I have been waiting for final pay from MTSO since May when check was "sent" It has not been received by me, nor has it been returned to MTSO. Operator of MTSO says they have "fulfilled their legal obligation" and the fact that I have not received money is unfortunate. Apparently no new check will be issued or Direct Deposit made until original check is returned as not deliverable. Thoughts and advice please? Yes, I have emailed weekly and have the same response.

since May, and keep saying they sent the check, but do not send documentation of that, i.e. check # etc. they are lying. contact an attorney and get what's due you. I am assuming you have documentation, of course, that you were never paid. Do it.

might be the cost. Our firm charges $400/hour. She may want to call the Bar Association where she lives--many state and local bar associations offer services to people with low-income which is generally defined for the purposes of low-cost legal services as around 60K a year. She may be able to find a lawyer who will write a simple demand letter for $200.00 or so. If I were a lawyer (not quite yet) I would do it for free, as this kind of thing makes me mad!

And make a lotta noise. Tell the company that you are going to post their name on this site, that you will contact labor board and better business bureau, that you will put an ad in the newspaper local to their business location and the location of the hospital you worked on... squeeky wheel gets oil.

after reading much documentation from both sides, they will only tell you to contact an attorney anyway. no complaint will ever be filed. skip this step. useless.

Write her a demand letter stating that she has five (5) days to pay in full or you will:
1. Notify the Labor Board.
2. File a complaint with the Fraud Division of the Attorney General in your state and with the Fraud Division of the AG of the state in which she does business.
3. Ask her in your letter if she has a business license, is a corporation, an LLC, a partnership or what, as if this matter is not settled in the time frame referenced above, you will sue each and every party jointly and severally, not only for your wages, but for any and all additional penalties available.
4. Copy the letter to the BBB. Although they have no legal teeth, she will not want the letter going there, as new potential clients (hospitals and docs) might see it.
5. Be sure that you send your letter certified mail with RETURN RECEIPT REQUESTED. Specify that SHE herself is to sign for it. At the top of your letter type:

VIA CERTIFIED MAIL, RECEIPT NUMBER (and type the number of receipt in). If by chance, she refuses the letter, keep the letter.

The very last shot would be to turn the bill due over to a collection agency. Of course, they will keep a percentage of what they collect, but at least you will get something rather than nothing, AND you will put her on notice that she cannot mess with people. If you are an employee rather than an IC, you might want to run this by the IRS to make sure she has been sending in the money withheld for that purpose. If she hasn't been, she will be in a world of hurt when the IRS finishes with her.

Thank you to everyone for your support. I have indeed contacted the Department of Labor in Florida and have "set the wheels in motion." I will keep you posted of my progress. Also, I have sent 2 emails regarding the MTSO non-payment list on this site but have had no response. Thanks again everyone

I finally cut ties with the Q after being returning to work for them and finding them not to be the company they once were or the pay was not the same. After careful consideration and finding another position, I resigned. Awaiting my pay out from my PTO and being told it would be deposited today, nada. Anyone have any idea about this? This was published in the Federal Register last week, correct? I have a friend who is in a battle with an insurance company over a very sick child. They are always throwing up obstacles for coverage. She told me that out-of-network treatment is covered at 50% of 200% of Medicare rates. So we are trying to uncover exactly what that rate is. I was curious to hear if anybody failed the second part of the final? I got a 13% on the second part only because I was having serious trouble hearing the doctor clearly. I resigned from MModal a week ago, June 23rd and received my final paycheck deposit yesterday. It was over $100 short! I worked the same number of hours I also do and transcribed within the ball park the same number of lines. I also had 12 hours of PTO they owed me for that I had not used. Has anyone ever been told that the final pay from an MT company will not come all at once, and will be divided up into 2 final payments? I thought this company would send me one final check, but she stated that they are sending it out according to their pay schedule and the final check will not come until the second week in June!! Can anyone tell me in no uncertain terms, with absolute certainty - is crepitance a word? I cannot find it anywhere EXCEPT on sites like this where MTs are saying it is not a word.
