Has anyone worked for Houck Transcription and had trouble getting their money?...sm - ???

Posted: Mar 14, 2010

I worked for her, and she says she didn't get paid on an account and doesn't know when she will get paid, so doesn't know when she can pay me.  Excuse me, I didn't work for that company she subcontracted from.  I worked for her.  She should pay me no matter if she got paid or not.  Then she can do what she has to do to collect her money.  I have other friends and know multiple people have quit there over her not paying in a timely manner.  When will these companies who don't have the resources to run a business learn not to hire ICs if they don't have the funds to pay them?

Sue her in court for your money! - Do not type one more line for her.

Take her to court and stop typing for her then.

There are lots of hokey places out there. Was this in the contract you signed with her? The fact that she does not get paid should not affect your pay unless you signed the contract that states you don't get paid until she does.

What a shame this industry has come to this.

Did you sign a contract with her? Did you have the contract reviewed by an attorney before you signed it? MTs have to learn to do business in a business-like way. I will not lift my finger to the keyboard until I have a written contract which my counsel has reviewed first. What you do now is:
1. Report her to the Fraud Unit of the Attorney General in the state in which she is located and do the same thing with the AG in the state in which you reside.
2. File a complaint with the Department of Labor.
Did you check to see if this person/business has a business license before you started to work for her? I cal call myself Nick's Fabulous Transcription but I had darn better have the proper licenses to do business. Does she have a Federal Identification Number for the IRS? In short, is she a business or just a scammer? Last of all, sue her in your local small claims court if the amount she owes you is not over the limit. You will not be allowed to be represented by an attorney, but you can tell you case. Chances are, she will not travel to where you are to appear and you can take a default on her. Then you can have your attorney step into the picture and put a lien on her business to enforce the judgment. I am sorry this happened to you, but it sounds like more "due diligence" needed to be done before starting to work for her. Good luck to you.

I meant to say "I can call myself....." Between the time change and West Coast time, it's too early. Anyway, good luck to you. Above all, DO NOT TRANSCRIBE ANOTHER WORD FOR HER.

Thank you.... - ...

I will be much more careful of contracts I sign. Upon reading the contract, I discovered she had that IC would be "as xxx is paid." BUT as she is paid does not mean the same as IF she is paid. From what I have read on the internet even if there is a "paid when paid" clause it still does not mean IF but WHEN. It doesn't totally excuse them from paying. After a reasonable amount of time if they haven't been paid they still have to pay. I thought I would have to file in small claims court in her state, but I could be mistaken, I don't know for sure. I hope it is my state.

File in YOUR state, since that is where the work was performed. DO contact the AG's office in her state. Contact the Department of Business Regulation (it might be called something else in her state--you can find it by calling her State's Attorney General's office and they can direct you) and see if she even has a business license. If you really want to toast her cookies, contact the IRS as well. Chances are she is not declaring income. If she wants to play with fire, give her some FIRE.
First I would do this - drivebyposter

I would send her a certified letter demanding payment. Enclose any unpaid invoices, demand payment (give deadline) and EITHER outline exactly what steps you will take if payment not received, OR simply say you will follow due process of law if she does not comply.

Personally I would opt for LETTING HER KNOW that the IRS is on my list of things to do if she does not comply.

I think you are right on the mark. Your advice is great. I would simultaneously check to see if she has a business license and if not, I would roast her butt with the state and local authorities on that issue as well. Fair is fair.
You have a good voice on the board :) - drivebyposter

Thanks for your excellent comments as well - a lot of this is common sense but who among us has not had to learn some things the hard way?

Oh, I have learned a lot in the School of Hard Knocks, believe you me. :)- I think that with our economy the way it is, especially with trying to raise children, people are more desperate than usual. Couple that with the fact that many of the people coming into MTing are young and naive (nothing wrong with that, mind you, I was once young and naive myself). But these companies all think they can pull the wool over their eyes. I really hope that that person who knows the investigator reporter has some serious looking done at the state of our industry. I think it would make a compelling story. Meanwhile, people should cover their assets by seeing an attorney. You will lose far more by being swindled by some unscrupulous folks than you will be spending a couple of hundred dollars to have a contract reviewed. And not forgetting the issue of due diligence--how many would-be MTs check out the company they are thinking of working for? Believe me, I background check them just like they do me, and because I have had VA clients, there has been a lot of background checking, which is just fine by me and my family.

Take a look at the website!! - drivebyposter

OMG this is a site for a mentoring program and/or apprentice. For mentoring you pay a fee; as an apprentice you just work for them for free.

The concept of a mentoring program is one thing; but when you look at it after reading this thread of nonpayment, (allegedly) it gives it a very creepy feel.

All the more reason to have ALL contracts and agreements reviewed by a pro before entering into an agreement. As PT Barnum used to say, "There's a sucker born every minute." Slimy folks like this prove it. It is too bad there is not some master site where we can go to make a list of places to avoid.

Won't it be interesting when the investigative reporter(s) get hold of this?

What investigative reporter?... - ?

[ In Reply To ..]
I must have missed this info earlier. Please do tell.

Investigative reporter - anon

[ In Reply To ..]
Cannot tell too much; right now there is not too much to tell except there is an investigative reporter who is interested in bringing to light all of the scams of the transcription industry. His focus would be how rampant the corruption is, from the big giants (and we know who they are) to the little folks who have jumped on the bandwagon to rip people off. I will say no more right now; it he wants to do the story, he will come to the board and post under the name BILL.
But this is an old story: Capitalism = corruption - justsayin

And no this is not a political post - it's totally relatable to the issue.

Corporate greed and plain ordinary greed are always going to be present in a system that *encourages* one to make as much money as possible with few controls.

Not saying it shouldn't be investigated and even reported, just sayin' it's not new. Try to think of an industry where people are NOT being ripped off.

Really to some degree MTs need to realize how our system works: If there is money to be made, some suit will sniff it out. In some not so small way it's up to US the MTs to adapt.

Adapt *does not mean* acquiesce.

BIG MONEY
Jul 28, 2010

Okay, so I signed on with Transcend because they said, "Do you want to be guaranteed $900 per pay period as full time?" Well, sure. That sure reeled me in. I had always been afraid they ran out of work. Now it turns out that you HAVE to earn $900 IN ORDER TO BE full time. Big difference! It's like saying, "If you win the Olympic gold medal, you'll be guaranteed a first-place finish!" Or, "If you win the election, you'll be guaranteed more votes than your opponent!" It's so ba ...

How Do I Get My Money?!
Nov 21, 2011

Ok, finally, the horrors have happened to me. All was well, but now I'm getting seriously pissed. I work 8 hour shifts 5 days a week. Those hours are mandatory. My pay is equalling less than minimum wage. I e-mailed the company asking them about having to pay me minimum wage given the mandatory hours. The only response I got was "I'll look into it." That was over a week ago. In addition, the platform we use that records our lines is not recording all my jobs! I write down all the job ...

If You're In It Just For The Money, Don't Become An MT
Sep 03, 2012

I've had the same line rate (9 cpl) for 5 years, and I notice the new accounts they offer MTs pay 7.5 or 8 cpl at most. I must admit, though that I do work for a great company (I've been with them 12 years); they offer lots of flexibility (no required shifts or hours, just a reasonable line quota), payment promptly by direct deposit twice a month like clockwork, an easy to use transcription platform and wonderful QA and support staff. I have a lot of job satisfaction, though for my yea ...

Where Does The Extra Money Go?
Sep 27, 2010

I assume that the MT companies set up a contract with the client for them to pay on a per-line basis.  Of course, they charge more than they pay us; that's how they make their money & that's fine.  But what I'm wondering is... when we get a report that comes in as VR instead of straight typing, where does the extra money go, since we get paid less for VR.  I feel like I work just as hard, if not harder on VR than typing a report.  So why don't we make ...

Does Anybody Make Any Money At This? Sm
Jan 18, 2011

I've heard of more MTs NOT making any money than making money.  I've worked from home before but had to work full-time from home and part time at the hospital just to pay the bills then ended up quitting at home and went back to the hospital full time because I could make more money working from the hospital 40 hours than working 60 hours between the two.  I loved working from home but I couldn't make any money at it.  But at the time I only had 2 years' ...

Clinic Notes = No Money?
