Has anyone else at LM been informed that we now have to clock in and out starting today at midnight? I got an email yesterday that there are now federal government regulations requiring us to do so. Fact? I've searched and cant find anything about that.

Maybe it's because we are classified as employees? I don't really know.

to try to stop abusive unfair practices of some of these online MTSOs. Want overtime? need a time clock to prove 1 minute over 40 hours, for example. It'll be pretty much standardized everywhere for employees. Pain in the butt sometimes, but same as working outside and punching a clock, so no biggie. It's for everyone's (even the MTSOs) protection and not another whip-crack. and, yes, it's coming from the gov't trying to get some standards in place.
One company I worked for had us make note of the hours we were on with no work. Was a real eye opener for the MTSO for sure, to see all those holes on paper. Came in handy filing for UE underpay benefits. Justiied the earning of any benefits actually. If anything, made a good argument for hourly or retainer pay if not reason to quit and find a 'real' job elsewhere. That is to say, find an MTSO with business sense/tactics incorporated into their daily operations. How to Manage Accounts and Staff Properly 101, comes to mind.
No offense MTSOs, just my humble opinion and not as a whole, but pretty much overall by my experience.

A company I worked for last year as an employee made us log on and fill out a time sheet, and we could ONLY put time that our fingers were on the keyboard. No time could be included for looking up things to verify, etc.

In my email, it said we would have to keep track of our lines and enter them into the time card?? Does that mean we have to purchase a line counting program too? And where on the time card do we put the hours? I've sent an email to "A" but haven't heard anything back yet.
Also, what about NJA? Do we stay on the clock waiting? Keep clocking in and out looking for jobs?

I work for Landmark, too, and did not get that e-mail. Because it appears that only some of us got it, I am wondering if it is specific to a particular account? Not sure, just guessing.

I got the email as well, but mine never said anything about a time card. All it said in mine was that we would have to clock in when we start working and whenever we take a break or finish for the day, we'll need to clock out. It then said that in addition to clocking in and out, each time we clock out, we'll need to add our line count for the period of time which we just worked. So, does this mean that every time we clock out to take a break, we're going to need to enter our lines??? Maybe that's the time card. I don't mind the time clock portion at all, but the fact that we have to enter our lines that we just typed each time we log out is a bit ridiculous. My account is on ExText and it just shows the total for the day, not the total each time we log in and out, so I guess it's going to be up to us to do the math and keep track of our counts. That part just seems like a huge hassle and it really seems unnecessary to me, especially since the email said that they would still be going by the line counts on ExText for payroll.

After you punch in and out, there will be what looks like a little yellow sticky note icon. That's where I've been putting mine. I didn't see any other place to enter them.

I just logged into it with the username and password they sent me and it's legit. The email came from A, the owner of the company. I'm totally baffled as to why some people didn't get it. I got it around 10 p.m. EST last night. I'm really not thrilled about this. My husband thinks it has something to do with Obama Care.

I got it and it did say something about govt. regulations and insurance - I was never even offered insurance - I thought the point of IC is that you keep track of you're own stuff. Unless told otherwise, I will stay clocked in if there is no work if they are going to consider me an employee.

I view this as change not necessarily being bad.
My feelings are:
1. I have a job at a good line rate. Not everyone has a job nor can find one in this business any more, so I'm grateful for that.
2. There are going to be changes regardless because many states are clamping down on at-home workers. Some are also clamping down on IC status and making MTSOs report the income to the state tax commissions (California).
3. I know they are doing this to meet a regulation, so I'm doing my part to work with them and do my part.
I'm the go with the flow type, so I'll just do what they've asked of us and carry on.

I have been with LM for a LONG time and never gotten PTO, cause there's no record of what we are working, other than lines. Now, with a timeclock maybe we can get paid for time off. However, they are going to have to define how many hours is considered full-time instead of lines, etc. I think the same hours per week requirement for insurance is going to apply. In other words, the feds are going to say if you work X number of hours, they have to provide insurance, PTO, and all the other labor laws that apply to your state-this is actually a good thing for us!

which is what I see this business going to because they can't afford to pay benefits, so will be all IC or part-time soon I think. If you notice, many job listings are IC or part-time already, except the bigger MTSOs.

I asked about this and was told it is because of the health care changes in 2014. We all know there are changes coming and the government is keeping track now of everything.

No IC should be punching a timeclock. If you are, report it to the IRS and have LM investigated for your status and let the IRS determine whether you're a true IC or an employee.

I've been with LM a very long time and they have always been good to me. I make a very decent line count compared to what else is available out there and I rarely have NO work, so if they want me to clock in and out, then clock in and out I will. I could be in a much, much worse position if these boards are any indication. Its pretty ugly out there in the MT job market. I feel fortunate to have the job I do with them. Not trying to be a rah-rah, that's just the facts in my situation.

I am staying clocked in when I am out of work. I literally check for jobs every 3 to 5 minutes. I am not going to be clocking in and out 50 times throughout the day.

I asked A about this and received the reply from K and it said that we clock in when there are jobs and stay off of the clock when no jobs. I'm not doing that though, that is called illegal wage theft and I will definitely report them for that one. I have already reported one MTSO before in the past. I will clock in at the start of my shift and clock out at the end of my shift. Hopefully, they keep me busy or they can pay minimum wage.

Again, not saying I agree with the policy, but every MTSO out there has you clock out when there is no work.
The only thing that may work in your favor is if you have a mandated schedule so that you HAVE to be clocked in by 3 pm and you are scheduled to work until 11 pm, something like that.

Again, I am new to all of this, but what I got from the e-mail was that our vacation pay, etc. would be determined by our hourly production logged in. If we stay logged in while we take care of errands, etc., won't that bring the average down? And if you don't mind one more question, is it possible for someone who is an employee at Landmark to change to being an IC? (I do not need any insurance from work--I already have my own insurance.) TIA.

I can't answer your question, but I'm an IC and I'm required to clock in and out too. As it was explained to me, it has to do with the new regulations for record keeping and the upcoming changes under Obamacare. :(
I'm personally not going to sweat it. It seems to me they're just doing what they have to do to meet federal regulations.

I agree 100%. This is not Landmark's choice. They are just doing what they are required to do in order to keep up with the new government regulations. Otherwise, they probably wouldn't be doing this. I am very happy at Landmark and love my accounts, so I'm not going to sweat it.

Trying my best to do an outstanding job for LM as they are great! K never treats me like a number. She is caring and a very nice person. I've had less interaction with A, but she also seems to be a nice, friendly, decent person. I think they try to strike a balance between the needs of the company and the needs of the MT, which isn't always easy to do when medical transcription is going through such a rocky time and possibly will be phased out or extremely changed.

Yes that would bring down your production rate by not clocking out. I just find that there isn't time to clock out for some things like the dogs needs to be let out right away, etc.

When To Clock Out OOW? Jul 29, 2013She and I had a few e-mails back and forth about when I should clock out OOW. I'm just...confused. I have been clocking out OOW after doing the usual protocol any time there isn't work and had no issues with that with my old TSM.

Time Clock May 22, 2012The requirement for ICs to use a time clock is apparently to protect the service from being sued for unpaid labor, right? If you sign in honestly, i.e. whenever you are doing anything for this job with the service, tech tweaking, software installation, training, spreadsheets, research, phone calls, etc., etc., etc., it would put you into overtime and you are fired, right?
