DOL response to my email to them also indicated that, if it is determined that my state doesn't take action on my behalf it doesn't necessarily mean that the case is without merit. For those of you thinking that an attorney is your only option, they also suggested contacting the Federal Department of Labor. I will if I find out that my state cannot act on my behalf
