IC HIPAA issue - whatwsthat

Feel the need to address certain posts

  1. "..and there are no such places as you describe any longer. I have been working for an MTSO that treats their ICs as employees without all the "benefits," but also looking for something else along the way. I have not found ONE...not ONE service that takes true ICs any longer."

This is called painting with a very broad brush. How can you claim that as accurate? Saying 'no such places' means you have literally checked into, inquired and experienced EVERY company out there which I would assume would be thousands. I currently work for a company as an IC and it is straight transcription and hire only IC MTs. I am paid much over the standard that's currently offered by a majority of MTSOs.

  • "...none of us chose for these companies to cheapen our pay and go into voice recognition. We were forced into it, so yes in that way we are a victim of greed. We can choose to either continue to put up with this crap or get out, so yes that is our choice."

Again, painting a broad brush to speak for everyone when it's just YOU that is having this opinion. 'Forced into it' ?? How is that possible? I tried for 5 years at 3 different companies before I found the one I'm in now, 3 years this month! Yes, it can be done. Of course you choose, it's not black or white='I'll either have a crappy job or get out' smacks of a defeatist. It takes effort and determination, and not caving in to meet a short-term solution. Think long-term when picking out a company; like a spouse or a car or a house.

My company is based out of Ohio, I work in California. We are NOT required to obtain liability insurance to maintain employment. I may check with our insurance company who handles our car and rental policies, perhaps I can get professional insurance and use it for a tax write-off as a business deduction.

This is NOT a dying line of work, it has gone through a metamorphosis for sure, but still a viable way to make a living. Negativity breeds complacency.  Wink

It is DEFINITELY a dying line of work - sm

If there was previously MANY MTs who had great jobs, but now there only a handful who have great jobs, then YES, this is a dying line of work. I don't believe anyone would argue that there are a few companies left. Even the fact that you even said it basically took you FIVE YEARS to find a "good company" I mean FIVE YEARS??? And you STILL chose to pretend that this industry is just fine?

Aside from how MTs think they are being treated and all of the complaints there, another sign to ME that this is a dying field of work is that I haven't been to ONE SINGLE DOCTOR in the past year that hasn't been accompanied by a laptop, dutifully putting in my information. We never saw things such as that years ago, when we were all smiling and rolling in our MT income.

reality check - sm

As much as the OP wants to believe that she or he is in a thriving industry, the truth is that our previously lucrative career is rapidly turning into a thing of the past. There is such a thing as being hopeful and optimistic, but we need to throw in a hefty spoonful of reality at the same time. I am staying with my company part time, until they fold or sell out to M-Modal or Nuance, whichever comes first. I can afford to because I have a full time job unrelated to medical transcription. At my full time job I have a wonderful benefits package. The days of being able to support oneself and even a family on a medical transcriptionist's salary are long gone.

MTs need to read and understand...the word 'thriving' not used in my post - whatwsthat

[ In Reply To ..]
I used 'viable'=adjective--capable of living--practicable; workable.

Of course not making a barrel of $$ but enough to support my household to a large degree and save on hundreds of dollars on gas, etc. It's not a perfect career but I love being an MT now for 40 years. Working in a hospital or a clinic wasn't all that great either. It's not that in the last 5 years I chose to switch companies but circumstances (sell-outs, not-so-good treatment) forced me to look elsewhere. Everyone has a different point at which where and when that is. I just disagree that being an MT these days is dying, and nothing said will convince me otherwise. When I stop getting a paycheck that reflects my production and effort, I'll be the first to admit "you're right!"

Nothing shady with my company, they are nothing but honest and forthright. HIPAA compliance is not that complicated.

Time to do some homework... - anon2

While it is great you are optimistic, it is time to do your homework on your "company." I'm quite certain I know who you refer to and you'de be well served to look at the legal status of things within the company. There are issues/trouble brewing that you are clearly not aware of in the IC world...not being rude to you just a heads up!

Proof is in the pudding, so to speak... - 4reality

I didn't want to believe it either, but the fact is MANY colleges and tech schools have dropped the program. Even the school I went to, no longer offers it, and it was a well-respected MT school.

The guidance counselor at the local community college told me that they are "all aware of what's happening to the medical transcription industry." We're being hit, and hit hard, by both technology and off shoring.

I also am aware of many clinics, including where my PCP works, which is a huge clinic, adopting point and click. They don't use MTs or need editing at all. The loss of many clinics has to have an effect on the volume of available work.

Then, I noticed, quite painfully, that my once stable workflow has now become increasingly sketchy, causing me to have to seek additional employment. I've been trying to find another MT position for months, and despite doing extremely well on exams, I am told they have no fit for me or are not hiring, etc.

Then, I noticed very large layoffs and/or outsourcing to Nuance occurring all over, including a recent newspaper article about many MTs at a major teaching hospital being forced to work for Nuance or become unemployed.

And, don't forget that most of us have either lost pay or it flatlined 10+ years ago: no raises, slim to no benefits, etc.

To deny all this is happening, is to deny reality. Sure, there are pockets left, but mostly we are finding editing, which pays really lousy.

So, I'm seeking an outside job, and I have an interview tomorrow! I must admit that I am extremely excited!

Could you honestly recommend this "career" to someone you care about? Have them acquire student loans at one of those for-profit schools?

I would not do that to someone. My advice to anybody thinking this would be a nice career, etc., please don't do it. Go into something better, more stable, where you aren't "flexing" your shift to the middle of the night hoping to scrape up enough lines to keep the electricity on.

HIPAA - Need A Quick Check On HIPAA Rules
Oct 29, 2009

Hi, I need a quick check on HIPAA rules.  With respect to the health care debate, I want to write to my senator, etc., about a situation with a patient I transcribed on.  The only info. I intend to give is that the patient was a:  Russian immigrant, on welfare and receiving Medicaid benefits--when he should not have.  He and his "sponsor(s)" was responsible for his care and living expenses.  Further, I transcribed a note in which the doctor said that this patient wanted to re-sched ...

Well, So Much For HIPAA Law
Feb 04, 2011

My husband went in to have blood tests done for a new blood pressure medication he is on and when he left the house to get an RX filled, the nurse from the doctor's office called to tell him the results of his blood tests. Out of curiosity (testing the HIPAA thing), I asked her if his potassium level was okay and SHE TOLD ME that all his levels were fine except blood sugar was a little high! Not only that, I then asked her what new medication had been prescribed and SHE TOLD ME THAT ALSO! M ...

Understanding HIPAA
Jan 21, 2010

I am trying to get a grasp on understanding HIPAA.  Does anyone have any suggestions where I can find "easy-to-understand" HIPAA rules?  I have a doct that I type his documents in Word and print them to letterhead for him and then hand-deliver them myself to his office.  Is this breaking HIPAA rules?  I just need to know what I have to be doing to be HIPAA-compliant and not aware of the facts.  Thanks for any input! ...

Regarding HIPAA - This Is Important For MTs
Jan 28, 2010

if we are to be held responsible for any kind of so-called 'security breach' which can be so easily manipulated to either just get ridf US MTs or at least make life a iving ____ for those of us left in these jobs (for example, if your reports are not 100% perfect - because 98-100% would no longer make sense because an error is an error and all are a security risk and breach - (this is so ridiculous I almost cannot even write it)); however, an MT can and will be fired for such?  Im ...

Question About HIPAA
May 29, 2010

I had to take my 18 year old daughter to the ER the other night because she cut her finger (not seriously thank goodness).  Being a medical transcriptionist I was rather surprised, she was not given any type of HIPAA form to sign, was not told anything about HIPAA, I thought everyone had to sign one.  I always have received a form when I went to the doctor or the hospital but she signed absolutely nothing.  Is this something new or is it a HIPAA violation since she did not sign an ...

HIPAA Violations ...

First of all....isn't any medical report being typed out of our country by a another country that isn't required to follow HIPAA regulations.....well a HIPAA violation?  Not to mention a potential homeland security risk! So, my ex-husband of 15 years called my and my son's doctor's office and gets all of our medical and billing information (son is 21).  Takes those documents and files suit in court against me using the documents he obtained fraudulently to claim that I have lied about the cost of our son's medical bills (he has been ordered three times to to pay 50% of those costs which only amount to about $2,800).  Y'all get that?  He committed fraud in order to prove that I have committ ...

HIPAA Rules
Oct 08, 2013

When a consultant's office calls the referred patient, is that office allowed to say the name of their office?  Ex:  Got a call from a GI office for my husband.  The woman gave her first name and said she needed his medical hx before she could schedule an appointment.  I asked what office she was from, and she said she couldn't say because of HIPAA but that it was a referral from his PCP.  Is it true that because of HIPAA we can't even know who's ...

Nov 11, 2013

I posted earlier about a HIPAA violation I believe the company I am subcontracting for is committing. I'm considering filing a complaint, but not sure what this would entail. Before I go too far into it, has anyone filed a complaint against an 'employer,' for lack of a better term, as I am a subcontractor & not an employee? This issue is weighing heavily on my mind. HIPAA Compliant?
Apr 23, 2014

From what I am hearing, if you have an XP computer, you are not HIPAA compliant. It violates regulatory requirements. Then why is MM not supplying us with Windows 7? My XP computer they gave me was freezing up, so they sent me another XP. I asked them why they didn't send me Windows 7 and they said XP was cheaper. So now as of April 8, they are not HIPAA compliant. I would like to know how they get around this,,,,,,having many accounts and still having many employees submitting reports u ...

I get why they do these webinar things, but honestly, the person narrating sounds like she herself is bored. I try to follow it, take notes, but know deep down that when I do the test very little of it will have been absorbed, so am resigned to taking the test any number of times. It's kind of like watching a weather report you are waiting for, yet then when it comes on you realize you have completely blanked and it's over. I have a real problem focusing on webinars. ...

Question: If New HIPAA Laws Are Going To Come Down
Dec 23, 2009

sending a copy of the report to the wrong doctor, what about sending all this work offshore?  What am I not understanding?  If sending a copy to the wrong Dr. Smith constitutes a huge breach of security, then sending people's health records and personal information offshore constitutes a GIGANTIC breach of security.    ...

Question About HIPAA Rules
Jan 13, 2010

Couldn't we just leave a note on any report with a cc to "please verify physician name for copy" which would then take the burden off of our shoulders? Not a QA marker, but by doing Ctrl + Shift + Q. I plan on leaving a note for anything that is questionable at all, ie., only last name given, unclear, cannot verify, whatever... I am not going down with them.  Fire me for it, then I will file for unemployment and win because they cannot fire you for a doctors mistake and then I might ...

Well, It Has Already Started, HIPAA Laws.
Feb 13, 2010

If we do not check our screen where patient name, info, attending, date of birth, blah blah blah is not correct or we did not check to make sure the dictator name is correct or attending name in the screen, of did not fill in attending or dictator for, this will have to be notified to HIPAA.  If company does not notify HIPAA that an MT made a mistake and did not correct patient name, dictator name, attending, etc., my company will be fined big time and possibly the MT too.  Honestly, ...

HIPAA Data Breach
May 02, 2010

I am reading far too many cases of MTs being fired/threatened for copying the wrong doctor on a report.  While this constitutes an error, it does not (NOT) constitute a HIPAA breach.  HIPAA law is being wielded like an axe by misinformed management, with the regulations being used to threaten and fire a huge segment of the American workforce.  MTs fired for a "cc" issue need to report their job loss to their state labor department as well as the department of health and human se ...

What a joke. They come down on us so hard about this, but there is information on ADT we have no reason to see such as SS numbers. I have a couple of dictators who actually dictate the patient's SS number and say to put it on the report. Not to mention the wrong patient information and cc names given by the dictators. I now will always leave a QA note every time a cc name is given without the first and last name or any ADT names given without first and last name. With thousands of MTs wor ...

Questions About HIPAA Rules
Jun 15, 2012

I was wondering if anyone had any knowledge in regard to HIPAA violations and whether certain rules apply only in certain circumstances.  I had a workers comp claim and had my IME closing exam in March.  There were problems - the doctor assumed that he knew it all, didn't take any history from me and then rushed me through the exam and closed my claim.  I wasn't happy with the way the exam was conducted, and then on reading my exam report I found a number of mistakes, so ...
