Keystrokes clock in and out - hmmm

Recently new to KS and have a ? If I am scheduled three 8 hour days at 24 hours a week and I sit her most nights for 8 hours but only get maybe 20 reports but I stayed clocked in because when trained I was told since I was not at 40 I could stay clocked in as they just did not want anyone in overtime. Will I be paid minimum wage because obviously I was not even making that even though I had to watch the account or I would get in trouble since there is a very short TAT on some of them. I do not know if I will be paid just by reports or by time as I should be. My other company makes us clock out if we run out but we still have to watch it so I just do not know. If I will only be paid on what I typed it is not worth my staying home these nights watching it but only making like $20. Thanks for any help!

I just did what I was told but I was just curious about if I would actually get paid since I did it or get in trouble from someone somewhere.

just like every other company. I never heard of them paying for time sitting and waiting. If they did, everybody would want to work for them, so don't get your hopes up about getting paid minimum wage for sitting there clocked in. sorry.

....to sit there, clocked in, even when there is no work at which to BE productive, wouldn't that be against some kind of wage and labor law if they don't pay you at least minimum wage for your state? Of course, I'd rather earn what I could make if I had a full hour of productive typing rather than $7.25/hr, but I'm just saying I thought it was against the law to require an employee to be "on the job" for zero pay.

In my state, the minimum pay for restaurant waitstaff is something like $2.13/hr. If you don't earn enough in tips to bump up your pay to at least $7.25/hr, my understanding is that the restaurant has to pay you the difference so you're AT LEAST earning that standard minimum wage. Shouldn't MTSO work be something similar to this?

that is why it is called "production." Their contract does not include "waiting time." Legal?? that is always in question, but what can we do about it. I understand how you feel, but in reality, that is not the way it works.

The only reason I asked was that I went over the clock policy I signed where it stated to be sure to clock in for your shift and out for your shift and said nothing about clocking out when no work and the lady that trained me said I could stay clocked in so unless they falsify my records they would be liable legally to pay for that time at least this period until they tell me otherwise. Yes I know it is not always that way. I have been in this industry for many years so I know how it all works but I am just thinking that the way they worded things they would have to at least pay me this time for all clocked in and out time. It is not legal as the law states we should be paid for waiting to work but we all know that is not reality with our jobs. Just was wondering if anyone had come across this with them before.

I was told to clock out whenever there is no work. They don't pay for you to wait around. If you stayed clocked in and wait for work, that is your problem. They pay on production only!

I was told clock in when there is work, clock out when no work. Paid on productivity so really doesn't matter about the time clock, but that is the rule .... clock in for work, clock out no work.

That's exactly why I quit KS after a very short time. Sit around your whole shift and wait for work and don't forget to clock in and out for every report you type and barely make $200 a pay period. It's like making $2 an hour. Not for me. Good luck!!

Yep that is how they operate - they want you check and refresh your queue every 20 minutes or so and there is no pay if no work - they want you to clock out because they are scared for anybody going over 40 hours. I know of what I speak.

Yea I told them I was not going to do it. I did give a two week notice because I do not want to burn bridges as in this industry you never know. I even got accused one day of not being on and said they called me and I told her I had no missed calls on my phone and I was on at that time and never heard anything else about it. Just not worth the stress to sit here worrying if they are going to call becuase I did not check it within 15 minutes for that money. I am worth more than that!

It is my understanding from an attorney that if we are required to sit and wait for the work that is considered time worked.  Keystrokes wants us to keep track of ONLY the time spent typing, any time spent NOT typing is NOT considered as time working according to them.  You would have to rack up a lot of time just typing to get in those 40 hours in order to get paid overtime.  By the way I have never been paid overtime even after 40 hours and when asked if I would receive it the anwer was ...

So, have you heard that Keystrokes is going to a "time clock" system in August?  If this really goes through, this may be the straw... I have put up with all the other stuff going on there.  I constantly help out on other accounts as well as getting my own work done.  But, if I have to punch a clock, when I have been able to flex for 4 years, I don't think I'm gonna do it!  First off, there is no way I can sit for 8 hours straight.  I get my work done in 4 hours or so and then ...

When To Clock Out OOW?

She and I had a few e-mails back and forth about when I should clock out OOW. I'm just...confused. I have been clocking out OOW after doing the usual protocol any time there isn't work and had no issues with that with my old TSM. New TSM said that I only clock out OOW if I am quitting for the day and have no work. She told me checking in during my regular scheduled shift when OOW is "flexing" and so I don't clock out OOW. The requirement for ICs to use a time clock is apparently to protect the service from being sued for unpaid labor, right? If you sign in honestly, i.e. whenever you are doing anything for this job with the service, tech tweaking, software installation, training, spreadsheets, research, phone calls, etc., etc., etc., it would put you into overtime and you are fired, right? If you need to get your lines in but you've worked your 40 hours or plan on working your whole 40 hours, can you hop on and type off the clock? So, now if we have to go to the bathroom or some other thing that pulls away from the computer, we dont clock out otherwise we will be locked out for the shift?  What, it is no big thing anymore if we are on the clock but doing something else?  Doesnt that defeat MQ purpose of getting the work done.  If I get locked out, I cant finish my shift so they cant get all the work done.  Its okay for me, I will have a free afternoon, LOL, but it hurts MQ turn around time.  This& ...

Lest any of you would like to continue debating whether the "activity" mentioned is legal versus illegal.  Transcend paid out MANY thousands for violating the laws you all are talking about and did so around 2006-2007 as did Softscript pay out many thousands MORE around the same time and there are no doubt more violations. The truth is KS is being sued for not paying overtime.  KS does not have time records and that is why it is being implemented now.  I myself know overtime pay was not offered for anyone taking extra hours on my account.  I also have e-mails to that effect.  KS has not always paid overtime and if it was given it was to a select few or favorites.  At one time gift cards were being given in lieu of overtime on certain accounts, which does not make up for the overtime m ...
