Your e-mail said: "I'm in California and was told I can't apply for it unless I get let go specifically because they are offshoring my job, and then only after I'm already on unemployment. Did you get MQ to tell you that?"

No. The caseworker for my TAA case told me that. Said if I knew of anyone else to tell them as well. Even if you have not LOST your job at all but have lost work, go apply for unemployment benefits and tell them your employer has a TAA contract and you are interested in job retraining through this option.

I specified I was still working, but increasingly afraid my job would be lost due to the company being owned by an Indian and knowing that our work is increasingly being sent there. I spoke with a man handling TAA here in CA, and he thought I needed to first be laid off, specifically due to my job going overseas, but suggested I ask the unemployment people. They reiterated what he said, that I have to wait to get fired first. I've been waiting like that for the past 2 years. If you have the name of someone that knows something the people in charge here in California, please let give me that contact information. I hate worrying like this. I'm afraid to quit only to find out I will be unable to qualify for UE let alone the TAA.

Not sure why the other person 'laughed' at me in the other post, but I also know what I'm talking about. My previous employer is still in the local area, but the manufacturing portion of the business was sent out of country. The fact that this was a "mass layoff" plus my job still existed but would be performed by a foreigner is what qualified me. I was a FT employee, so my situation is different from yours. You will need to find out what qualifies for you as an IC. *I* was told you do NOT qualify if you quit, are fired (you must be LAID OFF). If the company letting you go is simply doing so because they are going out of business, have lack of work, that does NOT qualify. Your job must continue to exist but will be performed overseas. That is the purpose of TAA. Again, you will need to find out what exactly applies to your situation.

In addition, the company must officially report the intended mass layoff. This notification is the other key to eligibility. The person in the other post mentioned there was already a TAA 'contract,' so maybe that notification is already in place. I was also told if 3 people at one employment location are laid off at the same time, they collectively can request the notification from the company in order to qualify.

I am simply sharing what I've learned in WA state. You need to research what applies to you in your area.

that they are trying to make the lives of American MTs difficult so they could send our work overseas. They put increasing pressure on us so that we either quit, or get fired because we cannot meet their new demands. Wow.

1. You must qualify for unemployment before you can get TAA assistance.
2. You do NOT have to wait until you are fired or let go to draw unemployment! You DO, however, have to be losing income each week (not enough work) to file an unemployment claim.

I DREW UNEMPLOYMENT WITH MEDQUIST WHILE STILL EMPLOYED BECAUSE THEY WERE NOT PROVIDING ENOUGH WORK EACH WEEK!!

I NEVER quit and they have NOT fired me but now I qualify for TAA and am in classes right now at my local university completing an Associates Degree in Nursing (RN).

3. You do NOT have to be TOLD by MQ that you are losing your job BECAUSE of offshoring! Their TAA contract is already approved. If you lose wages and/or your job you can qualify!

IF you are finding the NJA issue, the next day that happens GO FILE AN UE CLAIM!! Get started with that UE claim. TAA will THEN send you a letter about all the options under that program!

That's exactly what I did. I had NJA and got tired of sitting and waiting for work only to come up short. I finally had enough. The next NJA I had, I went straight to the DWS and filed an UE claim, explained that there was not enough work to keep me full-time and I would be PUNISHED by either losing my job and/or INVOLUNTARILY reduced to part-time status because THEY DO NOT HAVE ENOUGH WORK BECAUSE IT IS OFFSHORED TO INDIA. I also told the DWS (for my UE claim) that MQ already has a TAA contract (which is ONLY approved because they are losing a significant amount of their business to offshoring).

and I suggest you all do too. To your TSM. Allow some time for answers; however, I would keep e-mailing/calling and don't let up. Besides it might be slightly illegal is the fact that it isn't fair. When a company decides to make an account VR, are all the reports a mess to begin with for weeks or months until the voice engine (sorry if that's the wrong term) learns from the "straight" transcription that is done? Why do different platforms matter (i.e., E-scription versus M-Modal, etc).
