was let go because QA gave me 97% - frustrated

Posted: Mar 29, 2010

I was let go from my full time job of 10 years.  I dont think I can collect unemployment if I have a part time typing job............ can I?

I would check - each state is different. I do believe even if you have a part-time job and are not making more than the unemployment weekly benefits you can still collect. I am collecting unemployment and am eligible for benefits even I was working part time, which I am not working at all, that I can receive benefits as long as they do not exceed what I am entitled to each week. It is worth checking into.

if you were fired, you can't get unemployment, sorry about that. - nm

I was FIRED and am collecting unemployment - RLee

A close friend of my husband's was fired as well and is collecting unemployment. He worked for a medical pharmaceutical company delivering medications to various clinics/hospitals/clients. He unintentionally left a package behind containing medication while loading his van and was terminated due to the fact that these packages had to be accounted for at all times. This was an "isolated" incident and his employer appealed the unemployment claim, but the DOL still granted unemployment in his favor. Every state is different and each circumstance is different. This acquaintance obviously made a critical error, but it was not intentional.

Someone needs to "QA" the QA. Most of them - are highly prone to errors! nm

You might have a good case for a wrongful termination - Lawsuit - or something

[ In Reply To ..]
Especially if the 97% was the sole reason *written* for your termination, you might think about checking with an employment lawyer. If they didn't write it, it's even better!

This is just such a flaky thing to fire someone over, not to mention being rather excessive. As another poster said, a different QA person would end up with different accuracy. And what's the difference, really, between 97 and 98%? What kind of perfection do they expect. Were "the rules" the QA person used ever provided to you in writing? What are other employees' accuracies?

Employment laws vary by state, but a lawyer can advise you.

If you're over 40, you might be able to turn this into an age-discrimination suit.

Wrongful termination - Ex-MT

Wrongful termination; discharged for unjust cause; discharged for unreasonable cause -- whatever it is called . . . that is what is going on. It was done to me and I had lawyers from all over the city calling me wanting me to sue my employer. I was put through such a terrible experience, while I worked there, that I did not pursue any lawsuit, because I did not want that group in my life again. BUT . . . if I could do it over, I might just pursue it because what they did to me was unreasonable and wrongful, and not only that, I believe that I am being black-balled to the point of creating as much misery for me trying to find a decent job as possible. I never thought that I would say this but take them to court . . . for what would happen in the future and your working future. You may not have one or have a difficult time (like I am) if you don't. I wish that I would have. I never would have thought that I would get an attorney after a car accident, but I did and I am glad that I did. I didn't get rich or whatever, but it paid my steep medical bills and totaled car . . . the insurance companies just quit paying when they find out it is a car wreck and I was laying there with my guts ripped out -- get an attorney and check out the wrongful termination.

The keyword is "wrongful" termination exactly. If this QA score was an isolated occurence she probably is entitled to unemployment along with a lawsuit if she chooses that route as well. I have found in the past that getting "dinged" on QA depends on the person doing the QA. If they do not all follow the same guidelines the audit will be different. When I got a new TL she pointed out something she thought was wrong in my axis diagnoses for psych work. I had been doing it a particular way for 5 years and never got "dinged" on it before even when I was working in house and psychiatrists would proof work. The TL felt it was wrong because she had psych experience as well and did it a different way. Needless to say - I had to keep the TL happy and go by what she chose for the axis diagnoses.

As far as unemployment - I do know someone that is working part-time and is collecting unemployment. They were let go from their full-time employment but can still collect what they call "partial" unemployment. The unemployment office will determine if the reasoning for being terminated is "wrongful" and I do believe if there were no warnings and this was an isolated occurence unemployment will be in her favor.

was it a one-time 97% score or a consistent - failure to meet the standard?

[ In Reply To ..]
I'd be shocked if you were terminated due to a one-time 97% QA score. Usually it's a consistent substandard QA performance that will lead to termination. If you've been given a warning and tools to improve and still fell below the acceptable standard, not sure how it would be considered "wrongful" termination. just saying.

Gave Notice To The Q
Dec 14, 2010

Hi all.  I've been doing medical transcription for over 20 years, and have been with the Q for almost 12 years (the first year in the office and at home, and then they sent us all home).  Been through all kinds of changes, from working in the local office and at home, to working at home, to being moved to the responsibility of another office, to that office closing down, then to working for a "virtual office" and finally a "service area."  I lost count of how many superv ...

Encore Gave Me Bad Paychecks

I thought I found a good company to work for until I got a two returned checks from them in the mail. The first time I thought mistakes can be made but AGAIN my check was returned. That really upsets me because I work hard for this company and they give me a bad check. There is no excuse for doing this to an employee. I have not been contacted about this check and I just quit because enough is enough. This is very dishonest and unprofessional to say the least. I have a family to take care ...
