Paid breaks - Nuance needs to read their handbook

Posted: May 27, 2015

Has anyone every received an employee handbook?  I found this quite interesting, especially the part about state compliance with paid breaks.  I am sure the labor commissioner is going to love that sentence stating taking breaks may affect your MUP/benefit eligibility/weekly hour requirements.  How are they going to explain how this is a paid break? "MEALS/REST BREAKS Employees that are scheduled to work more than six consecutive hours are entitled to two 15 minute paid break periods and a 30-minute unpaid lunch period. Employees scheduled to work less than six consecutive hours are entitled to two 15 minute paid break periods only.  Employees do not need to clock in/out for break period(s) 15 consecutive minutes or less.  Employees must clock in/out for the 30-minute unpaid lunch period.  Please note that breaks and lunch periods are not mandatory (unless you reside in a state that requires them), but are only guidelines and are to what you are entitled. If you want to take them but feel it will affect your MUP/benefit eligibility/weekly hour requirements, etc., you will need to contact your manager for approval to flex your schedule. *Nuance complies with all state and local regulations governing Meals/Rest Breaks. If you have any questions contact Human Resources."

Great, isn't it. - wtfe

Every few months, I check the handbook to see if anything has changed and always download a copy so as to have it handy. Never know when you may need to refer to it but not be able to access.

Actually asking HR about the break is useless. The answer I got (to what code I should use in Webclock for breaks) was that the pay is built into the line rate and allotted for in the nonproduction system hours. Right. Of course it is. Karma is a b***h and it will be enjoyable to her bite them on this. The day is near.

break pay - xo

Good grief, are they serious? Breaks are included in our cpl rate. Researching is included in our cpl. Emailing/phone calls are included in our cpl. Sitting while OOW is included in our cpl. So many things are included in our cpl rate, what are we actually being paid to type and/or edit at this point? Such cheap, greedy liars. Throw the stupid pay grid into the mix and it's flat out robbery, plain and simple.

Averaging tasks that are not directly production related is also illegal in California. They will soon get what's coming to them.

I really, really wish there was a way to find out how many wage claims are pending.

Did you fill out the DLSE-55 worksheet? - sm

I'm filling out the paperwork this weekend but NOT looking forward to that form. Three years worth. Not looking forward to that at all.

DLSE-1. - DLSE -55 is for irregular hours

[ In Reply To ..]
I submitted The DLSE 1 form and just heard from a deputy commissioner. DLSE 55 is for irregular hours. I worked a pretty regular shift. It's really not as complicated as it looks, just estimate. It'll be pretty easy to prove breaks aren't paid since they aren't listed on the pay stub.
Thanks. I'm filling out the paperwork - this weekend.

Did you do paperwork for the remaining internet reimbursement also? Wondering if they are the ones for that or not.
Yes, internet and non-production time. - ...
[ In Reply To ..]
They will include internet and non-production time such as email and Fiesa also.
Perfect. - Thanks.

Wish this was done already but also wish I worked elsewhere, married rich, etc.

Finally found the work email stating that - wtfe

nonproductive time such as fiesa, webclock, emails, etc do not get entered into webclock because we are already paid for it according to system variance, which means we are not paid for it. I love ammunition for wage claim.

Can't see them showing up - Fedup

[ In Reply To ..]
I have all my proof, but I really don't think I'll need it since I don't think they'll show up at the hearing.

Good point. - wtfe

Paid 0.25 Hour Breaks X2?
Jul 11, 2013

In my state, there are supposed to be 2 paid 15-minute breaks if one works 8 hours.  I questioned my company HR about this and was told "there was a slight amount added to our line rate"  to cover this.  What??  how is that a break.  I am wondering:  1.  How many companies do this?   2.  Do any pay for the 15-minute break? 3.  How many states honor this?  (check with your state Labor Relations Board). ?  ] 4.  Is there a legal ...

"Paid" Breaks... Again...
Apr 05, 2013

It's pretty obvious that we are not being paid for our "paid" breaks to which we are entitled which really irks me to say the least.  Have any of you done the math on this? I just did.  If you took your 2 breaks per day and were paid for them, that would be equal to 1/2 hour of paid time. Let's just say you make $8/hr. That's equal to $4/day in paid breaks or $20/week if you work 5 days/wk.  Multiply this x52 weeks = $1040/yr. I've been with Nuance since they b ...

HOW OFTEN DO YOU TAKE BREAKS?
Nov 10, 2009

When you guys type how often do you take breaks?  Do you find that if you take frequent breaks - say every hour or hour and a half for about 5 minutes that you are more productive?  Or do you sit and type for more than 2 hours straight without stopping?  Just wondering how often others take breaks.  This was also one of the "tips" given by the top producers of the company according to MQ.  They claimed these folks took frequent breaks but went hard at it for an hour or s ...

I lost the email, but supposedly I get a 10-minute break after 4 hours. Re PTO Taxes, Breaks
Jul 03, 2012

ok here's the dirt from payroll. If you are paid a lump sum such as PTO, the IRS  considers it "supplemental" and taxes it at 25%! So, if you're considering leaving, best to take all the PTO you have before. Wish I would have known that before. As far as paid breaks, I didn't realize it was "state" dependent...so thanks for that information. Cudos for KY this time requiring a break after 4 hours.  Either way, it would not have mattered to me as I took a break whenev ...

I accepted a part-time job to supplement my regular MT income a few weeks ago from a girl who was advertising here on MTStars.  It's been great, fairly easy work and an excellent extra income.  I guess I should have known it was too good to be true.
