Well this this a bit of a contradiction isn't it? Which is it many or some? It is irrelevant information to employees at any rate. A responsible business would have a revenue stream to deal with these issues. She clearly does not grasp that this is not a problem she is legally allowed to pass onto employees. Employees must be paid according to labor law and if she does not do that then she is in violation. This is not an acceptable excuse.

“We all appreciate the hard work that you do and the support and loyalty and patience you all had in 2019 and now. This will not be a year-long issue. We will be caught up and then on track and we will stay there.”

First off, no, the “we” is clearly not appreciative or else they would run the business like a real business and pay employees. Appreciation does not pay the bills, nor is it what employees signed up for in lieu of a check. And who is the “we?” By the information in the memo it is looking like a one woman show? It won’t be a “year-long issue?” Are people supposed to be grateful or hopeful about that. It won’t be a year-long issue because by law it is illegal to be even a one-time issue!

“We are not selling Keystrokes. At this time, there are no plans to send work offshore, although this has been discussed…”

I really don’t think selling Keystrokes in its current condition with the debt and lack of good will and Ch.11 bankruptcy status is much of an option. As far as sending work offshore, go for it. If that is a veiled threat it isn’t working. She can send work wherever she wants to send it. This information is also irrelevant since unpaid employees are in effect unemployed anyway. She just needs to settle her debts to her employees and pay according to the law or she needs to close up shop or sell to someone who can run a business properly.

“The payroll delays will be cleared up. I will answer everyone individually who emails me, but please be patient with answers – I will always within 24 hours. I cannot guarantee faster than that, although I try, because I am tied up most days with customer calls and off-site meetings and with the number of emails I get daily. I am not ignoring you.”

What? Is this a one person show then? According to the website there is a : CFO, VP of Operations, Executive Director of Operations, Sales Consultant and many others. So now she is the only one who is doing everything? Either she has inflated the website info or the team is woefully inept or maybe they weren’t paid and left too?

“By the same respect, I will not tell you something just because it’s what you want to hear. If I cannot release your check, you will get that answer. “
So an admission there is possibility she is holding checks, interesting. She is the owner and she knows exactly where the check is and if she tells an employee that is owed a check “I cannot release your check” that is a very different matter from being lost or in transit in the mail. If she ever tells an employee she cannot release their check that is clearly illegal. But lost in the mail is unacceptable as well.

“Yes, we have been cracking down on minimum wage and those who are chronically on the minimum wage list will be notified that they must bring their production up to the minimum standards we have in place to remain with Keystrokes.”

This is irrelevant information for an employee. Having to pay a minimum wage is the cost of doing business in the model she has chosen. This information is no excuse for non-payment to employees she owes payment to.

As far as her comments about ‘rumors’ on social media. Unless employees can take her threats to the bank and cash them then nobody wants to hear her empty threats. She has no power to tell people what they can discuss. I have seen no rumors, only facts that she is not fulfilling her role as a responsible/approachable/transparent employer. It is evident by this contradictory memo that she is not giving employees accurate information and employees will naturally seek advice and counsel. If her management is such that she threatens to fire employees that talk to each other, what does this say? It appears that she is very fearful of people sharing information. Could it be because she tells some one thing and others are getting another story? Why no climate of teamwork? This is a very dysfunction situation and likely indicative of serious internal problems. Most reputable companies are striving for a climate of teamwork, yet this company discourages that. As for her contacting her attorneys, go for it. It will be easier for the attorneys hired by employees to deal with another attorney and not her. That is just a threat from a person who is desperate to deflect attention away from the issue, non-payment to employees and questionable information regarding the status of that pay.

As a whole, the memo confirms what people are thinking: There is reason to be concerned about the health and longevity of the company and that there is questionable information regarding payment status on wages owed.

The main issue is non-payment of wages owed and the memo is IMO just a lot of excuses and promises. What she needs to understand is employees don’t have to wait on promises. If their checks are late the company is in violation of labor law. Promises and whining about problem accounts is irrelevant. She must pay on time and according to the law.
