Off-the-Clock References

The Fair Labor Standards Act (FLSA) requires that covered non-exempt employees receive at least the minimum wage and at least one and one-half times their regular rates of pay for hours worked over 40 in a workweek. In general, "hours worked" includes all time an employee must be on duty, or on the employer's premises or at any other prescribed place of work. Also included is any additional time the employee is allowed (i.e., suffered or permitted) to work. The amount employees should receive under the FLSA cannot be determined without knowing the number of hours worked. The materials listed below provide general information concerning what constitutes compensable time under the FLSA.

...and as far as anyone can tell she might be planning to call the company to complain, not DOL.

It's only "clear" if you jump to conclusions.

I hope this applies and something can be done to help our working conditions. When I inquired, I was told we were under different rules since we are paid by production. It really stinks and I hope you find out better news!

I will go out on a limb and guess the MTSOs know the labor laws and skate right up to the very edge of them without crossing over.

Yes, you are right. Maybe we should see if we can talk to Mitt Romney or his camp and see if he can send the some labor jobs to India as he farmed out another call center in Massachusettes.

Something needs to be done about these companies and their lying and cheating. Medquest, rebranded as M-Modal, still a thief and a liar. Nuance liars too, and apparently so is Transcend. Nuance, the crap, "See why we are bettwr together". How, just a bigger thief and a bigger liar. For Mesquest, rebranding does not change who you are. If Jeffrery Dahmer changed his name to Mother Theresa, would that make him any less than a cannibal, rapist? I hope you can get some compensation. However, so post regarding Transcend about suit would probably be swept under the rug and settled for pennies. I believe that, as "judge" allowed Medquest to "give the money to charity" after transcriptionist filed suit. Their needs to be a group of us that sticks together and fights. The money should have been given to the transcriptionists. Hope you find JUSTICE.

All this crap about clocking in and out when there is no work, and then having to "make up production" on a schedule I did not agree to. If there is no work during my schedule hours, then my employer has to pay me for the time I sat here. Period. That is what the DOL told me, and then told me to "double check" with the DOL in my region, which would be in Tampa.

I didn't take a job so I could be available 24/7. They offered ME a schedule and that is what I work. Don't get me wrong, I don't mind helping with overtime now and then, but this weekly F-M crap of help us is getting old.

Last pay check, I did not receive the PTO I requested in SS and was granted by my CCM. I contacted payroll immediately. Mind you, this happened to me once before.  It took 1 email and 1 phone call and I had a check the very next day. I would encourage everyone to call their local DOL about this issue. When we sit here for 20-30 minutes typing a job and lose it due to no fault of our own, we should be compensated for the time that we sat here.  I left a message for my local DOL, hopefully will get a call back, but it seems to me that constitutes not getting paid for hours worked, which is illegal.  If anyone else has checked into this, let me know.
