The main reason you can be denied unemployment is if you have not earned enough money during the qualifying period (usually the last five quarters, excluding the one we are currently in, depending on your state).

If you have earned enough during the qualifying period, it is very hard to deny unemployment unless the employee did something willfully very wrong or harmful in the workplace.

"production" doesn't matter. The only thing that matters is whether you earned a certain amount of money during the qualifying period.

When work started dwindling, I applied for partial UE and was originally denied because my boss claimed I was working full time. I documented everything (including screen shots of NJA and all emails) and I appealed the original decision. I was able to prove that I had been, in fact, reduced to part time through no fault of my own and the decision was reversed. All I can say is, you need to document everything, even if it might seem trivial at the time.

I get partial benefits most weeks as I don't make my weekly minimum of 350 (sheesh.. sucky value to start with when I used to make 800+ a week)...

If I earn more than 350 in a week, my benefit is nonexistent. But if I earn less, the first 116 is "bonus of sorts" and I get up to $466 total of wages and UE.

Just be sure to send a resume 2 or 3 times a week, work less than 40 hours...

I keep a daily log in one of those stenography-size notebooks. Even though we have to punch in, I also record the times in and out in my log, as well as any downtime and times during which I see NJA. On the rare occasion that we are asked to do overtime (which is never paid overtime), I print out the e-mail and keep it all in a binder. I hate to say it, but you gotta look after your own self in this game.

I tried applying and was turned down due to being an independent contractor.

that's a given internationally. companies don't pay - into unemployment taxes for ICs. NM

They don't pay ANY taxes on ICs. Unemployment money doesn't exactly come out of thin air.

It may be state to state also but let's say you had a religious reason for not working saturdays or sundays and they said to you "if you work sundays and saturdays you will have work" but you were not hired to work these dates as you stated when you were hired it was because of religious reasons, can you get unemployment? Wondering....was forced to change from statutory employee to IC status with federal ID number instead of SS# when MDI-MD was rolled into Transcend. Now, Transcend informs that they are NOT going to be employing ICs after Jan 1, 2011. Start getting paperwork documentation in order NOW. Here's hoping you don't need it, but you will be that much further ahead if you do. Even if you're not at risk of being fired, laid off could be possible and you would still need this. So much fun filing for partial unemployment. Have to send in weekly gross wages, which MMODAL say they can't let me know that until 3 days before payday, which does not work, as I have to report WEEKLY or I lose benefits for that one week. Just have to guesstimate what I earned by line counts straight and VR, but can't figure shift differential or what they screw you out of if you send too many QAs. YES!!!!!!!! Ladies and gentlemen there IS hope! Because my employer dictated my hours per week, per day and the time I was to work unemployment considered that to be an employee status and NOT IC even though they didn't pay my taxes. This was the decision made after my prior employer appealed my unemployment benefits from them. Wondering if any long-term MTs are out there that have had problems since going to SR have gotten fired and qualified for retraining through unemployment? beyond smarmy, they terminated the part time MTs because when they apply for unemployment (and they are without question able to get it because their jobs were eliminated) they will find the govt will document the last five quarters of their employment and base their rate of pay on a percentage of that.
