IC MTs - tired of getting your teeth kicked in? - We cannot unionize but we CAN organize.

We can form the Association of Independent Medical Transcriptionists for the express purpose of putting the relationship between IC MTs and MTSOs on a proper legal footing, where it has NOT been to this point. 

For starters, the AOIMT would formulate a model contract between the IC and the MTSO rather than accept the MTSO's contract.  The terms of the model contract MUST be negotiated rather than dictated by the MTSO, just as any other contract for services is negotiated. 

The AOIMT model contract will incorporate line rates that reflect the time, effort, skills, talents and knowledge that IC MTs bring to the document, and WILL provide for an ADJUSTMENT IN THE LINE RATE WHEN EXTRA TIME AND EFFORT ARE REQUIRED TO EDIT THE REPORTS OF SUBPAR DICTATORS.

Under the model contract, the line rate for editing would not be 50%, but rather will be 75% of the "straight typing" line rate, in recognition of the fact that the myth that one can edit twice the lines that one can type is demonstrably untrue.

When applying for IC status positions, a member of the AOIMT would invoke the model AOIMT contract, rather than simply accepting a contract forced upon them by the MTSO.  All MTSOs that can be identified as operating within the United States and under its laws would have received notification and a copy of the model contract. 

If, then, the MTSO fails to recognize the AOIMT contract or to negotiate terms of the relationship in good faith, there can be no legally binding contractual relationship between the IC MT and the MTSO. 

In such a case, the Association would have no choice but to conclude that the MTSO is misclassifying IC MTs for the express purpose of evading employer taxes and other legal obligations of employers.  The AOIMT would then file a complaint on behalf of the AOIMT member with relevant state and federal labor and taxing authorities. In addition, the companies that agree to recognize the model contract and to negotiate rates under its terms will be permitted to post contract openings on the AOIMT website, and will do so as requests for bids with the rates and terms to be negotiated.  All other MTSOs will be listed as non-AOIMT-compliant.

It's time to put the MTSO and the IC MT on an even footing when it comes to the legal relationship, the compensation, etc.  This has gone on long enough, and far, FAR too long.

AOIMT.org and AOIMT.com have been reserved.  We only need indications of interest in membership.  Annual dues would be used only to engage legal counsel to prepare the model contract, and for minimal administrative costs (website, outreach, etc.) - depending on membership, perhaps $25 a year.
