As of 08/09/2013, so how can they say the position has been eliminated?  I took screen shots of the post for my attorney, so even if they take it down I have proof.  it's on a prominant board for MTs looking for jobs.  Not allowed to link here, but it shouldn't be too hard to find for a bunch of smart ladies like you guys.

For most MTs who were recently laid-off, I don't think this situation - is actionable

I have known many, many people who had worker's comp claims who were "laid-off" or flat out fired prior to their claims being resolved or very shortly thereafter and they ended up with nothing more than the percent of disability an IME gave them. The Labor Board is a joke, at least in my experience. I worked for a doc's office that handed a bazillion WC cases and did the IMEs.

I do feel bad for your situation and I certainly understand your anger.

However, to the average MT who got laid off, instead of counting on some lawsuit to bring you justice in a very unjust world, I highly recommend you be very proactive, move on and contact TAA.

I don't think anyone is "counting on some lawsuit", I think we're angry and feel betrayed by a company that we've been devoted to. Whether we have valid claims or not is for an attorney to decide.

In the mean time, after picking ourselves up from being blindsided like this, most of us will do what we have to do to keep our families afloat. Many of us are single moms whose only source of income was just snatched away.

Am I going to look into taking action while I pick up the pieces of my life? You bet I am, and so should everyone else who feels they were wronged, or at the very least, have a free consult with a labor lawyer. Won't hurt and might help.

The reasons companies like this get away with what they do, is because some people think nothing will come of fighting them. On the other hand, the reason companies like this are taken down, fined, and exposed to the public, is because some people think something WILL come of fighting them. I know which camp I'm with.

Is how you people constantly, chronically complain about how horrible it is to work for MM and how you wish you didn't work there, but god forbid you get let go and you throw a huge hissy. Can't have it both ways.

unemployment. TAA does not kickin until UE runs out. A lawyer is unlikely to know enough about TAA to help you and can't do the paperwork necessary. It can only be done through a OneStop office.

I retained him when MM "lost" my Worker's Comp claim. I still have an open claim.

Before we were "terminated or laid off", whatever you want to call it, we did our job great, had 99% or better QA, and were let go with no reason, only to find that they are hiring others to replace us, most likely newer people for less pay. We may get unemployment benefits, but what I tell you may interest you. I got paid an amount per report doing radiology and cardiology. Working late into the night all you got was heavy ESL and sometimes it took you 4-5 times longer to type these reports and some were 10 minutes or longer. Per report you got paid less than minimum wage for your state and much less thanyour hourly rate. When this happens they don't pay you the difference and you make less than $5 an hour. That's why you need a lawyer, to get what you should have gotten when your production fell below the minimum wage because of the script they had you on. They are getting away with this and most people are not dealing with it for fear of losing their jobs. In this instance a laywer may help you to get the backpay that you were entitled to. It is worth a try.

I noticed the advertisement and actually did re-apply the same day I was shut down, mostly to see if I would get a response of some kind, as for the day that I got my fatal blow, I was led on a wild goose chase of numbers and no-one answering. I even followed up to make sure my application had been received. A disinterested third party who handles applications answered and said, yes it had come through, but could give me no explanation why I had been told a few minutes earlier that parttime had been "consolidated" and was no longer available (he was a contract company, did not work for MModal.) I see, however, that you are correct that parttime is still being advertised. I also inquired at another department internally if there had been accounts lost to explain for the "there is not enough work" excuse for this massive lay-off this year and still only told I would receive a letter in a few days and really no answer to that question. I am happy to learn that you have an attorney to hopefully get the ball rolling on what appears to be bigger than I initially had thought (posts keep appearing, and that does not account for the larger number out there in isolation.)
