Payment for transcription work - duffy

I worked for a small transcription company. They only paid me for half of the work I did for them and refuse to pay me for the rest. When I try to collect from them they tell me to sue them in small claims court if I want the balance. Any suggestions to get my payment? I am in one state and they are located in another state.

but I believe it has to be in their state. Depends on how much they owe you as to whether or not it's worth it. Hopefully, you've registered a complaint with the BBB.

You might also want to inquire as to how much an ad in their local newspaper would cost :)

And then there's the old share the name in every venue possible attached to - THEY DON'T PAY.

Hopefully you also kept some kind of a log, or other record of the work done and not paid. If not, it's still likely that the right PC tech can extract a record of every keystroke you made on your PC while doing their work. (They say nothing you put on a PC is ever really "gone forever"...)

Finally, regardless of how much or how little is owed, go after them for the PRINCIPLE of it. You did the work in good faith. They should pay you for your work. Period. If they don't like you, don't need you, lost the account, WHATEVER - you still did the work, and they still have to pay you for it.

Make an example of them. Take them to Small Claims Court, or get in touch with the State Labor Board in both states: yours and theirs, and find out which one(s) have jurisdiction.

Then, SUE THEIR A$$E$ !!!

Their cockiness about not paying you, and then daring you to take them to court, shows that they're banking on taking advantage of a person they don't think has the resources, the time, or the chutzpah to go after the money. If they stiffed me on pay, and then dared me to sue them, I would SO have to sue them, even if I knew I would lose, just on the princple alone. If nothing else, I would have the satisfaction of dragging their sorry behinds into a courtroom.

If you can get the Labor Board involved, by all means, DO. Those are a bunch of bloodthirsty barracudas, that love nothing more than to rip employers like this to shreds. I know. I filed a claim against a non-paying employer once, and when the L.B. got on the case, they not only got me my money, PLUS back insurance money I was owed, but also found numerous other illegal little things this employer was doing. (Most of what we see these shysters doing is just the TIP OF THE ICEBERG, you know!) They were put out of business. The owner did a little bit of jail time. Then she had a nervous breakdown, and left the MT business for good, which was as it should be.

GO FOR IT. Go get the money you're owed, along with (if nothing else) the little bit of extra satisfaction you'll gain by giving the crooks a hard time.

If you're an IC the DOL has nothing to do with it, so you'll find no help there.

Small claims court would be about your only option.

Just be prepared to still not get paid. Just because you win in Small Claims does not mean they are going to come up with the money. Then you end up having to go back to court to get a court-order to actually attach their assets. I am sure that is why they told you to sue them.

For the principal of the matter I would still take them to small claims court, just be prepared it might have to be more than one filing. The problem with Judge Judy or any of the other TV court shows is that both parties have to agree to have it settled in that forum. They are not going to want the nationwide publicity, if they are still in business. It would be a great venue to show the shoddy business they are, but more than likely they are not going to agree. UNLESS they are really cheap or really broke because you know the show pays the judgement for them so they end up not having to pay a dime.

I mean, do they give you a reason why they feel they are only justified to pay you half, like quitting without notice, poor work performance or anything like that? Not saying you did anything wrong, but a lot of people have that small print where they try to screw you in the end. My husband's job (not transcription) has in his contract that if he quits without notice his final two checks will be paid at minimum wage, instead of his regular salary.
