Can an MTSO enforce mandatory OT? - So sick of this!

My MTSO has basically enforced (aka guilted us into working) OT since April 1st or there abouts. We've had less than a handful of days that it was not required. Each day I check my email I'm looking for the OT requirement ("at least 1 hour or more if you can") and now today's email basically states that mandatory OT is enforced until further notice plus extra volunteering on weekends and they are recruiting new MTs as well. I already work 6 days a week, about 45-50 hours, and am physically, mentally, emotionally drained. The only "perk" of all this OT is more $$, but it can only be on a certain account that is worked during that OT only! How can I keep track of how many lines I typed during that exact hour of OT while making sure it was only on that certain account? I've tried also to just ask for any reports out of TAT or late ones or stats to do during my regular shift so I do not have to work OT. Like give us the work in order of TAT....duh! I like to be a team player but come on! We all have lives outside of MT. If we are not able to work OT we have to email and tell them why too. I have had days where I did not work that extra hour of OT and did receive an email about why did I not work it? How is this legal?? (My MTSO is not N or MM either). Gawd I can't wait to get out of here!

So basically if I don't work the OT then they can fire me, not pay me UE, and then state that I refused to work and have bad attendance, etc thus hindering me from getting a new job?

But knowing my luck with my MTSO, if I don't work OT then I'd get fired.

And I did Google it for my state and could not find a definitive answer.

Should I contact the labor board/DOL? I found a link for the WI DOL about filing a complaint but I don't want to go that far (yet). I'm just sick and tired is all.

It does appear that employers in the state of Wisconsin can schedule mandatory overtime.  See the link below, but here is a quote from the "Over 40 hours" heading:


"Employers may schedule employees any way they wish. This means that overtime may be made mandatory. Since employers may schedule as they see fit, they may also change employees' schedules during a given week in order to prevent them from working overtime in that week."

I've been to this link before I came on here to ask as I thought maybe somebody had experience with this or knew how to get more answers.

Also, I tried searching for production only employee or piece rate paid employee and couldn't find anything specific to that. I guess there's just no way around it unless I file a complaint, call the DOL directly and ask, or see a doctor about getting a note to not work over a certain number of hours due to carpal tunnel and all that, but then that's a work comp claim because I'm not paying for that even with my insurance. So I guess I'm SOL no matter what.

I was on "mandatory" overtime for almost a year, working 1 extra hour every day we worked. I didn't think it would ever end. Not sure we got compensated very well for it either. From here on out, I will not do overtime, mandatory or otherwise, although my group hasn't been asked to work mandatory OT yet.

I find it funny that people complain that there is no work and can't make any money, and then when given the opportunity to make more money, more complaints. You can't have it both ways.

I see any OT as an opportunity to line the coffers. I can't remember the last time I worked less than 70 hours a week.

Then again, I am 12 months from retiring to Hawaii at the age of 51! All that OT is going to have been well worth it.

When I worked there I ignored those e-mails. If I felt like working I did and if not I didn't. They never caught me or else they knew they couldn't enforce it. The funny thing is if you tried to talk to them about it then you got in trouble. So I avoided all of them like the plaque!! I got away with it until they let me go in August 2013 with all the other supposedly "part-time" employers. That was the best thing that ever happened to me. Good Luck.

I just got let go by my company reducing head count. I begged for more more, never had an email response. I got canned during Medical Transcription week, 5/20... Even missed my aunt's funeral to work and only to miss it to get fired basically!! I repeatedly asked for a different account, different secondary account and that is what I got... Looking for a job now... enjoy the OT because some of us are just wishing for something like that!!Feel blessed.

Perhaps I should know the answer but I do not.  What is the deal with the move to EMR?  Is it government mandated?  I just picked up a good side job transcribing for a cardiology group in my community and it's projected to last only until they go to EMR..the move isn't happening too quickly...are there penalties if they don't move to EMR?  Who is driving this? ...

Anybody enjoying the mandatory overtime.  Yea funny how we are on mandatory overtime and then get an email that states that if you run out of work, you are required to email them and flex your time and can only make it up after 5 p.m.  So again, you are required to check for your work throughout the day and if there is no work, sorry for your luck and if you want to be "lucky" enough to be employed w/ Nuance, you will then have to sign in and work on your off shift to make up your hour ...

Email received said basically,,,time sheet must be approved, make sure you have the required amount of time or PTO will be added to make up missing and you will need to re-approve it..I dont want to take PTO, I didnt run out of work, THEY DID..I put in my remedy ticket release without pay..How do they get away with that? ...

Mandatory Weekends....why?

Why do MTSOs require weekend coverage for every one of their accounts? I have 2 and have work up the yin yang during the week but come Saturday, I'm watching paint dry. My MTSO requires 1 weekend day, at least 4 hours. I changed my weekend shift TWICE to work during the "busy" dictation times and I'm still NJA. In my state, they are required by law to pay.  I called the labor board to verify.  By law, they have to pay if you are a non-exempt employee.  I can't file a complaint until the training is completed, but I can do it online the same day as I complete the training.  They (labor board) also advised that I keep emails and attach them to the complaint.  Unfortunately, it could take up to a year to get the money - my state is sloooow in resolving issues. I am curious to know if all this overtime every week is mandatory or not.  MY AM asks for overtime on a daily basis and wants commitments for the week. I have been doing it, but am to the point where I just dont want to anymore, I have things in my life that I need to do or want to do instead of spending MY free time always working, working, working. I was told by someone who attended a recent ICD-10 academy (for trainers) that the OIG is requiring all (current) coders to be certified by the October, 2013, ICD-10 implementation date.  I am aware of the OIG's compliance guidelines, but nowhere in that document do I find anything about mandatory certification. Also, I am not sure if they meant certified in ICD-9 or 10, but it is my understanding that the last ICD-9 CCS/CCS-P exam will be given in March, 2013, and at this point nobod ...

I was thinking... mandatory CMT credentialing might not be a bad thing.  I'd have no problem passing that exam, but would the Indian MTs?  If CMT were a requirement for ANY MT transcribing/editing US-based medical dictation, I think we'd lose our Indian partners pretty quickly. If AHDI could ("would" is probably more appropriate) make this happen, I'd gleefully pay CMT dues and attend all the seminars, etc. ...

I interpret mandatory fields as being those in the upper area that says mandatory plus any fields listed in the CP as mandatory. I interpret the lower fields listed as optional ADT (Alt I) as optional unless stated in the CP as mandatory. There are some accounts having problems with physician names not printing out right and have to be re-researched and entered. These are shown as having a question mark before their name. But, 99% of these have been in the Alt I fields, i.e., optional fields ...
