Division of Labor investigation against Landmark - concerned

I just got a letter from the Department of Labor regarding Landmark. It states they are investigating to see if they are complying with the Fair Labor Standards Act. Included was a form to fill out. Should I fill this out? Will it come back to bite me  later?

Did anyone else get this letter yet, and are you planning to fill out the form?

It can't come back to bite you if the Dept/Division of Labor is making the request. If they find that LM is not complying with the FLSA you might be entitled to recompense.

DOL - The good guys - Just Suggesting

DOL typically generates such process because they already have a file of complaints on an employer. The form you received is a generalized verification to see if LM violation is wide-spread. DOL asserts OT pay, fair pay and benefits coverage while IRS determines 1099 versus W2 issues.

If you have received the form DOL knows you work for LM. Not filling out may affect your potential future issues with an employer. LM knows they are being investigated. I suggest you go ahead and complete the form.

They were skating on thin ice then, and I should have reported them. I was naive back then. They hired people as employees and then within a few weeks changed us to ICs. They did this to all incoming MTs, not just the group I was in.

I was constantly running out of work. The owner would say "Oh, just take the day off. Get some rest." I didn't want to take the day off! I wanted to work! He is a very deceptive, shady character. It take long for me to see through his lies, and I resigned.

The letter was postmarked from PA. The return address that was on the letter is PA as well.

I wonder if complaints from other states are supposed to be handled in their state or the MT's state. Anyone know?

I have had a call from them already. With all the variables we have (No work, lots of work, ASR, straight, no work during certain times of the year), I think she was totally confused when I answered her questions. Don't know if we will ever hear anything else about the results.

I knew it....I am not a moron.....hiring all these MTs for these accounts, running OOW on a regular work day.....did they think we would all stay busy on Labor Day?  I am disgusted and am taking the day off.  I ask about being off.......NO.  Don't you think that managers could make schedules knowing the work is slow?  Let people off if they ask, making sure to have at least 2 MTs on in case some work comes in?  That is too easy a fix....let everyone just be OOW and ...
