Shouldn't all MTSOs be investigated by the Dept of Labor? - Please share any info on suits.

Posted: Apr 04, 2015

Landmark:  They were sued with a class action for FLSA violation, for "willfull and reckless" nonpayment of overtime in 2011.  I have not seen a suit for minimum wage.

Anyone aware of any suits besides the one against Landmark?

all MTSOs subject to DOL and IRS, including FLSA - anon

Yes, all MTSOs are subject to the federal agencies and regulations. However, they typically don't hire "sniffers" who ferret out those who are noncompliant. They rely on information from those who are the victims of their illegal activity: like paying minimum wage for the state in which you live, paying OT for hours greater than 40 (some states greater than 8 hours/day), not paying the payroll taxes, not having sufficient workman's comp and unemployment insurance, insufficient liability insurance, a timekeeping that can be verified with no one changing timesheets after they're submitted, paying for training and all other required compensable work (like reading email, HIPAA training, etc.), and the list goes on and on including unfair discrimination.

The responsibility lies on us to do our homework, understand our pay and how it's calculated, and report all violations or suspected violations to the proper authorities. They only abuse us to the limit we allow.

That's one of the reasons our industry is in the state it's in--we've been asleep in terms of our rights and what the laws are. And as long as we're asleep, nothing changes.

According To US Dept Of Labor
Dec 15, 2012

Recognized as top career choice by US Dept of Labor Statistics, "employment of medical transcriptions is projected to grow faster on average compared to all other occupations through 2014." In addition, with new health care legislation, adding nearly 50 million people to health insurance will definitely increase the demand for more transcribers.   What a crock. ...

Approaching Dept. Of Labor
Jul 19, 2011

Alerting the Department of Labor has been bandied about regarding the unfair and unjust treatment that MTSOs like to dole out because they think they can get away with it, and we have, in a sense, just rolled over and let them for fear of job loss or being the troublemaker if we spoke up.  Perhaps it is time we find out if we have legitimate issues here and maybe something can be done about them, such as: 1.  Not being paid for spaces. 2.  Not being paid for demographics. ...

Found This Under Dept Of Labor.....
Aug 07, 2012

Off-the-Clock References The Fair Labor Standards Act (FLSA) requires that covered non-exempt employees receive at least the minimum wage and at least one and one-half times their regular rates of pay for hours worked over 40 in a workweek. In general, "hours worked" includes all time an employee must be on duty, or on the employer's premises or at any other prescribed place of work. Also included is any additional time the employee is allowed (i.e., suffered or permitted) to work. The amo ...

I Will Be Contacting My State's Dept. Of Labor.
Aug 19, 2010

Last pay check, I did not receive the PTO I requested in SS and was granted by my CCM. I contacted payroll immediately. Mind you, this happened to me once before.  It took 1 email and 1 phone call and I had a check the very next day. It is now a week later.  I have been around and around with payroll and my CCM.  FINALLY, yesterday, I get an email that they owe me the PTO and will add it onto MY NEXT CHECK. I don't think so.  That is money that I earned and am entitl ...

Waiting On A Call Back From Dept Of Labor
Oct 07, 2010

I would encourage everyone to call their local DOL about this issue. When we sit here for 20-30 minutes typing a job and lose it due to no fault of our own, we should be compensated for the time that we sat here.  I left a message for my local DOL, hopefully will get a call back, but it seems to me that constitutes not getting paid for hours worked, which is illegal.  If anyone else has checked into this, let me know. Thanks! ...

LM Line Count Will Be Investigated.
May 26, 2013

My niece is willing to look into the matter. She is an attorney and is contacting the labor boards.  She is requesting all keep documentation and compare in open word document against your line count you get from your finished document.  She said Medquist was brought down by these same misleading practices and had to pay MTs back, and she is willing to do the work.  I too have asked about my line count and was told to work harder.  Well, if I am wrong,  nothing to lose.& ...

CA. Labor Board States "Good Case" Regarding Unpaid Labor
Jun 22, 2015

A fellow MT posted on the Nuance board that she contacted the California Labor Board regarding unpaid labor.  I hope this case creates a precedent!  For me, some jobs are so laden with problems half my time is spent researching and correcting dictator errors - for no pay!  We are not paid to check email, answer email, train, review of all the documents emailed to us, review changes in procedure, doctor exceptions to the rule, working with tech support, reviewing QA, searchin ...

All Companies Need To Be Investigated By The Senate Floor...VR Needs Investigating
Jul 06, 2014

So tired of hearing "VR is here to stay, and get used to it, and this is the going rate."   A plain chest x-ray cost is now over $800, and they send it off site to be read.  A sleep study is over $5000. There are multiple hidden ways of price gouging, yet this profession is being used for others to profit.  Who is regulating all of this as you have absolutely no recourse even as a patient.  VR has eliminated MTs, yet the radiologists be ...

Should I Or Shouldn't I...
Aug 11, 2011

I worked for a local hospital as a medical transcription clerk routing work and such to transcriptionist about 1-1/2 years ago. I left that position as I met someone in the transcription department at the hospital in the same department that allowed me to work from home.  I have been working for this person for 1-1/2 years subcontracting work. I just found out the same hospital has 2 open transcription positions in the same department which I am interested in. I am afraid that if I app ...

I Shouldn't Have Taken This Job (venting)
Oct 21, 2010

I actually like the job. The dictators are fine. I'm a month into the job and now in the comfort zone, past the breaking-in period. But this is my first time doing voice recognition, and the pay is too low.  I really didn't have any experience in knowing an acceptable rate for VR. It is my fault for accepting the pay, because they told me what the pay was before I accepted the job. I'm not trying to blame my job at all.  But I was just too eager to be getting a ...

Ummmmm, it is in the list I sent you...  TSMs are sending out their famous backlogs....THEY should know I am OOW, but I feel almost guilty telling them I am OOW.  I have had TSMs tell me that no one else was OOW on such and such a date. work off their regular hours for OT! I'm just astonished at all the nice work there is off of my regularly scheduled hours this week!! I thought that kind work was all gone! Got my lines so easily. What an eyeopener. Don't doctors rotate shifts they're on to different times of the day? And weekends? Why are mine always the same no matter what day? Now I know. Looking to leave now. Abbreviating Words That Shouldn't Be Abbreviated?
Jun 18, 2011

How do you treat words that the physician abbreviates that shouldn't necessarily be abbreviated? For example, I'm transcribing for an ENT physician's assistant who routinely will abbreviate medications or conditions in her haste to speak quickly. In a dictation I'm working on now, the patient has "a perfed TM and is on Oflox. otic suspension" (the patient has a perforated TM and is on Ofloxacin otic suspension). I tend to remove the abbreviations and type out the full word ...

Email From IT Dept At Imedx
Dec 02, 2014

I just love emails from IT department at imedx. It is like solving a puzzle to figure out what they are trying to communicate. More fun and sparkle added to my day! Message to Imedx: Hire 1 English as first language IT person to commicate with your US employees. This is just common sense, which in my opinion most of your decisions so far seem to be greatly lacking! P.S. Sure ...

Since The Quarter Ended 09/30, Shouldn't Our Webclock Reflect.....sm
Oct 09, 2013

The score for this quarter?  Mine is still showing my QA accuracy score exactly as it was prior to 09/30, which made me ineligible for the weekly production incentive bonus for the entire last quarter.  So now my "new" score for the quarter that ended 09/30 is 99.28%, which would mean I'm eligible for the weekly incentive bonus for this past week, right?  However, my Webclock timesheet shows the 98.64% score from before 09/30 and shows me with an incentive (Better Me Better W ...

HIPAA Violation? My HMO's Records Dept Accidentally Sent
