Why hasn't IRS clamped down on this IC situation? - MTSOs dodging taxes, unemployment etc.

Can't remember exactly, but maybe 20 years or so ago, the IRS focused on MT companies using ICs, did audits on them and some wound up paying bigtime. As a consequence, the practice of using ICs in the MT industry all but disappeared for awhile, but obviously it's gradually crept back. I know some like it, but it really isn't a good situation for MTs because it allows companies to escape and/or avoid all kinds of employment laws, regulations and fiscal obligations that other employers have to abide by, and which protect and benefit worker-bees like us.

before they will investigate. Find the info on this link. If you meet the criteria and the company is in violation, you can report it here also. Do not assume that someone else has reported the violation, or that the IRS will investigate on their own, you do need to report it. I have read that the IRS is cracking down on this in all vocations, but they have a long list and all violations should be reported.

I would love to see some of these MTSOs slammed with - taxes and penalties. I have to pay taxes, SM

why should they get off free and clear without paying taxes and penalties?

I intend to report 2 of the ones I worked for and see what happens.

IC has never disappeared. A couple of companies have had to pay, most do not end up having to pay because the reality is, the contractor laws are loose. Any company with a decent attorney can shoot through the IRS "guidelines" (that's all they are folks, guidelines, not laws).

Most companies using ICs are doing so legally. Because you may WANT to be treated as an employee doesn't mean that you are or should be.

If everyone who complained, filed a case, maybe you'd see the change someone on here suggested-- getting rid of MTSOs. (Yeah now THAT is a stellar idea- NOT)

An IC means a person is an independent contractor. That means the person pays their own taxes, sets aside his or her own vacation or sick time. That's what being an IC is. There are certain jobs that are IC positions. If you want to blame anyone for it blame the MTs. Because so many of them out there have abused the system. I know of so many ICs who log in then go and do their laundry or clean their house while jobs sit it their system. So do you think MTs should get paid by the hour so they can do their laundry or clean their house or whatever they want which is probably everything but work. It's not fair to us working our butts off hard working that our coworkers are out there goofing off and getting paid for it. Also I worked with a girl who had a long report signed out and we all thought she was working on it. Meanwhile our supervisor had just gotten back from a store and ran into her. She called us from her cell phone and told us to log her out as she was shopping. She also made sure one of us completed the long report this MT was holding in her system, which was a great dictator we all wanted. After that because of that MT we went IC or if we worked at home that day we had to complete a certain number of lines.

MT's are the ones who abuse the system when they get paid by the hour, yet don't do the work.

Besides, you are the one who has the control to change that. Find an hourly job.

I was an employee for the same MTSO for 12 years until we got bought out. And let me tell you that there were a LOT of employees who cherry picked and got on and off the system to avoid bad dictators, etc...After we got bought out I had to compete against 15 other employees and was having to work 12 hours a day to get my required line counts. Now, I am IC. If IRS wants to change that, so be it, but my work ethics havent changed just because I am IC. Dont put all the blame on IC MTs. Some of us dont have a choice anymore but to become ICs if we want a job and put food on the table for our families.

current date into the body of the report, it's puts the WRONG date. For example, I just noticed that it put 11/08/2010, and of course it's 08/10/2010. So, I may have been inserting the incorrect address until noticing this. Does this happen with anyone else or just me? one out here with nothing most of the time? I filed for partial unemployment but I really don't know what that is going to do for me yet. TSM looking into transferring some of us to other TSMs. We lost a rather large account and have been running into OOW a lot. Hoping I don't get called. I really, really like this TSM and don't want to have to learn another group of accounts. My accounts (5) have been dried up for the greater part of a year. People have quit and more are hired. I see newbies making horrendous mistakes on my primary.
