Overtime as an IC???? - SaySally

I got an e-mail last week saying OT was required during the upcoming weekend. Wow! What's up with that? I'm an IC and part time at that. Crazy!

I worked as an IC for a company sometimes mentioned here, and they forced me to work 1 weekend a month after about a year and a half of working there. It was for stats so I was on call from 6 am to 4 pm for anything that came in. It really pissed me off. I was only part time and was scheduled Monday through Friday from 1 to 5 pm only because they knew I had another job!!!

Tell me about it. I tell you, I hate to sound unappreciative for the work, but something has got to give. For the last 4 years, 2 different companies, same thing. Constant overtime, evening and weekends. IC means no incentive except "just be thankful for the job."
Why in the world don't these companies just hire a few more MTs? I just do not get it. I changed companies last year for this reason and now back in the same boat.

nobody wants to work "holidays" particularly employees, so they make the ICs work just because "they can."

I didn't think it was legal to be forced to work all holidays!! At Nuance, we MTs (but not managers!) have to work every holiday unless we ask for it off enough ahead of time and before too many people have already asked for it off. I had definitely never run into that before Nuance!

IME especially over the last 10 years companies want to be able to control an IC's hours and schedule, like an employee, but pay and allot work like an IC. I had enough and quit the last place I worked IC because of "mandatory overtime" and being called even as late as 10 p.m. on a Saturday (we were clinic work Monday-Friday) because of a "stat" she forgot to assign. Sorry I wish I had better advice, I'm sure the good companies are still out there...well not sure but I hear rumors.

As an IC you are only obligated to work the hours you contract with the business for. If you are not able to work those hours, you are only obligated to advise them in a timely manner. If any business out there is demanding more than that, that is venturing into employee status and they are crossing the line AND you are letting them. Remember though there is a flipside to every solution. While you are not obligated beyond the hours you contract FOR, they are not obligated to keep you if you cannot work those hours on a consistent basis. As an IC you can only get trampled if you allow it.

Anytime you said no, you'd have 50-75% less work sent your way for a week or two (not just me because I physically know not just online know some of the other MTs). This was 2 different companies over the last 25 years, but I've noticed it becoming the norm in the last 10.

companies, correct? What if you said you had another contract where you were committed to weekend hours? This is infuriating that they punish you with less work. I don't understand why the DOL does not do something about this practice. I know it is illegal.

It gets worse and worse! Recently had to obtain an EIN for a position that was really an employee by IRS classifications and they were using the EIN as a smokescreen. They still wanted an I9, a set schedule, and so on.
Unethical employers rip the treasury off for millions a year calling us ICs when we are actually employees. Not to mention depriving us of the hard won labor and safety rights our forerunners fought for. Start reporting this to the IRS when you encounter it. You do not have to give your name, just the pertinent facts. It is the only way this particular exploitation will stop. Don't worry wages will continue to go down, their unreasonable demands will continue to go up, and this profession will continue to go down the tubes, but at least you will go down fighting rather than like a sheep.

I work second shift, so, due to the time change from PST to CST, after 10 pm my time, the last hour of my shift shows up as the next day. I worked 1.5 hours this morning and then my regular 2:30-11 pm shift, so I figure I should be paid for 1.5 hours overtime, but my calculated time (I recently discovered this on the current time card page) shows me as only getting credit for 0.5 hours overtime with 8 RT (Regular time) + 0.5 OT hours showing up on Sunday and then 1 hour showing up on Monday as ...

Is OT calculated on ONLY the work week OT was worked? or both weeks of the pay period, even if one did not have any OT. Or, based on 3 months worth, etc. Thanks. ...

Got an email that the company will no longer offer any OT at all costs and do not work more than your 40 hours. That is because they overhired and we do not even have enough for our 40 hours. I do not get it. ...

I know when I call in to have work assigned (OT accounts) they always ask what kind I want. I usually just tell them "Whatever" and they confirm I do all work types, say thank you and away we go.

Not only cut in pay, it seems like the OT is no longer time and a half. I can't believe the amount of money I have lost. Anyone know how they figure overtime?? Could the suits be so devious as to require mandatory overtime so it temporarily boosts income so they look like they are paying a living wage? Or is there just a supply/demand problem?
I did check into mandatory or forced overtime. It is legal as long as it is not causing a safety risk and there are 16 states putting restrictions on forced overtime. Before anyone goes yelling about mandatory overtime being illegal, it's not, at least not in my state - and not federally either.
