Need information.  Contemplating going IC instead of employee and have very little knowledge about IC work.  Does the MTSO draw up the contract or the MT?  Any helpful hints would be appreciated.

the MTSO holds the cards and they make the rules. Typically, though, my MTSO has drawn up the contract. I can certainly object, but chances are the job will just go to the next waiting IC who needs to work.

Being an independent contractor means you are a business person in a 1-woman shop.

So let's just substitute making donuts for typing reports.

Are you going to call every potential customer and say- "I need a contract from you regarding your purchase of donuts. I need you to tell me how much you will pay, how you want them prepared, when you want them picked up, and how many you will buy."

It's not likely you will do that. It's more likely you will study the donut industry, find out what your competitors are charging, what kinds of donuts they offer, how many they sell in a day/week/month, etc.

The lack of knowledge of what an independent contractor really is is why the status is bastardized on both the MTSO side AND the MT side.

So, there are two types of ICs in our world of MT today.

The first one, is an employee in essence who may or may not have a set schedule (usually according to the needs of the client), works only for one client all the time (MTSO) and simply pays their own taxes. In this case, you'd more than likely let the MTSO give YOU a contract, you'd read it, decide if it works for you and sign it. Go work.

Then there is an IC who is truly a business entity. YOU provide your clients (MTSOs, private physicians, etc) with a contract that outlines your pricing, your confidentiality rules, who your security officer is, HIPAA compliance, your rates, your TAT, etc. You would then outline your own work schedule, take care of your own taxes, etc.

Can someone please help me. I am new to the company, I have not been here 90 days yet. my TSM is "gone" so I have a new one now and have not yet spoken with her. Employment Contract With Nuance

I got a contract with this company and have never seen anything like it.  Their performance rating/expectations outline is the most condenscending, tryannical thing I have ever read.  I bet military rules are more lax than this company.  They give you a 12-hour window but then say you cannot leave your computer for more than 30 minutes 3 times a day.  Then even go on to explain you can't go to a party, grocery shopping, go to the gym, school event, social gathering, bake ...

In a state where there is a prevailing wage (over $19/hr for MTs) law for employees who perform work on a state government contract, how do you suppose this MTSO is in compliance when the MTSO itself is only getting less than 10 cents per line?
