speaking of the employee handbook - where is turning worm

Posted: Apr 03, 2013

When you sign for the employee handbook, it says something about no employee or manager can make up rules that contradict it.

labor law supercedes all policies - sm

[ In Reply To ..]
that rule would protect them from employees/managers contradicting policies and procedures, but in the end, company policies and procedures cannot contradict labor law.

I would like to see the employee handbook, but do not work for them. What does the employee handbook say about qualifying for full-time benefits? What does it say with regard to one's shift and NJA?

does employee handbook even address how to qualify - for full-time benefits?

[ In Reply To ..]
And does it provide a policy regarding NJA? I would love to know if anyone cares to share.

NJA policy - see inside

[ In Reply To ..]
The NJA policy is not addressed in the handbook but is addressed on the portal under HR Policies for Medical Transcriptionists. Benefits are discussed in the MT Rewards Plan, also found on the portal.
I understand, but I don't work for them - just interested

okay well briefly - see inside

If an employee gets NJA and NJA condition continues for 15 minutes, create a ticket in Remedy and choose from 3 options: Take the remainder of the day without pay, make up the time, or use PTO.

Regarding benefits, full time with benefits must work 39 hours per week and produce 150 lph. Full time limited benefits is 39 hours per week and 120 lph. Says nothing about losing benefits if these goals not met; may be implied.

Why so interested?
thanks - interested because...

I am interested in labor law and fair labor practices, and I wonder how they can stipulate hours worked AND lines per hour when employees are known to endure periods of NJA.

It seems not so out of the ordinary for employees to lose benefits and/or have their compensation reduced for not meeting quotas that appear to be unmeetable, and I question the legality of this practice.

If, because of NJA, an employee has to work 50 hours to meet the minimum line count for a 40-hour week, the company a) has to pay overtime, and b) may NOT reduce benefits and/or pay.

The company may NOT ask an employee to falsify their time sheet AND not pay overtime.
I have heard some lose their benefits - because they cant make the minimum
[ In Reply To ..]
I don't think it happens a lot but I think it does happen, and it should not happen if they don't make the minimum because there is no work.

I haven't heard much about falsifying timecards here at MModal.
I have never been asked to falsify my timecard - here. Also,
[ In Reply To ..]
There have been a lot of MTs without work, and I have not heard one of them come on here and state that they lost their insurance becuse of having no work.

I think that they route the work to the full timers when work is low, which explains why I, a part timer, have had such a huge lack of work since November!
I think the timecards are already falsified - sm
[ In Reply To ..]
because even tho we sit here waiting for work, we have to clock off and not get paid for that time. So even tho we might sit here for 12 hours, our timecard only reflects a fraction of the actual time we spent waiting and/or doing what little work comes in.
why are you sitting there for 12 hours waiting - no way
[ In Reply To ..]
Why not just apply for unemployment or get a second part time job or something. No way would I spend 12 hours of my day attempting to get work. That is so unreasonable.
I don't spend 12 hours - sm
[ In Reply To ..]
waiting. My point was just that they expect the impossible out of us, get all our hours in, get all our lines in and keep up the lph or else you get in trouble. So, basically they expect us to do that, and even if I'm expected to be here for my shift, I am not getting paid anything for that time. It's just a no-win situation.
that's the point - it is unreasonable - sm

Maybe the above poster is full time and needs to maintain a line count. Maybe she relies on the job for benefits. Maybe she doesn't have the financial freedom to take the day off without pay.
Unfortunately, the NJA protocol is outdated. - nja

It was written before Remedy and instructs you to contact your manager along with other incorrect instructions. They don't have their ducks in row -- because they have no idea how many or where their ducks are. I so wish I could fix all their documentation, especially CPs, and fix their job accountability. I could so do a better job. I'll bet IT doesn't keep a log of how they change the software and therefore don't know how they "broke it" and can't retrace their steps.
