A community of 30,000 US Transcriptionist serving Medical Transcription Industry
I could really use some advice. I worked for a company for 6 months and then quit when accounts were being lost. I am owed over $3000.00 (I quit over 6 months ago). I know of 2 other ICs who worked for this company and the total owed to all of us is over $10,000. We have been given every excuse in the book. We have been told the company has gone out of business, that a AmerAssist loan was being sought in order to pay us, etc. We have contacted the Sheriff's Department in her state about this and they will not assist us. The Small Claims Court amount is so low in that state we would lose all of our money. We are now being told that she is going to file for bankruptcy. She was paid for our work but will not pay us. I don't know where else to turn for help. Any advice?
Does the company name (and her last name) sound like SERVICE ?
If this is the same one, she has been doing this for years. There was a series of posts back in May of 2010 on MTStars about her not paying.
Do you know about "PACER" it give all the information on bankruptcies. You have to sign up and sometimes it takes up to a week to get your password, but after that you can search for any bankruptcy filings or any Federal lawsuits (a lot of MT suits end up as Federal cases because of multiple State jurisdictions). They do charge if you want to read the actual paperwork, but it is very minimal.
You may be able to find out if she has filed bankruptcy already or possibly about any previous lawsuits she has been involved in. It would give names of attorneys that represented the parties against her and maybe you could contact one of them to see what the prospects are for getting paid by her.
