An if the plaintiff prevails then there is a good chance damages will be awarded as part of a judgement against the plaintiff.
So go for those NSF fees and any other financial hardship that is a direct result of chronic slow or no-pay.
The first step is notifying KS and the CFO that because of their neglect there has been costs incurred and demand remedy. Put it in writing so that in a court case it has been clearly established that there are clear damages as a result of KS actions.
