Win XP and HIPAA violations? (sm) - Ann Nony

What fines could MTSOs be faced with for HIPAA violations in requiring their employees to use Win XP, which is no longer HIPAA compliant?  I wonder if it might be worth an increase in line rate to keep our mouths shut.  ;o)

While I'm not sure what the monetary fine would be, I believe the minimum is $100; however, I do know that whatever the MTSO would be fined by HHS, the MT would also be fined.

Bull, the MT would be fined. The MTSO would be the one to - sign off on the content of that report SM

at the end when they submit it to the client, or if they let the MT submit it without any review or supervision. The MTSO is the top of the food chain of responsibility unless that's specifically written into any contract that the MT can and/or would be held liable. It's their responsibility to make sure the MT is trained to whatever specifications the client requires.

I'd like to see anybody try to sue me for an error if I'm under a MTSO. Big fat hairy chance of getting any money out of any of us.

Both claimed just having an XP computer on the network is not always an automatic HIPAA violation. You have to look at each situation and do a risk analysis which I doubt many of us can afford. It's definitely over my head. One article recommended that today you be sure your security and antivirus software has had the most recent updates.

I don't know that it's necessarily a HIPAA violation in and of itself. Biggest issue is probably being more open to viruses.

When Microsoft supports an OS, they are a little bit of a buffer for viruses. From there, you still need an anti-virus program, like Norton. So, I'd worry more about viruses than being non-HIPAA compliant with this. It's way above my head, but it's the sum total of things, not just Microsoft support.

I am trying to get a grasp on understanding HIPAA.  Does anyone have any suggestions where I can find "easy-to-understand" HIPAA rules?  I have a doct that I type his documents in Word and print them to letterhead for him and then hand-deliver them myself to his office.  Is this breaking HIPAA rules?  I just need to know what I have to be doing to be HIPAA-compliant and not aware of the facts.  Thanks for any input! ...

From what I am hearing, if you have an XP computer, you are not HIPAA compliant. It violates regulatory requirements. Then why is MM not supplying us with Windows 7? My XP computer they gave me was freezing up, so they sent me another XP. I asked them why they didn't send me Windows 7 and they said XP was cheaper. I try to follow it, take notes, but know deep down that when I do the test very little of it will have been absorbed, so am resigned to taking the test any number of times. Couldn't we just leave a note on any report with a cc to "please verify physician name for copy" which would then take the burden off of our shoulders? Not a QA marker, but by doing Ctrl + Shift + Q. I plan on leaving a note for anything that is questionable at all, ie., only last name given, unclear, cannot verify, whatever...
