OOW situations for Fla. employees - flamt

Nuance is playing a game to get people to quit by slashing wages 40% to 50% instead of laying them off and paying unemployment.  Everyday we run out of work 4, 5, 6 hours before end of shift.  We do have a recourse, however.  Florida unemployment rules say this: 

If you are working part-time (fewer than 32 hour during a Sunday through Saturday week) you would be eligible to draw partial benefits if your gross earnings for the week are not equal to or greater than your weekly benefit amount.

If those of you out there are not checking on your state UE requirements, shame on you!! My state also (Western US) has a similar law. I have been collecting UE now for a few months, while still "working" at looking at a blank screen most of my shift! The benefit amount is based on last years earnings which means you still will be making what you made last year working or not!

Even being OOW during the week, I still make well above minimum wage and I never MUP. I wouldn't be elligible for partial UE then right?

What does minimum wage or MUP - have to do with being OOW?

Unemployment insurance is based on your previous quarter (3 months) average (I'm guessing if you filed now it would be Jan-March?), it has nothing at all to do with MUP or minimum wage. If you make $20 an hour, yet you are temporarily out of work due to no fault of your own, you are entitled to file for UE to make up for that lack. The full UE is based on a percentage, maybe 2/3rds or something? I imagine the partial is as well.

Even people making heaps of money can get UE, but usually there is a cap on how much anyone can get per week which is determined by the state you live in.

I have not filed YET, but do plan to if this continues. They are not even trying to explain this, no emails at all, which is pretty bizarre considering you usually get all that rah rah rah stuff.

What I don't really understand is that once you establish you are still working and it is only partial UE, do you need to file some sort of statement every week stating how much you are short hours or $? Sounds a little confusing.

Appreciate if anyone can explain the process.

in FL, the only way to collect partial UE is if you made less than minimum wage for the week. So it doesn't matter how much per hour you average or the hours you worked, if you make more money than the minimum wage, you are not elligible. That's the way I understood it when I contacted UE. Even when I'm OOW for 5 or more hours a week, I still average $10-15/hour so can't collect UE.

I think all states have limits on how much you can make before you qualify, in New York it is $400. They don't say anything about minimum wage, though, just that if you make more than $400 in a week you won't qualify.

I have another part time job and I think I sometimes go over that even with the OOW so I have been dragging my feet too, but someone told me you can still apply and get some kind of a top-up anyway.

I dread the bureaucracy, but I think I might have to deal with it soon if this drought continues.

I think weekly benefit amount would be the amount of your unemployment - based on UE calculations if

you were laid off. They use a formula based on past quarters as to your UE amount, then use that amount to calculate if you can receive partial unemployment if you are Underemployed or if your wages are cut. If they calculate your full unemployment benefit at 400$ a week and you are still making over 400$ a week even with OOW then you probably won't qualify for unemployment benefits. At least I think that is it.

They told me also if your hourly wage is cut a certain % (they would not tell me WHAT %) and you give it a short try and decide you can't live on that, that you can quit and qualify for unemployment benefits. Say if you were averaging 15$ an hour past quarters and they give you a new grid in which you can only average 10$ an hour, I imagine you can quit and receive unemployment. Every state is different.

than your rate if you were to just be unemployed and collecting. It's not a huge amount more, but definitely more than your "normal" rate and then you just report earnings for that week and they are subtracted from the higher weekly rate.

I live in Texas and looking at the information you fill out how in the world could we put in an amount when our pay changes so drastically with the new grid? As much as I want to see if I can collect, the hoops you have to jump through almost make it not worth it. At least where I live.

Serious question... I transcribe for a hospital/account that is in a different state than where I live. I get so upset sometimes at the types of reports that I get. Usually I transcribe/edit them and move on and they all blend together and I forget at the end of the day who/what I typed. Which is a good thing. I was just curious about what employees thought of Nuance on Glassdoor.  You read several US employee opinions and they reflect the morale listed on MTStars.  Scroll further down and read the opinions of the transcriptionists from India.  What a difference.  They are highly satisfied with their jobs and most have been working with Nuance for 6 to 7 years.  The US transcriptionists are very sad!!  What a difference..... ...

Someone jumps on this board, fires it all up by saying to use F11 for every ASR job, and then calls their CCM to say "read the MTstars board" and then they go check who is doing it and fires them, all the while the pot-stirrer looks all cutsie in the CCMs eyes and more work opens up for the pot-stirrer?Maybe it is my wild imagination, but it seems like all that "stop typing for a day" and if that does not work, then "stop typing for 2 days," and "use F11 for all ASR jobs," all feels so not ...

As I am getting no work during the day shift anymore, I have the chance to go third shift Sun-Thursday (11-7), either that or find a new job (yeh right), or do ASR (done it at this company, no thanks to returning there).  I have never worked that one before.  How/when do you sleep?  Any other pros/cons about this shift?  Thaniks your your advice.    ...

All the research I have done on this subject is vague, but it appears that SE and IC are almost the same with the exception of Social Security and Medicare being withheld and the employer's portion being paid for an SE. ...
