Reposted message I NEED HELP HERE - Now or never people..sm
Posted: Apr 04, 2014
I was told to repost this to bring it to the top..
Trying to keep this clear and concise as possible. I WANT to fight this sweatshop treatment they are giving us. I need some help, like names of lawyers that supposedly handle MModal or have handled them in the past. I have a "Jane Doe" email. If you want, and I suggest you do, set up one for yourself and then email me. Never can be to sure who is who on here. My son is the business school graduate that says this is an unrealistic goal for errors. It is the standard set for factories and it is very achievable there because the variables are different.
The thing I have tried to bring out on social media is that a lot of personal information is being sent overseas via medical records, 99% of the people have no idea where their personal information goes. To me overseas work is a violation of Homeland Security, I have spoken to doctors that believe the same thing. Also, notice the LARGE amount of ID theft, harder to track it when it originates overseas. And I dont believe HIPAA is enforceable outside the USA. To me that is THE only thing the general public cares about. The other fight we have is working conditions that only affect us. So we as a group need to stand up and be heard. My list is as follows, please feel free to add to it.
1. Impossible goals for accuracy in a field where the simple thing like a pause in a sentence or voice inflection can change the meaning of a sentence.
2. Constant barage of daily bullying to meet said impossible goal.
3. Switching from account to account with NO training, just a CP that is usually ambiguious at best, and then getting dinged for stupid errors. In other words, basically, improper training.
4. Unrealistic wages for what we do, personally, I took a 10K paycut through the years.
5. The phrase, see "the repository for samples" when you switch accounts. My new accounts, for the most part, have no samples in there.
6. Forced to work a schedule, yet constantly run out of work on that schedule. All the while they are hiring new people.
7. Lowered wages via Performance management and sending reports to QA because you are afraid to send them back to the doctor.
The other thing I need is from those of you fired or on performance management. What scores did you get to be put at that status. How many audits did you fail? We need total honesty here, remembering the industry standard has always been 98%, there is nothing to be ashamed of for a low score. Not here to judge, here to help.
ONE person emailed me, only ONE..I need information. I may have put the wrong email address on some of the other emails (hotmail wont let me into that account) but I am sure this note has the correct one.. I know what it takes to win a lawsuit, I know what it takes to "spark" a lawyers interest. I need to be able to say this is what jane doe #1 had happen.. I will list everything I get by email address and may never need your name, but if I am lucky enough to find a lawyer and move this forward names will have to put be put to the email addresses and in person action is going to be needed on your part, so if you can't make that committment then please dont bother..This is a big IF, I am willing to complie data, I am willing to ask some lawyer friends, I have friends in places, one being an Ex Senator that stepped down for health issues that fought heavily for workers rights..

To quote Garth Brooks " I've got friends in low places. Where the whiskey drowns. And the beer chases my blues away. And I'll be okay." But I truly hope with all your lawyer friends and ex-senator friend that you can accomplish what you are setting out to do. Truly, much luck to you.

Here is an old post regarding (at least) min wage for NJA even though it's not on your list. Hopefully this can help you if you contact an attorney, or perhaps you can try e-mailing the poster for further info. I remember this because I found the production vs. tiered incentive part quite interesting. If this is true (and you can verify this with an attorney), they really don't have a leg to stand on when it comes to letting employees sit during scheduled hours with no work for no money.
Good luck. Please keep us posted, and thanks for standing up.

Be glad you have a job in this country as long as you have it. So many people out of work for months to years would be more than happy to be able to have these jobs. Mmodal lawyers can beat up your lawyers. This is not the former Soviet Union and NOT the workers' paradise. This is a plutocracy.

I'm not L&L but I do think your analogy is going a little too far. Nobody here is condoning "rape" and I think the parallel between "allowing rape" and being happy you have a job in a really rotten economy is a bit of a stretch.
Let's all try and keep it in perspective. Just because someone may not agree with the steps being taken doesn't mean they "condone rape of women". Sheesh.
But... we ARE being raped. Just not in the - "traditional" way.

Isn't MModal? It will all eventually catch up to them. What is being done by these lawyers anyway? We have already given them all this information, and the only thing they seem to be focused on its the nonpaid overtime.

to sit back and let your employer take advantage of you. Save that "be thankful you have a job" nonsense for someone who wants to be a doormat. Being "thankful I have a job" doesn't pay the mortgage, but I think you already know this.
Wanting fair pay/treatment does not equal Soviet Union. Give me a break.
True! And I'm thankful I DON'T have a job! I'm - on UI, & make more than I did @ MTSO.

And yes, I AM looking for a job, but NOT in MT, or any aspect of the medical field.
Either I get a living wage, or else the government, which was so instrumental in my living wage going to poor little India, can continue to pay me. (And they can also kiss it.)

I don't believe any of you understand what plutocracy means or what it means to have 1% of the US population controlling everything.
You simply exist to work and earn a little money to keep corporate America functioning. Bread, circuses, and lawyers.
NOBODY but you cares. I don't have to believe what is happening in this industry is right or wrong to see what is happening in this country.
I don't believe you are going to get anywhere fighting for an industry which is already on its last legs when the organizations such as the AFL-CIO have fared no better in this corporate plutocracy.

thrown in the towel doesn't mean everyone else has to. No two people attempting this same thing would likely get the same results. So who's to say that this particular poster, and perhaps the particular lawyer she has in mind, won't be the key that unlocks the door to a precedent-setting case?
Yes, everyone is aware of the AHDI result from the last suit. But did you ever think that it was also a learning experience? I'll bet my last dollar that AHDI will not be getting dime-one the next time around - that lesson has already been learned. Whatever caused that last suit to take that particular path will be avoided next time.

anyone has to lift more than one finger. Unfortunately, I think the case will have to be already coming together in terms of organization and paperwork, and you'll need to have a much larger pool of claimants that just the few that frequent this board. Have you considered hiring an investigative-type person to do the legwork of finding out who are all the thousands of OTHER transcriptionists in America, or in your particular region of the country? That might make your job a lot easier. You need names and email addresses so that these non-MT-Stars-readers can be reached.
It may be a matter of trust - For me
[ In Reply To ..]
Considering this is an anonmyous board, I don't feel comfortable giving out my email address to anyone from here. Even though I support you and what you are doing, unless I can see you and know who you are, I just can't do it. I would be afraid to lose my job. It's not much, but it's putting food on the table and I can't risk losing it. Hence the trust issue. You may be who you claim, but considering the posters who frequent this board, I just can't take that risk. Maybe do a Facebook private group where we could share information without it being subject to the management types who frequent this board.
You can always use a disposable email address, - instead of your real one. ;)

She is simply being proactive & willing to fight for what she believes in. And a good way to reach other MTs and get their stories is right here on this website.
She is already doing a lot by committing to all the foot work. *IF people are interested and willing to share their story, the only thing she is asking of them is to send an anonymous email; and that's not asking much. The OP is doing plenty as it is.

of creative, investigative research that enables you to find and contact the at-home MTs in America. This board is not only just the tip of the iceberg, but the numbers of MTs represented here has dropped substantially because many have simply dropped out of MT altogether.
I'm always surprised when I talk to fellow MTs, either that I work with now, or at former companies, who don't even know MT Stars or any of the other boards even EXIST.
I think you'll get the best representation of the medical transcriptionists in the US by ferreting out all those truly invisible MTs that don't read or post on this forum. How you'll find those people is anyone's guess, but I think you'll have to use the same tactics a skip-tracer that works for loan companies would use. It takes good telephone acting & impersonation skills in order to gain the information you need, but I know for a fact it's highly effective.
Just call the law firm below. They will do all this work for you. - mtnsp
