the "employee" is sent a 1099. You ask why do they do that? Because many times, they do not have the money to pay the employees' taxes. Seems this happens a lot in certain industries, such as trucking. That's where the DOL steps in. For an IC, you cannot contract with a subcontractor and then treat them like an employee. That's where the IRS steps in with the filing of an SS-8 form to determine if the subcontractor has been treated like an employee without any benefit to the IC but only to the business, no taxes withheld, no workers comp, etc.
