On looking at my pay stub, it looks like the OT rate is not time and a half, is this correct or am I reading this wrong? Thanks.

Ask someone to explain it to you and, if you're lucky, they will. It is less than time and a half. I wish I understood it myself so I could explain it to you. I hope you're not ignored like I am when I pose these questions. I have always thought it would be easier for them and better for us if they just said, "Hey, we're in deep water and we'll pay you guys 1 penny more per line until we get caught up." When I suggested this, I was told that was too complicated for payroll (in the computer age, it is too complicated? and I'm supposed to buy that cheap excuse).

Like I said, they get away with it. Maybe not for long, I don't know. I've already contacted the lawyer for the T13 lawsuit. They didn't call me back. I should try again. I just gave up on N and am in the process of interviewing, hoping to get out very soon.

I just checked the labor laws in my state, and yes they have to pay time and a half for anything over 40 hours a week. They also give you a telephone number on the website for minimum wage/overtime information.

It is 25%. I was surprised when I found that out too. I was used to getting 1-1/2.

demand an answer. Unfortunately, they can and do ignore Emails, so there is not a thing anyone can do but quit or call a lawyer.

Thanks so far for replies. I am an ex-Webmedx so we have no access to any kind of policies manual from Nuance. I don't even really know what the procedure is as far as having to work final 2 weeks to get paid for any remaining PTO when quitting.

you can probably figure it out like this: Imagine what would be fair and reasonable and expect them to do the opposite. I am on my way out and plan to use up all my PTO before I quit. In the past, even if the job was horrible, I would always give 2 weeks' notice out of respect. However, this company has never respected me and I see it as a 2-way street. I will most likely not give notice. Also, regarding company policy, I do not believe there is a handbook or anything in writing; this allows them to change the "policy" at their whim. Haha, I'm on my way out too. I myself did give notice but regreting it. Ever since then I've been on QAs nasty radar lately "like I give a crap" and giving me the worst scores. Really don't care what they think. They are brutal _____ (fill in the blank above^^^^^.

We do not have a Nuance handbook. We do not have access to any Nuance websites. We don't have lists of who anyone is at NTS other than whatever we see in the occasional newsletter. Have no idea who to complain to about anything. So, when people say to look here and there for information, it does not apply to us.

I'm just wondering because I personally have done all of the bombarding, the calling, the bothering and it doesn't weigh on anyone's conscience to ignore all those attempts. Believe me, I have tried and done all of that. They simply don't answer what they don't want to. End of story. That is one of the many reasons why I am seeking employment elsewhere.
Say you know TL is busy so if she cant answer questions, you will - go up the ladder til you find someone who can. nm

I'd say if they do not reply, start calling them. They give their phone numbers by their signatures in the emails. Start leaving messages if they don't answer your calls and keep a telephone log of how many times you've tried to reach them by phone especially if they don't answer your emails.

If you look at the client forms library in AlphaStaff, there are FAQs from the HR roundtables that explain how OT is calculated. They state that they take your number of lines per week and then divide that by the number of hours you worked. They use that figure to come up with your hourly rate and then take 50% of that and multiply it by the number of hours of OT you worked to get the "half" of the time and a half for OT. I think the example they give is you type 10,000 lines during the pay period and make $800.00. You worked 88 hours during the pay period, so your average hourly rate is $9.09 per hour. They take half of that ($4.54) and mutiply it to the number of hours of OT you worked (8) so you would be paid $36.36 in OT for that pay period. I guess their method is legally correct, but it seems like they could do it a different way.

At least you get some OT compensation. Some companies ask MTs to falsify their time cards if they work extra hours so they don't have to pay them OT and won't be in trouble if their records get audited. I don't know if there's legal action being taken against this, but if there is I have a company to report.

I started a job with a company (I won't mention the name) and bailed because it was not a good thing for a number of reasons. The time card thing was something I learned during my training. I have written to the DOL in the state where the company is located and to the DOL in my state. They don't owe me money, I just think it's wrong. Thanks for the info.

They do this to fairly compensate you for the OT on an average rate. I've worked places where people will type 100 lines an hour for 40 hours and then miraculously type 275 lines an hour in the 4 hours they do OT to get the higher rate. This makes it fair for the company and the MT - more or less.

File a complaint. They will follow up on it and if you are right and they are wrong, hire a lawyer.
That's what I did. That's what a LOT of people have done.
But in the end, nothing will change. I am getting out of MT so I'm just trying to recoup some lost wages.

If the company is doing something illegal, why doesn't the DOL do something about it so that everyone doesn't have to spend money they don't have on a lawyer? I don't get that. How are companies getting away with it? The Department of Labor can't act? Probably rhetorical questions, but nevertheless, I don't get it.

included making it a class action, I think. And if you win, which how could you not, THEY pay. And most atty work on they take a percent so really no out of pocket expense.

I posted above under "Anonymous" and then again under Inquiring Minds" about the time card issue, I forgot who I was, lol! I received a call from a DOL investigator at my district office after I sent a letter, I'll call him tomorrow. My experience has nothing to do with Nuance but it seems that the DOL is interested. It's always good to get the word out, IMO.
One call to the Transcend suit atty, I am sure would be free and - they would be thrilled to discuss any issue. nm

I am a long time salary employee for an orthopedic group that is laying off all inhouse transcriptionists and outsourcing to Nuance. Does anybody know the production line rate of pay offered by Nuance? ...
Shall we make our guesses? Wonder if the new pay scale will be an across the board percentage reduction in rates or will everyone be moved to the bottom rate of 8 and 4? What about the people recently hired who make 8 and 4? Will they go even lower?
My personal opinion (pure speculation on my part) is they might just reduce all shift differentials and perhaps jack with the incentive plan some more.

With our new line rate starting Saturday, if we do over 12,500 lines we get increase of 2 cpl, means 2500 lines a day or about 320 lines an hour. Do many of you do this many lines an hour now? ...

According to a poster below which has apparently already attended one of the payroll meetings (as the poster posted) for nuance they have decided to keep the incentive part of all of our pay going with an exception that now you have to have over the industry standard of 98% to get a production based incentive.
In addition (if this poster is accurate) they have again cut the overall pay from 8 and 4 to 3 3/4 AND 7 1/2. This is nothing but a bunch of crapploa...an MT who is now getting ...
that fall during the shift. For example, if half of your hours fall in 3rd shift and half fall in 1st shift, do the 3rd shift hours pay more cpl? Or, do all hours have to fall within the shift to qualify?

After nearly a decade of working with Webmedx, I like many others am looking for extra work to supplement what I will be losing with Nuance. I have a chance to pick up some part-time IC work, but I have no idea what a good acute care IC rate is. Ten years ago, I charged $0.12/line. Is this still an okay rate? More? Less? Wow, I'm an independent contractor and was looking at the job seekers board to maybe take on another part time job. The rate of pay is still 7 to 8 cents per line?? This seems a bit ridiciulous.
