She can be hugely fined and required to pay all back taxes that she has not for her "employees" she has wrongfully categorized for however long. As an IC you own your own business, you tell them when you are available to provide services and for what rate. They choose to accept or decline your services. As an employee they tell you when to work (or can) and at what rate they will pay you for said work. You choose to accept or decline. They then have to contribute to SS and Medicare tax, at the least. Depending on the size of their business and number of employees, they are now also required to provide health care options, also.
