I've read several of the posts regarding MTSOs requiring MTs to complete HITECH training on their own time, work over 40 hours without reporting it, or forcing ICs to adhere to a schedule, etc.  Although not an attorney, I'm very close to an employment attorney, and here is a summary of the laws.  Please check out the FLSA (Fair Labor Standards Act) under www.dol.gov and check out your own state specifically.   

EMPLOYEE STATUS: 

1.  It is illegal for an MT to work greater than 40 hours in a work week (8 hours a day in some states) without overtime pay (1-1/2 times regular rate).  If caught, the employer is  fined huge penalties, which are then paid to the employees who were underpaid. 

2.  Required training, whether HITECH, platform, or any other required training, IS compensated time and must be paid by the employer. 

3.  Any time REQUIRED to be on the system "waiting for work", working with IT to resolve technical issues, etc., IS compensated time and must be paid. 

4.  Professional liability insurance is the responsibility of the employer and not the employee.

5.  No less than minimum wage can be paid for all hours worked. 

6.  These requirements are mandated by the federal government; however, some states have a higher minimum wage or higher standards.  In those cases, the employee's state standard is the required one.  (For example, some states require an employer to pay for jury duty, but that is not a federal law). 

INDEPENDENT CONTRACTOR: 

1.  ICs CANNOT be required to attend any training, etc., as they are fully trained when the contract is signed.  They are only paid a piecemeal or job rate per the contract.  (Can you imagine hiring a contractor to build a deck on your house, then requiring him/her to attend your training session on building decks?! 

2.  ICs are required to provide all necessary tools to do the job, so they cannot have any equipment or tools furnished by the company contractor. 

3.  ICs are not restricted to hours per week, hours per day, etc.  They can work all they wish with no overtime requirement.

4.  Minimum wage does NOT apply. 

5.  ICs cannot be asked to adhere to a specific schedule, specific hours, required hours, anything of the kind. 

5.  ICs must provide their own professional liability insurance--they are operating as a business. 

6.  ICs have no paid time off, no unemployment protection, no FMLA protection, no workman's compensation if they are injuried, no hoilidays, and no insurance coverage of any kind.  ICs are responsible to cover all of these risks/protections themselves--they run their own business. 

The only reason, and I cannot stress that strongly enough, that these companies continue to get by with their illegal practices is because we allow them.  We work for them, we do not report them, and we are not educated about our rights and responsibilities.  If you're an IC and do not have professional liability insurance, you are putting YOURSELF and YOUR FAMILY at risk.  And if you're breaking the law, and your employer is caught, you are responsible too. 

Imagine how our industry would change if MTSOs just upheld the law!

I've never been required to have self-insurance as an IC. Doesn't a signed confidentialty form cover that? Once the doctor signs any document, it's on him because he agrees with the information within. That can't be on the MT, employee or IC.

That's the way it used to be, but it's my understanding that the new HITECH law can hold the MT accountable for errors.

That's the biggest one. But there are others such as a requirement to be paid for training etc.

Not sure what your "close to an employment attorney" really means, like is you sit next to him on the bus or what.

I attended an AAMT conference a few years back and the attorney who spoke directly to the MTs regarding their situation did not agree with many of the things you've listed here.

Some of them are exactly right, but I question your source on some of the others.

First off, how many attorneys do you know ride the bus to work? Secondly, I wouldn't trust any attorney speaking at an AAMT conference because he is PAID to say what they want him to say. And we all know that AAMT is supporting the MTSOs more than the MTs. AAMT started the trend in cutting the compensation that MTs get and led the movement towards shipping work overseas.

If anyone questions the validity of anything the OP mentioned, call and find out. I did already and asked about most of the questions myself, and OP was right.

Hey Luvmt, I just read your post on ICs and I am very glad that you are here to help to educate us. I read the requirements for ICs and you are completely right we as having our own business do need to have our own insurance. My question is, that I do want to be an IC MT but I am not sure where I need to start, where I find liability insurance and basically what I need to do for equipment, etc. Would you be willing to walk me through the process. I appreciate it very much

I was just curious about what employees thought of Nuance on Glassdoor.  You read several US employee opinions and they reflect the morale listed on MTStars.  Scroll further down and read the opinions of the transcriptionists from India.  What a difference.  They are highly satisfied with their jobs and most have been working with Nuance for 6 to 7 years.  The US transcriptionists are very sad!!  What a difference..... ...

I just got a report where words were added that were essentially a diagnosis that could match the symptoms and treatment the patient had, but THE DOCTOR NEVER SAID THAT! Talk about adding words! Now MM ASR is diagnosing patients along with all the other extra words it adds. I'm an ex-Transcender and when I was approving my time sheet this morning I noticed that my time sheet said my percentage sent to QA was 20.2%.  I have NOT sent this many reports to QA as blanks, but have sent a lot of stuff due to discrepancies, no demographics match, no dictation, etc.  Are they seriously counting stuff that we have NO control over against us for purposes of denying bonuses?  I asked my TSM if that would be the case after we got news of the new pay cuts and ...

Is it really legal for Nuance to make us work a holiday, then we don't get paid for it because there are no reports, and then they expect us to work overtime another day to make up for the holiday we worked on that we were never paid for?! I missed 3 days and 3 hours of work due to computer crashing. It took all this time to purchase a new computer, get windows 8 out and windows 7 in, fix whatever for windows update to work and now I'm told I have to use PTO or MUP this week. Seriously?
