I was reviewing my current contract. I am an independent contractor and do not work for a company. It states the following: The agreement shall become effective ________________, 2014 and continue for a term of one (1) year, and shall renew automatically for additional one (1) year terms, in the absence of ninety (90) days advance written notice to the other party. If HOSPITAL terminates TRANSCRIPTION SERVICE agreement upon ninety (90) daysâ�� notice, no further salary will be due TRANSCRIPTION SERVICE after the effective date of early termination. Notwithstanding the termination of the agreement, the parties shall be required to carry out any provisions or obligations which may have accrued prior to such termination. Is 90 days normal? Any thoughts on this would be appreciated. I haven't signed it yet and want to know if this is normal. Thanks so much!

Ask how many days notice they gave those who have been terminated by them. Probably zero and they deserve what they give. 90 days seems extremely long, but they can put it in the contract. Doubt they would sue you for not giving notice because you can't get blood from a turnip.

The companies could absorb a sudden resignation much easier than an MT would be able to bounce back from sudden termination. I wouldn't give them an inch more than they would give me.

I signed on to work one night and was told I was on p.r.n. basis as of the NEXT DAY. How much advance notice did I get?

They now terminate transcription departments on the spot. They say it is because of the fear of any type of on-premise anger and it is to protect themselves and you. Sobeit. Golden Rule now of termination! At Will, I guess. New Rules.

But you can do to them, just like the hospital would do and give your 90 days and then not take on any work. IOW, give them 90 days notice that you will no longer be servicing their contract, then just stop working.

Most professional contracts have the 90-day clause on all ends - hospital to MTSO, MTSO to contractor.

Another question, do they treat you as a contractor or are you treated like an employee?

IC for over 25 years and never had 90 days in a contract. All mine were 2 weeks or 30 days. - 90 is excessive,. NM

I have done some Team Lead and Acct Management work too. I was working 3 VR Editor jobs (I also have an online jewelry boutique) to make ends meet. I am so fed up with this job. I barely make $8 an hour, and part of that is how much I hate the job and how slow it makes me want to go.
