Regarding breaks in certain states - How does it work?

Posted: Nov 14, 2009

I lost the email, but supposedly I get a 10-minute break after 4 hours. Do I clock out of DQS but stay clocked on at ScheduleSource or do I stay logged onto both and walk away from the computer for 10 minutes? Does it show up on the time card or only on the pay stub. Does anyone know the details?

Thank you.

You have to call up the labor laws from your state, each state may be different. In my state, I don't get squat.

for breaks. I just stay clocked in to both DQS and SS and take the break if I feel like it, which I usually do and did even before we got paid. But whether you take the break or not, it shows up on your pay statement. Mine is usually about 20 bux. I KNOW they hate paying that, but they were forced recently bc of a labor law but made it sound like it was all their big idea.

You log out of DQS and out of ScheduleSource, otherwise it will affect your hourly pay for PTO. It will also affect any bonus you may get if you stay logged in; it looks like you are working when you are not. I believe 39 hours is what you need a week for full time, so just make sure your get that (also check on that with your CCM), but never, ever stay logged into DQS while on break and never, ever stay logged into ScheduleSource while not working. Hope that helped.

incorrect info on rest breaks - Thomas

the official policy for recording of rest breaks can be found on MQCentral-Depts-HR-Policies. For those in specific states mentioned in the policy, rest breaks are paid and the employee should NOT log out.

I can't find which policy it would be under. I thought my state had it, but I'm not getting anything, so I thought I would make sure.

rest breaks are paid in 10-min increments according to how many hrs worked each day. automatically calculated and paid under Mt Break on check
Check your state labor laws. - NM

HOW OFTEN DO YOU TAKE BREAKS?
Nov 10, 2009

When you guys type how often do you take breaks?  Do you find that if you take frequent breaks - say every hour or hour and a half for about 5 minutes that you are more productive?  Or do you sit and type for more than 2 hours straight without stopping?  Just wondering how often others take breaks.  This was also one of the "tips" given by the top producers of the company according to MQ.  They claimed these folks took frequent breaks but went hard at it for an hour or s ...

Re PTO Taxes, Breaks
Jul 03, 2012

ok here's the dirt from payroll. If you are paid a lump sum such as PTO, the IRS  considers it "supplemental" and taxes it at 25%! So, if you're considering leaving, best to take all the PTO you have before. Wish I would have known that before. As far as paid breaks, I didn't realize it was "state" dependent...so thanks for that information. Cudos for KY this time requiring a break after 4 hours.  Either way, it would not have mattered to me as I took a break whenev ...

Paid Breaks
May 27, 2015

Has anyone every received an employee handbook?  I found this quite interesting, especially the part about state compliance with paid breaks.  I am sure the labor commissioner is going to love that sentence stating taking breaks may affect your MUP/benefit eligibility/weekly hour requirements.  How are they going to explain how this is a paid break? "MEALS/REST BREAKS Employees that are scheduled to work more than six consecutive hours are entitled to two 15 minute paid break periods and ...

Paid 0.25 Hour Breaks X2?
Jul 11, 2013

In my state, there are supposed to be 2 paid 15-minute breaks if one works 8 hours.  I questioned my company HR about this and was told "there was a slight amount added to our line rate"  to cover this.  What??  how is that a break.  I am wondering:  1.  How many companies do this?   2.  Do any pay for the 15-minute break? 3.  How many states honor this?  (check with your state Labor Relations Board). ?  ] 4.  Is there a legal ...

SYNERNET Not Hiring From Certain States

Has anyone else had trouble with companies not hiring because of state laws with Workmans Compensation.  I did all the testing required for a company and then I get an email back stating they do not hire people from Ohio due to the workers comp laws.  It would be really nice for companies to take the time and list the states they will not hire from so we do not waste our time doing unnecessary testing.  The company is Synernet ...
