RE: DISABILITY AND HIRING/FIRING PRACTICES - Jasmine 215

Posted: Mar 20, 2014

Hi,

I was just pondering something:

This does not apply to me personally, but I was curious as to whether any company, say MModal, Nuance, etc. have ever laid off any disabled employees, like visually impaired, paraplegic, etc. due to quality of work or whatever.

I was curious if they have employees who work for them who are disabled in this way and if they have ever terminated any of them, what kind of legal trouble could they make?

I don't know about currently but 15 years ago M*Modal which was then MedQuist had hired 2 or 3 blind MTs but they provided their own equipment to transcribe with. Until I left the company those MTs were still working there

I was fired for making mistakes because of a hearing - Me

problem. My manager wouldn't let me switch accounts to one with good sound files that I could hear. The company said they could get me some volume-boosting earphones but that's all they could do for me, but I already have that. So it was adios, you make too many errors after 9 years doing 5 other accounts in another region without a problem. I wrote articles for the company newsletter about different types of hearing loss and how we hear things, how to treat people with hearing impairments and got ignored. Screw them. I filed for unemployment and had no problem getting it, they didn't bother to answer my claim. I tried for Social Security disability and I'm 25 dB too low so I'm on straight Social Security. The company? Precyse.

Have you tried using the ADA ? - anon

It certainly would be worth giving it a shot. Maybe a civil rights attorney would be willing to take it on a contingency basis. May also consider contacting many of the national hearing loss organizations, maybe they could give you some info on what protections in employment there are. Did you save all your emails for documentation?

I tried ADA, lawyers, civil liberties/rights, you - sm

name it. Sent emails, all the info I had and they all said the same thing - what Precyse does is dirty but technically legal. I'm not the first, won't be the last. The only other accommodation other than headphones was they would have to change the entire system and that's not economically feasible. Wrong - they could have put me on an account with clear sound files but that goes back to the account manager and they stick up for their managers no matter what; things are always twisted so that it's the MT's fault. They tried the "change your schedule" excuse too. How is a change of schedule supposed to improve a sound file? Bah, I'm glad I'm out of the whole situation.

Precyse Hiring Practices
Feb 07, 2013

Hi everyone:)  This is in reference to the message left about applying for work at Precyse.  One MT stated that their hiring practices left a lot to be desired and she took the test and felt she wasted her time.  I am now among the ranks of those that tried and didn't make it.  I took the test, and looked over everything carefully and felt I had done a good job.  I took the job in the late evening and not even 1 hour later I got a message that I was not a "good fit ...

Deceptive Hiring Practices?
May 26, 2013

FYI, when negotiating with potential employer, DO pin them down in detail about how they pay for *editing*. My recent experience: Offered job paying 8 cents straight typing (which there is not much of), and 4 cents for editing. I was aware up front that the edited line was considered 1-1/2 *regular lines*, or 97.5 characters (Visible Black, of course) constituted an edited line. Most recent information regarding this pay, their software was not able to calculate the 97.5 rate for editing, so t ...

Voice Recognition Vs Transcribing, Unjust Hiring Practices
Mar 21, 2011

Over the past four months I have been hired by companies ***** after passing all the necessary tests and background checks as a medical  transcriptionist.  Each and every time I was offered $ 0.9/line, told I would have very little voice recognition if any which, would pay anywhere from $0.3 to 0.5/line. Once I get onboard and through training, I find out 90% is voice recognition!!  I am applying for medical transcriptionist jobs - not Editor, QA, or Speech. I have been in t ...

Firing Good MTs
May 07, 2010

Below someone commented that good MTs are let go.  That they see a trend.  That they project this is because the "older" MTs make more. First, "good" MTs are not only or always "old" MTs.  Sometimes quite the opposite. Second, what constitutes a trend? Third, what kind of sense does that make?  If an MTSO is in business to make money, they need to get the lines typed.  More experienced MTs do not, as a general rule, get paid more money than less experienced but equal ...

What Is With All This Firing And Termination This Week...
Nov 04, 2012

People are being terminated without warning at M Modal, according to the board here.  People are being picked on at Nuance even more than usual by QC and supervisors.  These are the 2 biggest employers in the industry.  Why this now?  And most people only make minimum wage.  There can't be such a big economic reason for firing people who are paid so low with this kind of technical skill.  What is going on here... and why... thinking aloud, but ideas would be ap ...

Okay So I Definitely Know Today Is My Day For Breakdown And Ultimate Firing
Apr 06, 2010

This is my end.  I have received back to back ESL horrible doctors that slowing down only obliterate more.   They absolutely know NOTHING in how to pronounce the simplest drug names, and have butchered it beyond control.  All from the same hospital from the south.  Now oncology notes and are whizzing past the difficult chemo meds so fast it is virtually impossible for ANYONE even Indians to decipher this garbage.  This on top of a major error MQ has made concerning ...

CO Hospital Employees Threatened W/ Firing If They Don't Get Flu Shot
Oct 06, 2012

This makes me REALLY glad I am getting the hell out of health care!   These draconian measures are being implemented across the country.  Most require that ALL employees -- even those who work off-site and have zero patient contact -- receive the toxic injection or they will lose their job.    Check out the comments.  I was VERY heartened to see that the vast majority of them are by posters opposed to the mandate (several very educated MDs and RNs po ...

QA And Feedback Practices
Oct 03, 2011

I was wondering what others think about this.  When QA sends feedback at my company, the feedback is also sent to all regional manager and all the team leaders in that region. I think this creates unnecessary embarassment and humiliation for the MT getting the feedback and I feel this practice is unfair, especially when they are not critical errors. Feedback is supposed to be helpful and encourage the MT to improve and step up their game but when it is done th ...

Shady Practices
Apr 02, 2013

I recently got 'promoted' to MME, having taken the test with the understanding that I would receive a 5% pay raise to my transcription and VR base rates (according to MM intranet MME FAQs document).  But the recent e-mail we received, asking tier-3 MTs to become MMEs, says we are "eligible to be considered for" a pay raise.  What?  Does that mean my raise is going to be raffled off or something?  Feels like bait and switch, and just another example of sketchy practi ...

Did Anyone Else Get Get An F11 Best Practices Email?
Apr 10, 2013

I F11`d a report a few weeks ago and now I got a generic F11 best practices email. It states the only acceptable use of F11 is an exception listed in a CP. I have never seen that in a CP! I have also found, besides being very inefficiently written, many CPs are out of date, i.e., states you must do certain things that have since changed. It is SO frustrating! The document was such a hot mess that I had to retype it as 90% of the ASR was garbage. ...

Who Do I Contact About Unfair Labor Practices?

I had a very bad experience recenly with a company which will remain unnamed.    I had been  intentionally decieved about some policies.    If I recall correctly I had read something about the labor board.  I was wondering if anyone could tell me how to contact them.   This was an INTENTIONAL , DELIBERATE misrepresentation.   Since I am no longer with said company I really have nothing to lose.   I have also read repeated co ...

I'm On Disability
Aug 19, 2010

I'm a disabled MT (Radiology) and am able to earn $720 per month per govt guidelines. I had the ideal job until recently thanks to VR. I was able to work a few hours each day until I reached my $720 limit. Don't think I could work 8 hours at this point so giving up my disability is doubtful as I have lung damage. I am finding it impossible to find employment because I have to tell them that I can work...but only able to earn $720. I'm frustrated. There has got to be another ...

Disclosing Disability
Dec 31, 2012

My current MTSO gave me the option of employee status or IC. I chose IC. One of the reasons is because I have disabilities that do not allow me to work without breaks: CTS and neuropathy from a spine condition that causes unbearable foot pain with one particular dictator who requires constantly having to flap the foot pedal to try to make out what she is mumbling. They never gave me a schedule but I take about one day off a week and put in my agreed time per day. I have not disclosed my disabili ...
