Lest any of you would like to continue debating whether the "activity" mentioned is legal versus illegal. Transcend paid out MANY thousands for violating the laws you all are talking about and did so around 2006-2007 as did Softscript pay out many thousands MORE around the same time and there are no doubt more violations. I do not encourage you to continue being side tracked by the conflicting posts on this board but am quite confident you all will be.

I have mentioned to my TL many times that i will not adjust my time. What I put in is the work time I did. I have also told her that asking me to change my time is illegal and that they better not change it for me. I keep track of that stuff, and I also keep all the email telling me to adjust times, or the ones they send out to the entire team telling them to adjust their times. What's crazy is these companies think they are big and untouchable, even though they have been busted on this before. Medquist also lost a lawsuit on the same thing. You would think the Dept. of Labor would keep a close eye on these companies that continue to break the law.

I am surprised that Transcend has not put a stop to you working more than 40 hours a week. I work for them and unless overtime is approved I cannot work it!!!! How are you able?

You have to adjust your time to how many - lines you did. SM

Say you do 200 lph, in 8 hours that is 1600 lines. If it takes you 9 or 10 hours to do that, you can only put 8.

The whole point of keeping time records is that they be accurate and reflect actual time worked so the employee is paid accurately.

If it takes you 9 hours and 10 minutes to type 1600 lines, then that is the ONLY time you should be entering.

Anything else is fraud and both YOU and the COMPANY can and SHOULD BE in serious legal trouble for it.

If you are getting paid by the line and not the hour what difference does it make how many hours it took you to produce 1600 lines? Now if you are getting paid by the hour that is another story.

1. Because if it was based solely on lines, then employers could raise the line requirement to 3000 lines a day and therefore force their employees to work 16 hour days without paying overtime.

2. We are a nation founded on the principle of law, and there are laws that govern how employers can operate. Unless, you are a salaried employee, these laws are based on 40-hour work week.

3. Finally, if it is acceptable to violate a law by paying by the line, then employers can come up with ways to violate all laws.

My company was honest and upfront when we started using ChartNet. They told us that once you enter a report for VR, the time clock does not actually start for 60 seconds. Soooo.... this means if I did 30 reports, I add 30 minutes on my time sheet, right? Nothing was said about this for straight typing on ChartNet. We do both. The requirement for ICs to use a time clock is apparently to protect the service from being sued for unpaid labor, right? It is my understanding from an attorney that if we are required to sit and wait for the work that is considered time worked. Keystrokes wants us to keep track of ONLY the time spent typing, any time spent NOT typing is NOT considered as time working according to them. You would have to rack up a lot of time just typing to get in those 40 hours in order to get paid overtime. The truth is KS is being sued for not paying overtime. KS does not have time records and that is why it is being implemented now. I myself know overtime pay was not offered for anyone taking extra hours on my account. I also have e-mails to that effect. KS has not always paid overtime and if it was given it was to a select few or favorites. Ok, I am wondering something. I work about 10 hours a day because I have back problems so I get up and walk around the house, then back to work. Used to work for Transcend and loved that you input your own time card. You could put down 8 hours even if it took you 10 to make your lines/$. Sorry to see employees will now have to use that same stupid clock we all do. Not hard, just a pain in the (&*&. Without a doubt, my production downfall has been the advent of being micromanaged and being held to "compliance."
