THIS is the attitude that allows them to treat us like dirt. - Legally, what are the ramifications of this? nm

My thought is your contract says old rate. You dont sign contract - with new rate. Then you should continue

[ In Reply To ..]
to be paid old rate and it is on MQ to keep track of all this and if you dont sign new contract they can stop allowing access to jobs. Just think, they would have to keep track of EVERY MT and their agreed upon rates and would have to pay old rate til they get it figured out.

I would look for the fine print - sm

I have no idea where mine is, but I'm guessing there are little tiny letters somewhere that state to the effect that this contract is subject to change on a whim, probably with XX days warning.

So true. Is there an organized person here who can quickly check that - out, who knows where their contract is? nm

There are no active contracts with MQ unless you are - a Canadian IC. (sm)

[ In Reply To ..]
All US MTs became employees as of January 1, 2006, and nullified any prior IC contracts or agreements.

Your rate will be exactly as they determine it like everyone else.

Well, they cant just change the contract of an employee, can they? - Again, even as employee, if you did not sm

sign a new contract, until they stop giving you access to work, arent they still bound by the only signed contract they have with you, at the old rate? I figure with the Q it could take weeks/months before they would figure out who has signed new contract and who is still working under the old contract.

They changed it before, they can do it again - Old part-timer

A few years back, they had us sign a contract, then later changed the terms. Our only option is to quit and if we keep working, they take that as an acceptance of the new terms. They seem to hold all the cards.
And all sat by and did nothing. Think should look at - what options Qers have. nm

Breach of contract - OldHandAtThis

[ In Reply To ..]
It's a breach of contract if they don't pay you as agreed. If you just accept this without taking action immediately, then the contract is considered to have been modified, a new contract exists, and there is no course of action you can take. If you are an IC, then submit an invoice/statement for the difference in what you received and what the contract specifies, and continue to do so. If you are an employee then contact your state labor commission. Ultimately, you could and probably should consult an attorney as to the best course of action.

Oh good grief. There are NO contracts! - nm

How To Amend A Signed Chart Note
Mar 11, 2010

Gotta question - I work in-house for a group practice that oursources the transcription to a service, then I work as an editor for the final review before the paper copy goes for signature.  The paper copies are faxed to the cc list of doctors on that note.  The original is then scanned into an EMR, with the paper copy then shredded.  There is talk of an electronic signature, but we're not there yet.  So my question is this - what would be the best way to deal with ...

Is There Anyone Out There Who Signed Up For Supplemental Insurance Through Colonial Last Summer
Jan 03, 2013

I called them today and I am still insured with them.  So, unless this is an error on the person I talked to, my next paycheck will have deductions for that insurance in addition to the deductions for the new 2013 Nuance insurances which are through other vendors. Does anyone know about this?  Our policies with Colonial should have been cancelled by Nuance. ...

I'm one of those that had a high enough test score to get into MModal's program but didn't quite make it.  I had already been looking at one of the Coding schools but wanted to give myself a week or so to think it over and not make a knee jerk move after being passed over by MModal.  Today, I picked up the phone and signed on with the school I've had my eye on and I start on Monday!  I'm actually reeeeally excited - and surprisingly I'm actually feeli ...

MDI Contract
Mar 15, 2010

I was looking through papers this morning and happened upon the contract MDI had us sign last January as independent contractors, but to be treated as statutory employees for FICA.  I didn't see anywhere where it stated an end date, and it did state that the contract was transferrable to any entity that might acquire MDI, if I read and understood it correctly.  Does that mean that Transcend was then bound by that same contract?  I am just wondering, since our line rate w ...

Contract Abuse?
Jun 26, 2010

Hi,   I have a big dilemma and I need help. I have been working for the same company for 6 years now. At first I worked for a bunch of doctors and a hospital and then quit the other docs and the hospital because one of my doctors said that he did not like to share and that he wanted me to work only for him. I did not know that was illegal to do until recently being that MTs are contractors. So I have been working for this one doctor and all the nurses and interns in the office for about 5 ...

Question About IC Contract
Aug 31, 2011

I have never worked as an IC before, only as an employee. I was offered a position by a company looking for an IC, and they have an IC contract that they send you and want you to sign. Is it common for an IC contract to contain the clause that you must provide 14 days' notice if you are resigning and that if you provide less than 7 days' notice they have the right to withold 50% of the monies owed to you? I can completely understand that they want adequate notice (just like any employe ...

Contract Concern
Nov 13, 2012

Can someone please help me. I am new to the company, I have not been here 90 days yet. my TSM is "gone" so I have a new one now and have not yet spoken with her. I am very concerned because I realized that my "contracted" rate of 4 and 9 cpl at 150 lph does NOT meet my state minimum wage, I rarely get straight typing to get the 9 cpl. I also am not meeting the 150 lph yet, even so that is only like 6$ an hour, that is horrible. I should have done my math beforehand. I didn't think they coul ...

Mercedes Contract

Question About 2 Clauses In IC Contract
Mar 09, 2010

I'm new with only a few months of MT experience under my belt.  Was offered a job with a company in Canada which I've heard nothing about.  However, their contract has 2 clauses I'm concerned about and would like your opinion on: 1. They will only pay for reports that meet their "accuracy and completeness requirements", and they wouldn't give me those requirements until I signed the contract. 2. Failure to meet a deadline for any reason means they will " ...

IC Terminating Contract - When Will I Get Last Paycheck

Advice On Terminating An IC Contract

This is the first IC MT job I have quit and I want to terminate my contract.  The contract says they require 30 days' prior written notice - I assume an email would be sufficient?  Would you also send a letter or even a certified letter?  Have any of you quit an IC job and not given the full 30 days (or 2 weeks or whatever your contract said), and if so, how did it work out? ...

IC Contract After A Month Of Work
Feb 01, 2013

New MT here, started the 1st of Jan so I've been working for a month.  The only info or paperwork I received from this company was a W-9 and direct deposit form.  In fact, I had to fill them out twice, not sure why.  I wasn't told my line rate until I flat out asked.  Yesterday I received a request to fill out these forms again, along with an IC contract.  I'm not legal savvy, so I don't understand most of it.  What stood out was the start date o ...

IC Contract Question - Is This The Norm??
Feb 17, 2013

What do you think of this? Is this a normal inclusion on a contract? Personally, I think this is a load of B.S. (P.S., they only pay 5.75 cents/per line to begin with, for straight transcription.) Any errors requiring extra processing (blanks/questions) or reprocessing (resends) created by the Subcontractor will incur a charge that will be billed to the Subcontractor by the Contractor. Charges will be made on a per-line basis of the entire (re)processed document with said line being 65 charact ...

Employment Contract With Nuance
Mar 16, 2013

I was offered a position at Nuance and was surprised to get the employment agreement that states I will be an "at-will" employee and that I must apply again in one year as the employment agreement is only for one year.  I was shocked.  I have never heard of this.  I am middle-aged and have never heard of "at-will" employment.  I have also never had to reapply with a company after 1 year.  Are all Nuance employees given this type of employment agreement?    Th ...
