Time outside production - isn't it illegal to require this? - Thumbs

Posted: Feb 13, 2014

New to Nuance, swallowed up when they acquired my employer at the end of 2013.  I see they really expect you to spend a lot of time doing things outside your schedule, training, reading manuals, etc.  Other than a flat rate for installing and learning software (20 minutes, actually took twice that), they don't offer to pay for all this extra time.  Seems excessive.  Has anyone tracked this extra time and filed a complaint with DOL about it?  Or tried to clock into Webclock under another category and see if they pay it?  I'm new here but I hate to cave in and accept this BS.  Seems illegal to me.  Seems to me if it's not paid then it's not required that I do it either.

It seems they add more things to do constantly. My all time favorite is assigning reports to be transcribed at the end of my work shift! I agree far too many things are required at no pay. I find management cold-hearted and impossible to work with.

It would seem to me that if you're doing something - they ask you to do (proofing, research, -

keeping logs, virtual meetings, filling out time sheets, etc., that are directly related to the work you are paid to do, then that too is work, and should be paid as work. Dept. of Labor might find it interesting that they choose not to. And I think the same is true with not being paid for anything you type, or bring up a macro for: Headers, footers, spaces, titles, etc. I've been toying with the idea of suing one of my past employers for back pay for all that I didn't receive while working. Not to mention all the "invisible" overtime worked.

I agree. Please file a complaint with the DOL - You can do so anonymously.

Time outside production - isn't it illegal to require this? - wagesraped

[ In Reply To ..]
yes it is very illegal. i called the DOL in my state but told her i refused to do all these things w/o pay. she said i have no case then. BUT, the minute i do these things and submit it on my timesheet for pay and nuance does not pay me for my time that they required of me, THEN i have a case.

i havent been on fiesa in over a year and do all their other silly webinars or whatevs during long reports. too old to fight. ignore their emails and deny theres a problem. :)

Hey wagesraped ! You could be my twin !! - mt2

I also haven't been on fiesa in over a year, never attend any of their crappy webinars, join their stupid contests, etc. I'm just here to make a paycheck - :)

GREAT IDEA! - Rags

We should all send them invoices for back pay that was "required" from us, the time spent going into Fiesa, answering our e-mails, basically anything that stops us from "producing" lines. Has anyone ever added up the time spent doing that quasi-related scut work that we don't get paid for?

FIESA and Enrich - Meh

[ In Reply To ..]
Don't forget FIESA and Enrich. Enrich is a great website, actually, with helpfful resources and educational modules. However, given how little I get paid, I don't see it as a career and therefore I don't really invest time on it. You don't get paid if you do choose to self-educate yourself by using Enrich. And you're REQUIRED to review FIESA every day, but you don't get paid for that at all either. The only pay you get is lines on reports. I thought this was supposed to be a profession and not a hobby. LOL

DOCUMENT IT! - sm

I was recently deposed in a lawsuit against them and this was one of the subjects. If you are required to do these things for your job, they HAVE to pay you for it. Keep a log book, document time spent, time not paid, etc. I cannot believe they are so arrogant to continue doing this.

"unpaid Time Off" For Production-paid Employees
Jun 26, 2011

Looking to find out from others if this "UTO" is a normal industry-wide policy for production-paid transcriptionists who are not paid for time when lines are not turned in; example, storms, power outages, company's platform down, etc.  Losing pay and bonuses for not working the same hour twice and getting paid for once.  Losing time for sleep, family and medical regimen, too.  What is the norm out there?  This just started recently.  Don't mind not being paid f ...

Isnt It Illegal For A Potential Employer To Ask Your Age?

Have any of you had the feeling you weren't getting callbacks from employers you applied with because of your age?  I've been getting that feeling, and I thought that discrimination based on age, among other things, was illegal. Company Tactics; Unethical, But Not Illegal.
Mar 02, 2012

I am starting to see a trend here with companies hiring MTs at 6 cpl enticing them with easy doctors, tons of work, and once off of QA "you are bumped up to 7 to 7.5 cpl."  When asked, "Typically, how long does it take to get off of QA?"  The answer always is, "No one is ever on QA for more than 2 weeks or we let them, go...1-2 days typically."  What tends to happen after the first day or two, they begin to add the worst dictators to the pool, thus making it mo ...

Why Would A Co. Require IE 7.0 Instead Of 8.0?
