Penalties are pretty clear.
"(c) If an employer fails to provide an employee a meal or rest or
recovery period in accordance with a state law, including, but not
limited to, an applicable statute or applicable regulation, standard,
or order of the Industrial Welfare Commission, the Occupational
Safety and Health Standards Board, or the Division of Occupational
Safety and Health, the employer shall pay the employee one additional
hour of pay at the employee's regular rate of compensation for each
workday that the meal or rest or recovery period is not provided."

Have any of you done the math on this? I just did. If you took your 2 breaks per day and were paid for them, that would be equal to 1/2 hour of paid time. Let's just say you make $8/hr. Regarding Breaks In Certain States Nov 14, 2009I lost the email, but supposedly I get a 10-minute break after 4 hours. Do I clock out of DQS but stay clocked on at ScheduleSource or do I stay logged onto both and walk away from the computer for 10 minutes? Does it show up on the time card or only on the pay stub. Re PTO Taxes, Breaks Jul 03, 2012ok here's the dirt from payroll. If you are paid a lump sum such as PTO, the IRS considers it "supplemental" and taxes it at 25%! So, if you're considering leaving, best to take all the PTO you have before. Wish I would have known that before.
