You might want to consider calling the Montana Department of Business Registration (You can look them up on the net, as I do not believe the mod wants us to post numbers) and ask if this person has a business license. It is interesting that she indicates she is incorporated by the "Inc." Is this so? Find out from the State of Montana who sits on her Board of Directors and their addresses and cc your letter(s) of complaint not only to the IRS and Labor Board, but also to the Montana Department of Business Regulation or whatever the licensing entity for Montana is. Montana does have a state income tax, so you might want to contact the Montana State Tax Commission as well. If she is playing fast and loose with employee classification rules, she might well be playing fast and loose with tax rules, too. Or not. We cannot know, but the proper regulatory agencies have the authority and reach to take a look. How long has this "business" been in business? How much back tax do they owe to MTs past and present who were misclassified as ICs and therefore had to pay employment tax? What about Medicare tax? It doesn't sound like the company is large enough to come under the Obamacare radar, but there seems to be enough there that if somebody wants to throw the pass, the IRS/Labor Board/State Tax Commission/Business Licensing folks would make a great Dwight Clark to catch it. (Yes, I like football.) I say, go for it!
