Speaking of lawsuits - BurntOut

Found this on a Google search.  Is this old news?  It doesn't seem as though you can get any information about it anywhere.

Another one??? - Wow

Wow. There sure have been a lot of Keystrokes lawsuits for unpaid OT over the past few years. I have a strong feeling that more are coming in the future....

July 16, 2012 -- recent filing - GO MTs

[ In Reply To ..]
It's about time that MTSOs are held to the law. That's the only way I think to save our profession and its workers. We have worked hard for years with little thanks, all the while MTSOs ripping us off by classifying us as ICs, not paying benefits (while they continue to get benefits), not paying OT, not paying for research/downtime, and not paying minimum wage. GO MTs!!!!

GO MTs - Faith

[ In Reply To ..]
Yes, go MTs! We all need to raise hell and participate together and take back our MT careers as we once new them, let these MTSOs feel the fustration and pay the price for a change!!!

I tried to get the same thing going against FastChart - sm

AMS and because all the MTs were too chicken, nothing happened. I was so mad!

So did YOU file? All it takes is one, you dont need all - the MTs. nm

Can look up on PACER - dmj

[ In Reply To ..]
If you wanted access to the current filings/status of the case you could register for a PACER account.

http://www.pacer.gov/

There is a fee, but only if you hit a certain level in a quarter. See last paragraph of info below copied from the PACER website.

Public Access to Court Electronic Records (PACER) is an electronic public access service that allows users to obtain case and docket information from federal appellate, district and bankruptcy courts, and the PACER Case Locator via the Internet. PACER is provided by the federal Judiciary in keeping with its commitment to providing public access to court information via a centralized service.

CONFERENCE APPROVES FEE INCREASE

In September 2011, the Judicial Conference of the United States authorized an increase in the Judiciary's electronic public access fee in response to increasing costs for maintaining and enhancing the electronic public access system. The increase in the electronic public access (EPA) fee, from $.08 to $.10 per page, will take effect on April 1, 2012. The change is needed to continue to support and improve the Public Access to Court Electronic Records (PACER) system, and to develop and implement the next generation of the Judiciary's Case Management/Electronic Case Filing system.

The EPA fee has not been increased since 2005. As mandated by Congress, the EPA program is funded entirely through user fees set by the Conference.

The Conference was mindful of the impact such an increase could have on other public entities and on public users accessing the system to obtain information on a particular case. For this reason, local, state, and federal government agencies will be exempted from the increase for three years. Moreover, PACER users who do not accrue charges of more than $15 in a quarterly billing cycle would not be charged a fee. (The current exemption is $10 per quarter.) The expanded exemption means that 75 to 80 percent of all users will still pay no fees.

Entire complaint can be read through PACER - dmj

Get a PACER account and read the complaint filed. Interesting. When you do a query for the case (search for case 1:12-cv-05571). You can find the complaint document in the History/Documents for 7/16/2012. On August 13, 2012 a motion for extension of time to file an answer was granted until November 20, 2012.

They settled or won the other ones. I get paid OT and always have. sm - Happy KS MT

I worked with the person who filed. She was a piece of work and should have never been a lead. She is out for something free because she didn't like working and always was complaining. I asked for a transfer from her account because of her.

I guess no one has bashed KS lately, so someone had to. nm - KS MT2

Shaking my head. I worked under that person in the lawsuit, and there's no way she had overtime. I could never reach her and had to go over her head every time I needed something. I thought she was suing them for worker's comp, last I heard, but she must've given up on that. She always has some kind of complaint. I think she was fired.

Let me check my calendar. Ummm, yep, there it is. - Saturday -- KS bashing day. nm

plenty of times never paid OT - havetheemailsanddocumenration.

[ In Reply To ..]
It might be a disgruntled person but I bet she has a case. I've got plenty of backup documentation.
Agree - not paid OT
[ In Reply To ..]
Regardless of what type of a person she is or how hard of a worker she is/isn't, I also believe that she probably has a legitimate case. I speak based on personal experience with Keystrokes.

Everyone is entitled to their opinion and not everyone - has a good experience with KS.

If you don't like reading them stay off the boards.

She was there for 6 years!!!!! - BO

[ In Reply To ..]
She must have been doing something right. Can't someone just post a fact without someone else getting all tied up in their underwear??? If you're doing great at KS, that's wonderful for you! Don't try to shut someone else down for trying to inform others about what some judge thinks is a legitimate law suit.

Anything good out there? - trixie61

I just sent resumes to Keystrokes and FastChart. Holy wow...is there no company that anyone is happy with? Does anyone actually like doing this job and is being compensated fairly for their work? I'm shaking my head and wondering why I bother.

Waiting For The Lawsuits To Start
Sep 28, 2012

I'm no longer an MT, but I wanted to share this with everyone to maybe brighten someone's day.  I was talking to a client the other day who is being treated for cancer.  We got to visiting and I told her I used to be a transcriptionist.  She mentioned she obtained copies of her medical record and it was full of mistakes!  Wrong meds, incorrect anatomy, etc.  Apparently the doc tried to blame an MT.  Come to find out an MT had never typed, seen, or edited t ...

Class Action Lawsuits Against VR Cancers Would Start To Turn The Tide....

Many continue spinning their wheels in misdirected anger at the MTSOs who are the secondary byproducts/bottom feeders of the much larger metastatic VR software giants currently monopolizing this industry. Speaking Of Shorthand
Feb 11, 2012

I have had Shorthand for about a year and have never had a problem with it. Recently I noticed some of the words I have in it type out wrong. Costing me a lot of time to have to go back and fix. Sometimes if I erase and type again, then it will come out correctly. Anyone have a similar problem with Shorthand? Would it have anything to do with my license expiring in about 3 weeks?  ...

Let me tell you what happened to me the other day. I am traveling next week to Houston. I called a hotel there to make reservations. I said my name and then since it is sort of a long one, said let me spell that for you. Well no matter how much spelling I did, breaking it down into slow, 3 letters at a time, the person NEVER got it on the other end. I spelled the last name probably a total of 6 times total. In order to get confirmation through my email, it is my last name and then first and you ...

Speaking Of Being Disrespectful To MTs, How Do You Like This?
Apr 01, 2015

I had a horrible sound quality report from a dictator I'd never done before. He wasn't too bad, but the sound quality was terrible and it was a surgical speciality that is not too common and I've maybe had one other report on that speciality in the last 3 months. I had to leave a BIG bunch of blanks. Hated to do it. Of coure it was many more over what I am allowed, so I turned it in to QA and was looking forward to seeing what the corrections were because that is a good learni ...

I spoke my mind by sending this to all MQ addresses I could gather.  I got canned for it.  Not worried about it though.  Maybe it will make a difference.  I sure hope so.  Here it is:   I am hoping that this letter will alert any concerned MQ personnel to a potential disaster.  By introduction, I am one of many MQ employees who take pride in their position, in their work, and in their loyalty.  I am one of many MQ MTs who accepted and eagerly learned ne ...

A Coworker Speaking For The Group
Jun 01, 2011

At almost everyone of our weekly meetings there is a coworker who complains about everything.  She is never happy and monopolizes each and every meeting.  I know she doesn't speak for me, not sure about everyone else, but she speaks up as though she has conferenced with us all and that we are all in agreement.  How do I politley tell her to stop whining unless she specifically speaks for herself?  I am happy with my job, my pay rate, my hours.........everything that ...

Speaking Of Shorthand, I Have A Question
Feb 13, 2012

Small MTSO Speaking Out ... SM
Aug 06, 2013

I've been a member of this board for years and feel it's time to speak out from a business owner's perspective.  I see a lot of negativity against MTSOs (maybe it's just the big ones but still it touches a nerve) and just wanted to give my 2 cents. Not all of us are greedy, mean, nasty, evil people.  I can't speak for everyone but as for myself, I don't consider myself that way at all and my team of transcriptionists doesn't think so either.  As a ...

Speaking Of Irritating Noises...
Jan 23, 2015

It's that cold time of year, where the MT is forced to listen to dictators with a LOT of snot in their noses, which they periodically loudly sniff back and swallow.  Unfortunately, I have a very vivid imagination, and the mental image of makes me almost gag. Another annoying thing is when doctors speak in a low, barely audible voice, but their "S's" come out with a whistle, so each time you turn the sound up, you get the loud, shrieking whistle ...

Dragon Naturally Speaking Success Stories?
Nov 12, 2009

I'd like some advice from those out there that are using this.  I have 32-bit Vista.  I have heard that version 10 is a nightmare to install with cruddy tech support from Nuance.  Therefore, I am considering going with version 9 Preferred if I can find it.  I can't afford the Medical software, but I have heard of MTs having good results with training the Preferred version to medical words.  My hands are bothering me, and I need to get this software to help out with reports.  ...
