IC contract question - is this the norm?? - anon

What do you think of this? Is this a normal inclusion on a contract? Personally, I think this is a load of B.S. (P.S., they only pay 5.75 cents/per line to begin with, for straight transcription.)

Any errors requiring extra processing (blanks/questions) or reprocessing (resends) created by the Subcontractor will incur a charge that will be billed to the Subcontractor by the Contractor.

Charges will be made on a per-line basis of the entire (re)processed document with said line being 65 characters based on electronic character count based on the following scale:

$0.0025 (one-quarter cent): for all work returned that requires extra processing

                                                 (questions or blanks).

$0.02 (two cents): for files requiring reprocessing (resend) due to a transcription

        error. If the error is generated by a transcriptionist on a

        full-time proofread crew then the charge is split between the

        proofreader and the transcriptionist at the rate of $0.01 (one

       cent) per line each.

I would never sign that, but thats me. Would rather - flip a burger.

I thought it seemed incredibly severe. Honestly, why don't some MTSO's understand that leaving a blank is sometimes absolutely necessary? Coughing, yawning, chewing, background noise -- I'm not going to guess what a doctor is saying...and I would get penalized for that? Crazy! Where are all the good companies? Of course, you never see a post on here where someone is raving about the company they work for, just the ones that hate their jobs. Anyway, the search continues...

I think I have pretty good integrity and I can tell you that if this was my contract and I was already making such little per line to begin with that I would probably do some guessing at blanks that I didn't know, just because I have to pay my bill. I know guessing is the biggest "NO" in transcription, but if I am being CHARGED MONEY, because many dictators refuse to speak clearly, then my mindset would probably be, it is their problem, not mine.

This is not the norm and is definitely not fair. For me, if the term is audible, I can find it if I don't know it, but if the doctor chooses to use a "mush mouth" when he speaks, then I may have to blank something. Why should I have to lose money just because a doctor doesn't care to speak more clearly.

A company I worked for before tried to do that to me also. They sent me a 19 page contract to fill out! You'd think I was buying a house...and in there was a clause regarding deductions for blanks and errors!! I never filled it out or worked for them. Also, Again, every time one of our fellow MTs accepts a job for this low of an amount of pay, you are hurting the rest of us!! Give these MTSOs an inch and they'll take a mile! You accept it for $0.05/line and they'll think..Wow, these MTs are really hungry. Lets pay them $0.04/line!! Nobody should be accepting any less than $0.85/line! And let's face it, working for $0.05/line is not gonna pay your bills. You'd probably earn more collecting unemployment!!

Pick a company to subcontract that is more on your side than trying to skim your paycheck.

No one should be guessing at terms, and this type of thing will force people to guess and make stuff up.

For those rates, they can go to India or the Philippines and get crap work since that's all they're willing to pay for. Shame on the healthcare provider who is hiring this company.

Well, this was my first attempt at looking into being an IC, and I can say without hesitation that I am lost on where to go from here. I just don't know of a reputable, decent company to apply with that isn't going to pull this kind of crap. I currently work for MM and really need to supplement my income in a big way. I have worked for Landmark both as IC and as employee, actually.

If you're only looking for PT, they may be a good option. Their rates vary depending on account, so I can't comment on that, but their QA is good and they leave you alone and they DO NOT penalize you for sending anything to QA.

In all reality, I don't think this is too much to ask out of a contractor, if it wasn't in THIS business. I know that if I paid a contractor to paint my home and he did something incorrect and I had to pay someone else to correct his mistake, then I would feel like I should take out of the first contractor's pay what I had to pay the second one. That would only seem fair.

These companies need to go back to hiring employees and not ICs, because this practice wouldn't be fair to an IC, due to the fact that we have no control over the quality of the audio or control over if the doctor decides to have his lunch at the same time as he is dictating.

I wouldn't doubt if this ends up being the new norm of the industry sooner or later. They seem to try to take and take and take.

They hire ICs for THEIR ADVANTAGE..so they don't have to pay Work comp, state and local employment taxes, PTO, SSI, disability insurance, overtime, and on and on!! EVen when almost 99% of the time you are TRULY an employee and NOT an IC..but most people don't know the requirements to be classified as either..believe me..these MTSOs know what is required; it is the MT that is uneducated about such things and we are taken advantage of because of it! It does not matter what THEY classify you as, it matters what the GOVERNMENT says you are as mandated by THEIR guidelines. I know... I won a case against an employer who classified me as an IC when I was truly an employee in the eyes of the IRS!! If you want to read up on it, go on the IRS.gov website and click on the part that explains the requirements! It will enlighten you!

First off, no IC in their right mind would take a job paying 5 something cents for straight typing. That's just nuts.

Second, YOU are the contractor, so write up a contract and give to THEM stating your rates and stating the fact that if you transcribe it you get paid for it. In many states, it's illegal to take away pay from an employee, but since you arent an employee, I'd refuse to sign ANY contract that said they could deduct ANYTHING from my pay.

MTs have to have the guts to stand up and say- NO this is NOT okay. You are not going to pay me crap and then slap me with the crap stick.

People that take these jobs are just helping to perpetuate the toilet we're all swimming in.

Move on and find another job. And yes, you'd even do better working fast food. Heck, Costco pays $17/hr. No way, I'd even continue to converse with a company that would put out a document like that.

I did not start at 5.75 cents per line, and I make more than that now. While it might not fit everyone's needs in life, working with TNI has been a fairly decent experience. I have been with them for roughly seven years now. I did not like the fact that I used to be charged (when under the a proofing crew) for blanks that were turned in. 9/10 the proofer did not get it either, but the fee was not waved, as they had to go over the document justifying their charge. As for the reprocessing fee, that is legit. If the transcriber was paying attention, it would not have needed to be managed by someone else. Overall, if you are looking for tons of $$$, keep walking lol!! If you are looking for an overall decent group of people to work with, well I think they are!

Just wondering if there are ANY MTSOs out there that don't overstaff their accounts.  Read the boards here; it's fairly obvious that ALL if not MOST of them have overstaffed their accounts. MTSO Overstaffing Is The NORM Now, Right?

Last year I left the moderate-sized MTSO I worked for to work for a smaller company.   My former employer had overstaffed the accounts to the point that I was borderline homeless, so I had no choice but to leave. I have been with my company for many years and have liked the account I am on until the past 3 months.  Three months ago, they hired on 3 new MTs and now suddenly all the easy doctors disappear from the queue first, even if there are other reports out of TAT.  Warnings have been given by account manager, but only 2 days later, the cherrypickers are back at it.  I am now getting stuck with a majority of the harder docs that no one wants to do and have watched my pay ...

Can someone please help me. I am new to the company, I have not been here 90 days yet. my TSM is "gone" so I have a new one now and have not yet spoken with her.
