There are reasons why a company has to keeping hiring for the same positions over and over again. Inscribe is that company.  Most of the Tx are IC's but are forced to do the work of employees, i.e., training new transcriptionists, editing their work, being on call 24 7, computer-generated phone calls telling Tx's to get online any time of day or night, being on instant messenger AIM while transcribing in order to be able to help new people while you are transcribing - ALL WITHOUT PAY!  If you question in a nice manner why you are not being paid for your work, the owners rant and rave, make threats - the latest threat goes like this:  If you file a suit for wages we are going to only hire Canadians (to skirt the laws in the US).  I tried to point out that they are not following the laws set forth by the Fed Govt., I was terminated.  There is something very wrong with the management of this company, often sounding bipolar in my opinion. I do know they have lawsuits pending in several states.

Your job description sounds like a blend of management (salary, not entitled to overtime), employee (hourly, entitled to overtime), on-call (entitled to on-call pay or waiting-to-work pay depending on the restrictions placed on you), and IC (paying deductions). You could fill out IRS Form SS-8. If the IRS classifies you as an employee, and due to your special circumstances, you might be eligible for unemployment compensation. Because your situation is convoluted, accompanied by what sounds to be intimidation tactics, and you were terminated, consulting an attorney might be in your best interest--too many variables. Maintaining a time-and-date journal of work activities plus phone calls and intimidating statements facilities an attorney's job. Good luck.

As my copied email from the owner stating there were lawsuits still pending was deleted, I can only confirm it was sent company-wide. There continue to be threatening emails sent daily by the owners. Two suits were filed last week.

This original poster never performed in ANY capacity at InScribe other than as a straight line contractor. She has brought neither a labor dispute or any OTHER dispute against InScribe. Probably due to the fact that she has absolutely no grounds and no one will take her case! InScribe has one of the best retention percentages in the industry. The reason we hire so much is because WE HAVE SO MUCH NEW BUSINESS and are constantly hiring. Interesting too is that 95% of the people who DO leave at some point, return at some point - and we are always delighted they have come back home. Owning a business ain't easy - but I am grateful that we have very people who feel the need to try to injure the company due to being terminated.

Both lawsuits were filed against Inscribe, LLC 10 days ago, one with the State of California Labor Enforcement and the other with the Federal Govt. Other "employees" are getting ready to file in their States.
Paying lawyers and CPAs to conduct our side of these disputes is a very costly matter. We have decided that, going forward, if one of our contractors is terminated then appeals to their state to recover employee compensation, we will seek to recover our legal expenses.

Fortunately I googled ANP before doing anything and there are piles of complaints here and at other sites about them not paying MTs. I have gone round and round for days with them that legally they cannot require a schedule of an IC...but they don't care, one bit. ***** hires subcontractors and pays out of her personal checking account.  Says she pays every week, but does in the beginning then things happen......wrong postage used on check, somebody else got your check, wrong address, etc.  Several weeks late and then cannot leave voice message, does not answer IM or email.  On Call does not care because we work for BS and not for him.  Do not work for these people.  This happened to at least 2 MTs in the past 4 months. ...

My company was bought out by Nuance several months ago and it has turned into a complete nightmare!  Not only are the managers and sups arrogant and awful, but literally all the decent work has been sent to India and we are left with the dregs.  The benefits stink,  The people stink,  I feel so sorry for what you are in store for.  At the time of the buyout, we were told nothing would change.  That lasted for all of a month.  Then BAM!  Watch out! ...

Example, a 12 minute report is assigned, I would just get started on it and within less than 10 minutes they want to know where it is. WTF?!
