FYI:  The one-stop for Texas contact, David Smith, is very prompt in responding.  He does indicate that Medquist has been requested to supply a list of names if and when any are laid off.  While not specifically addressed, he gives the impression that we must be laid off before we can apply.

New TAA rules in place -- only need PRELAYOFF status - --

Based on new rules signed in place very recently, end of 2009, PRE-LAYOFF status applies to Medquist workers. You should call someone else if you can and just request the packet of information/application. If the staff are unwilling to help, there is a federal office that can assist you. The person sounds nice but not THOROUGHLY informed, perhaps he meant to be though. The Medquist petition applies to ALL MTs working at home in every state. Once the application is submitted, then a determination is made about eligibility. The person you spoke with is only a provider of information, not the main determiner of who is eligible. Although Medquist is located in Laurel, New Jersey, the petition submitted at the federal level was approved on behalf of ALL MTs that qualify. It is not based on whether you are already laid off. This is the typical requirement for regular layoffs to apply for unemployment. TAA has different rules and a different process, which includes PRE-LAYOFF.

I would make an appointment to go in to see someone at the local office. Follow same procedure posted by MT2020 above. She took in her paycheck stubs for last year to show decrease/change in pay. She printed out emails from CCM about NJA policy and emails about no work being available (i.e. the daily BOB updates). She printed out a copy of the Medquist TAA petition. She printed out information from posters on this site about MQ's outsourcing policy. She printed out info about MQ's NJA policy from their site. She printed out messages about NJA in all regions often weekly for MQ. She was prepared when she went to talk with TAA staff. It seems the local WorkOne/Workforce Development staff are only checking their state websites about businesses that submitted petitions for workers in their states. Medquist may not even show up on a specific state's site (under the state's businesses qualifying for TAA for employees in their state). You have to mention that the petition is on behalf of all MTs in all states, but was filed in Oregon. Also, that Medquist is located in New Jersey. Although the petition originated in Oregon and MQ is located in New Jersey, the WorkOne staff should know that the petition was approved for all MTs to be able/eliglibe to apply for TAA, no matter what state. Don't give up. Make an appt to see someone in your local office. Be prepared when you go in.
