Wrongful termination? - anyone

Has anyone ventured towards anything like this?  I feel VERY strongly that I was wrongly terminated, but I really do NOT want to work for the company anyway, but with no income, I am not sure what to do.  I do not like the fact of them getting away with what they have done either...

Anyone gone down this route or had any thoughts of it?

I do not want to ruin future chances of me getting employment and wondering if this would lean towards that if I decided to proceed.

I've never been fired in my life from any job, let alone 12 years of transcription, and it's quite hard for me to deal with.

Not sure what your question is. You ask if anyone has ventured towards anything like this but don't say what this is.

If you feel you were wrongly terminated, file for unemployment to help with your compensation.

You dont relay the actual issue so it's hard to give you any advice.

As long as you have been paying into the UC and have had enough earnings in the past quarter, you should be able to collect.

because they cut my work load down so bad the last 2 months that I wasn't eligible... my least 1/4 wasn't enough... which would have been half of my highest 1/4 I guess that is how they do unemployment, I don't know I have never filed.

how you feel. It'd be painful to just swallow it and irresponsible to allow a company to get away with it, but sometimes taking care of yourself does require just walking away. At least you understand unemployment is definitely to be avoided if moving smoothly to new employment is possible. I hope you find a good position very quickly. Then maybe come back and answer questions posted about your previous company fairly and truthfully. :)

I needed a supportive post like this. I have been feeling so down. I know it's lame because I still have more than so many people and I am lucky, but I have worked my whole life as a transcriptionist and it's just sad and frustrating...
I am looking for jobs outside the MT industry cause I never want to work for a company again... it was a really bad experience so thank you I know I should just let it go but man that pride in me just sticks out sometimes I know I am better than what they said! :)

The first thing you need to do is file for the unemployment. Then contact an attorney for a consultation. Labor laws are pretty specific in certain instances, but some states are at-will and other are right-to-work. Also depends on whether you were terminated for missing work, not meeting productivity, not meeting quality standards, etc. and how many times you had had verbal and written counselings documented.

that was wrong, can you give the reason for termination. Also, I thought ICs could not collect unemployment because you're self-employed and don't pay into the unemployment compensation "fund" as the employer does that?

after this is all settled, i will say... I still have to have an unemployment hearing with them and don't want to ruffle feathers just yet! no doubt they feel they were justified, of course... but I feel they definitely weren't.

Well, if you were wrongfully terminated and you know it, apply for unemployment and see what happens. You will probably have to back up everything with your paperwork -- you will have the burden of proof. It does happen all the time that people are "fired" just because they don't "fit" the direction of the organization (as deemed by whomever) or maybe someone just didn't like the way that person looked or assumed things that weren't even true. If after you apply and a decision legally that you were wrongfully terminated, you will receive a letter, which states the legal code, and also the letter will state that part of the decision was that ". . . determines if a discharge is without just cause is whether the claimant's acts, omissions, or course of conduct were such that an ordinary person would find the discharge not justifiable. After review of the facts, this agency finds that the claimant was discharged without just cause under Section . . . "

If you were fired for unfair cause, pursue it, because although many managers/supervisors, etc. will come and go and many of them are asked to leave or moved to another job instead of being fired themselves, their course of "unjust" actions of firing you (if it is unjust) is something you will have to live through for a while -- certainly not fair. And, some managers/supervisors are hell bent on proving their point even after the fact is long over and done with.

There are many personalities in this world and the fact remains that some managers/supervisors are not objective people and really are prejudice and persuaded into "group think," if that was also the case.

My QA score has always run about 12% (SS requires 8% or less to QA) since i started. My trainer told me I had a very difficult account and not to worry. GRRRRR!!!! People are being terminated without warning at M Modal, according to the board here.  People are being picked on at Nuance even more than usual by QC and supervisors.  These are the 2 biggest employers in the industry.  Why this now?  And most people only make minimum wage.  There can't be such a big economic reason for firing people who are paid so low with this kind of technical skill.  What is going on here... and why... thinking aloud, but ideas would be ap ...
