reluctance to pay the minimum wage and that, when they do pay it, they threaten you. It's true and should throw a wrench into any attempts by Nuance to stop your collecting unemployment benefits.

Technically, I believe we are "at will" employees as an MLS. We're not IC's and aren't "exempt" (salaried) so therefore shouldn't have a contract.
As for not meeting these //new// requirements, I think we really would have even more on our side in regards to getting unemployment since they technically changed the job requirements after we were hired, which to me means that if you became unemployed because of that, you had nothing to do with becoming unemployed (as opposed to just not showing up for work, etc.)

let go, but as long as it wasn't something atrocious (embezzelment, etc.) you can collect for being let go for that reason. File your claim right away though so the clock starts ticking in case there is a waiting period (sometimes 7-10 days is all)

It depends on your state. Here is some info I found through my state web site.
It depends on your state's eligibility requirements. To collect unemployment benefits, you must be out of work through no fault of your own. Most states consider employees who are fired for performance reasons or simply because they are a "bad fit" for the position to be eligible for benefits. On the other hand, an employee who commits serious misconduct, such as stealing from the company or violating important safety rules, probably won't be eligible.

Thanks. I have not been let go yet and I do not work for Nuance. I left Nuance over a year ago. I thought I was in for a better ride, but NO! I just have a feeling....I get dinged for a little less then 98% QA. Then when I slow down to produce great reports, I get dinged for low LPH. They keep threatening me with FORMAL NOTICES and FORMAL AND FINAL NOTICES, ETC.

I would try to get, but it depends on what your state requirements are. I was in the same boat with them, back and forth between production or quality. I think in Ohio you have to have 20 weeks of employment. I was a sole proprietor previously, so I cannot count that towards it. Gee, they got me out of there a 18 weeks. I think they know what they're doing.
Wondering....was forced to change from statutory employee to IC status with federal ID number instead of SS# when MDI-MD was rolled into Transcend. Now, Transcend informs that they are NOT going to be employing ICs after Jan 1, 2011. Would like to apply for unemployment, but am being told by a number of people that is not do-able because wages were paid under Federal ID #, not to my social and I signed an IC contract (under great duress, I might add!)

Start getting paperwork documentation in order NOW. Here's hoping you don't need it, but you will be that much further ahead if you do. Even if you're not at risk of being fired, laid off could be possible and you would still need this.
It could be at least 21 days from the time the question arose, before you receive an answer about benefits. If your case is complicated in any way, it will take longer.

So much fun filing for partial unemployment. Have to send in weekly gross wages, which MMODAL say they can't let me know that until 3 days before payday, which does not work, as I have to report WEEKLY or I lose benefits for that one week. YES!!!!!!!! Ladies and gentlemen there IS hope! Because my employer dictated my hours per week, per day and the time I was to work unemployment considered that to be an employee status and NOT IC even though they didn't pay my taxes. This was the decision made after my prior employer appealed my unemployment benefits from them.
Please keep the faith that these companies who try to dictate to IC's their hours, ect will NOT get away with it forever!

beyond smarmy, they terminated the part time MTs because when they apply for unemployment (and they are without question able to get it because their jobs were eliminated) they will find the govt will document the last five quarters of their employment and base their rate of pay on a percentage of that.
