Just got a call back from TAA Regional Coordinator - RE: ALL MQ employees.

Rosemary called me back just now. 

She contacted the Federal Office.  The Fed Office is going to contact ALL STATE COORDINATORS to clarify them on this TAA program for MQ employees.

If you can prove with pay stubs that YOUR PAY HAS DECREASED with MQ during all the changes going on with CBay buying MQ and sending increasing amounts of OUR work to India -- YOU ARE ELIGIBLE EVEN IF YOU ARE STILL WORKING. 

I told her I lost about 800 dollars a pay since they eliminated my department and took my hourly rate away and then the appearance of NJA screens.  She said THAT would make me eligible.  I told her my state and my local offices told me a cut in pay is not applicable in the TAA program, but she said YES IT IS.  Not only does the TAA pertain to hours lost but WAGES lost, also. 

Everyone who had zero luck before, re-contact your state coordinators because they are all being notified that those of us who have been affected salary-wise are eligible for help through this program.

Finally!--the MQ employees who have been affected already by all this will get some help. 

Those of you who have not been affected yet -- (and you will be) -- the program is active until 2011, so you have time, too, when your work makes it to India.

Don't keep the pay stubs anymore. I just work more to make up the difference, so I have absolutely no proof.

Medquist has IPay --record of pay stubs - Contact HR -- make request

to have check stubs sent to you. Also, if they take out state taxes, there will be a permanent record of all your wages earned in the state you reside. So, there are other ways to get the salary information. First, try IPay, then send email to support asking to have HR contact you about getting your past pay stubs. Just try.

I just got off the phone with TN office and she said our pay had to be decreased by 80% before we qualify unless we get laid off and MQ has to say we were laid off because of work going overseas. 80% pay cut??? anybody had an 80% pay cut? I have had a pay cut but not 80% so I guess that gets disqualified.

because I went from a decent hourly rate to penny production rate.

It is over half my pay. I thought that would be good enough.

You should apply for UE, then make appointment with local office. Once denied again send all info to federal office as a complaint. Do not give up. DO NOT. Not everyone that has qualified received an 80% pay cut. I believe staff are arbitrarily interpreting the Medquist TAA petition criteria and without accuracy. Do not give up.

"To be eligible for TAA benefits, you must have been laid off or put on a reduced work schedule (hours of work reduced to 80 percent or less of your average weekly hours and wages reduced to 80 percent or less of your average weekly wage) on or after the "Impact Date" and before the ending date of certification."

Please see link below. Please also note that your hours of work must be reduced 80%. You can't use a reduction in pay because of doing ASR. That is not a result of your work being off-shored.

Read the wording CAREFULLY. Word.by.word.

" . . . if your hours of work are reduced ---TO--- 80% of your average weekly hours . . . . "

TRANSLATION: You are working only 80% of your average hours.

" . . . wages reduced ---TO--- 80% of average pay . . . "

TRANSLATION: You are getting only 80% or less of your average pay.

The FEDERAL coordinator told me that yes, I am eligible -- I lost 50% of my pay proven by paystubs.

Your pay has to be reduced by 20% or more.

Your hours have to be reduced by 20% or more.

She said the wording was very poor on this.

I agree. Obviously people are reading it wrong -- including state coordinators.

Also, I received email from my TAA regional coordinator yesterday, Rosemary, and she explained the decrease in wages in detail. YOU ARE RIGHT. She said the same thing IN WRITTEN COMMUNICATION as well. The TAA coordinators throughout the U.S. now have a mandate from the federal office to understand the decrease relative to the 20% as you explained. It is not that hard to understand if you read everything. There will always be doubters. But, what I don't understand is why not apply, be turned down first, then come back and say the regional TAA director was wrong. You can always contact Rosemary for yourself. She is TAA regional director for 8 states.

I lefit MQ a few weeks ago and filed for unemployment sending a large amount of background documents/emails/paystubs, etc., to document that the job had changed, people were being laid off, work gone to India, etc. I've been trying to work with the local TAA person, but he is more confused than I am, but he did give me info with the phone number of my state's TAA rep, who called me right back and said since MQ is a NJ company I had to contact THEIR TAA coordinator, in the NJ Dept ...

I've seen a few posts about this in the past but can't find them now to review.  Has anyone ever responded to Nuance's request to come back?  If so, what happened?  I got a call and wondered if they really need me because I'm good or have had such a mass exodus that if they don't get qualified people to work their accounts they'll be losing them and lots of money too.  IMO, serves them right for what they did to those who worked loyally for compa ...

I would encourage everyone to call their local DOL about this issue. When we sit here for 20-30 minutes typing a job and lose it due to no fault of our own, we should be compensated for the time that we sat here.  I left a message for my local DOL, hopefully will get a call back, but it seems to me that constitutes not getting paid for hours worked, which is illegal.  If anyone else has checked into this, let me know. An account manager sent out an email suggesting that we monitor our emails on our weekend days off, and then log on to help if requested. Am I the only one who expects to not check emails or work during my one weekend day off?
