Beware of Atlas and Mike Mitkowski - Susan

Posted: Feb 27, 2013

He is just out there to waste time...here are some of the usual replies you will receive after you have tested.

1.  You made a silly mistake so I want to go in a different direction.

2.  There was better so I will go in a different direction

This guy only wants to get some files transcribed for free...keep away

Thanks for the warning! - MT

Same thing happened to me several weeks ago when he posted - I actually emailed him and asked what kind of scam he was pulling - of course, I haven't heard back. :)

I wouldn't necessarily call it a scam - SM

Something isn't right. I went through the process of testing. He originally said he was looking for an IC or a subcontractor. Fine. I tested, did well, and he sent me contracts. When I questioned the contracts, he said he was really looking for a subcontractor so that he didn't have to deal with scheduling or vacations, etc. I was very upfront that I didn't own a company, that it was just me. So, I don't know what that was about, but it was strange. Never heard from him again.

I would call it a scam - Fairminded

[ In Reply To ..]
because you didn't hear back from him AFTER you tested - sounds very much like he is getting work for free this way.

I did hear back from him after I tested sm - SM

[ In Reply To ..]
He sent me contracts to sign. The problem was that I was upfront that I needed to be an IC and he decided he would rather have a subcontractor at the last minute. This was after he sent me an abundance of paperwork to sign, contracts, etc. After he said he needed a subcontractor, at that point I told him that I wished he had said something in the first place and then I never heard from him again, because he wasn't interested in an IC. I totally agree that something is off, but I don't think he is trying to get work done for free.
Can you explain the difference for me? - Daisy
[ In Reply To ..]
What is the difference between an independent contractor and a subcontractor? Thanks!
good question - sm
[ In Reply To ..]
If you are an independent contractor, you have a work agreement with MD Group.

If you are a subcontractor, you have a work agreement with me. I send you to MD Group. MD Group pays me. I pay you (less).
But either way, you would be his subcontractor so - not understanding what you mean that he did not wa
[ In Reply To ..]
Do you mean he wanted to subcontract to a service so the service would then bring in MTs and deal with all the work for him?
I was responding to poster who asked what the difference is - sm

I was not commenting on this Mike guy. I was answering a specific question: What is the difference between IC and subcontractor?
Yes, that's exactly what he wanted. - nm

I am an IC with an MTSO and do not fit your definition. - sorry. sm
[ In Reply To ..]
You can be an IC (indepdent contractor) with an MTSO who CONTRACTS the accounts and supplies the work, or you can be an IC and skip the MTSO and CONTRACT your own accounts with the doctors/facilities.

Subcontractors are like my last MTSO who SUBCONTRACTED work from another MTSO who CONTRACTED with the physicians/facility.

I believe ICs CONTRACT (no sub) with the MTSO to work their accounts.

No fed or state taxes/SS/Medicare is automatically taken out your check as an IC. You have to do that yourself quarterly, and then figure out with all your allowed business deductions by April if you overpaid or underpaid, just like usual. There are more allowed deductions for ICs over employees with the home office. IRS rules change constantly as this work-at-home thing spreads to many, many job types now.
All subcontractors are also ICs, subcontractor simply means - you get the work through someone else and not dire
[ In Reply To ..]
from the client, but ALL subcontractors are still considered independent contractors. The only difference is how they obtain the work, either through 3rd person (i.e., MTSO) or directly from their own client. As long as you receive a 1099 and pay your own taxes, you are an IC regardless of where the work comes from. So this guy saying he does not want an IC but rather a subcontractor really makes no sense to me. Any individual he uses to do his client's work would be a subcontractor for him (and yes, they would still be considered an IC as well). I think what he means is he is looking to use a service, not an individual, and that makes me think maybe it's an offshore person and he wants an MTSO that will handle everything stateside for him. After all, someone pointed out in another post somewhere that he's using the Monsters, Inc., movie character name. Could be he has the same name as the character and it is just coincidence and he is someone who started a biz and knows nothing about MT. But, it could also be an alias for someone overseas trying to get a few US MTs. Know what I mean? I am just guessing but I suppose the point is, it seems fishy all around!
I think you explained this perfectly - on all counts. I totally agree. nm

Clearly a cheat! - Fairminded
[ In Reply To ..]
If you typed current reports for him and he INTENTIONALLY withheld the information that would have caused you to rethink in the first place, he is CLEARLY getting his work done for free.

I am all for giving people the benefit of the doubt, but I think this guy is taking advantage of people who are too TRUSTING.

And the details are very similar here - he doesn't tell ANYONE what he actually wants until some work is done.

EITHER he is testing to see if he should take the next step trying to find people to go find HIM clients, or he's getting work done for free, (or both))

He should be reported.
Really? lol Reported to whom? - nm

call? And how is this a HIPAA violation? It is easy to point out the fault in a situation, less easy to be the *someone* to do something about it.
HIPAA violations are reported to the Office for Civil Rights. - sm

Whether you will get any legitimate action or not is debatable. My one experience with OCR was a major waste of time and very disheartening. I ran across an MTSO online who had full patient files on their site for testing purposes that included identifiable info. These sound files were available to anyone, not passworded, and so I filed a complaint against them. The OCR rep believed every lying thing the MTSO said (that they weren't "real dictators" or "real patient names," etc., when they obviously were). So unless it directly affects me, that's probably my last time attempting to report any HIPAA violation I might run across, sorry to say.

The MTSO passworded the test files after that, at least. Unknown if they removed the identifiable info from the now hidden files or not, though. I thought about contacting some of the patients to let them know there had been a breach of their privacy, but decided to leave well enough alone at that point, more work than I was up to handling, especially after all the time and effort (forms, letters, phone calls, etc.) that I'd wasted with OCR.

If I understand correctly, this person is testing MTs with actual dictation! Not a canned report, not a report dictated by an employee of his business/company, but a report that actually needs to be transcribed on a live patient?

That has to be breaking some kind of HIPAA law. I know that HIPAA allows reports to be used for learning purposes, but they are already transcribed/edited reports, and do not include real patient information. I am fairly certain that there has to be an existing contract in place (whether it be with an MTSO or IC)that provides adherence to HIPAA law. He has no idea who the person is that is testing, it could be anyone. Several years ago thousands of patients in the UK had their information sold to medical supply companies. Private information taken from their medical reports.

Perhaps this person will see his name posted here and re-think his practices.

Oh yea, this guy is CRAZY! - Mj

[ In Reply To ..]
I tested for him and actually got a phone interview. He started the interview by asking me where I was located, the size of the city I live in, how many doctors, how many hospitals, etc. I haven't lived here a long time, so I didn't know as many specifics as he wanted and he seemed to get irritated.

He then explained to me that I needed to go out and visit doctor's offices and ask them to use HIS services. I then asked him if he was saying that I go out and get my own clients to type rather than him giving them to me. He acted like I was the stupid one and said, "No, let me explain this to you again" He proceeded to explain that each MT would go to their local area and gather clients to bring to him. We would not necessarily type for the doctors we bring in, that would be upon his discretion.

I told him I STILL didn't understand and if I were to go into the community looking for doctors, then I could type them myself and he said...."I am ALLOWING you to use my company name. You do not have a company, so to them you are nobody." He said in this field work is so low that people are lucky to get lines and by me going out and finding HIM clients that it would assure me to get to type some lines. No commission on getting him clients, no extra money, no bonuses, I just get to type the work and give him the kickback off of all of the work I put in.

Oh yea, I forgot - Mj

[ In Reply To ..]
I did decline his offer and he said that was good, because he was ready to withdraw his offer anyway, that I didn't seem like I had the ability to get things done. LOL, he is a dumb A$$

Are you kidding me? - Wow

[ In Reply To ..]
Really? So this guy is just using people like this to try and grow his business. Let this crazy person do his own leg work. Did he offer your any pay for each client you brought to him? This does sound crazy. Maybe he should be reported to the BBB.

No extra pay for clients brought in. - Mj

[ In Reply To ..]
I asked him what the pay was and he said it was dependent upon the client basis brought in. I asked him to give me a ballpark and he said starting at 5 to 6 cpl and "possibly" raising to 8 cpl.

oh yeah, he's a little MTSO - sm

[ In Reply To ..]
This is how someone without a clue or a skill gets a piece of the substantial healthcare pie. This is what MTSOs do. They bring our wages down but do nothing to bring the price of healthcare down, for they are taking that extra 7, 8, 10 cents per line that we used to make. And hospitals buy into it. For no good reason.

Mike - the numbnut

For such pro lamers, I would record some very vile dialogues from the movies and play them aloud.

As I read your - post

[ In Reply To ..]
the first thing that came to mind was this guy had what could be considered, as almost p!*p-like behavior. From your description of the encounter he was very disrespectful. You could have a company of your own quite easily, with just yourself as an employee. You're right, if you were going to spend your time, shoe leather and gasoline to get clients, get them for yourself, not this yahoo!

Where is this guy located? I thought maybe Vegas? - or am I way off?
