Execuscribe: any info on how they - ensure federal guidelines with regards to minimum wage - and overtime laws

Posted: Jan 10, 2010

Anyone currently work for or recently just left ExecuScribe have information they would be willing to share about how they pay?  I am curious about the statement they have on their web site.  How do they handle down times (no work, computer/internet not working, etc) to “ensure…federal guidelines with regards to minimum wage and over-time laws”?

Since they require testing with the application, if you are willing, could you also answer the following, so I know if taking the test is worth the time?

          1.  As an IC, is the minimum starting pay above .09 cpl for straight transcription?

          2.  Is it mostly straight transcription or VR?  If VR, what cpl for VR?

Thank you for taking the time to reply.  You can Email me also if you are more comfortable doing it that way.

How will I be compensated?
ExecuScribe compensation is based on a number of factors at the time of hire, including: test scores, years of experience, CMT status, and difficulty of account hired for. Home-based employees are paid on a production basis. Most account production is based on the standard 65 character line (including spaces). Radiology account production is paid on a report basis. Though ExecuScribe pays its home-based employees on a production basis, we ensure that we meet all federal guidelines with regards to minimum wage and over-time laws.

I guess there are 2 offices:

ExecuScribe, Inc.

1320 University Avenue

Rochester, NY    14607

***

ExecuScribe, Inc.

1910 Abbott Street, Suite 202

Charlotte, NC    28203

By the way, if anyone decides to apply and take their test, one word of caution for anyone who has any “special characters” in their name like a hyphenated last name.  You have to fill out the whole application before they enter your info into the testing page and send you a password to take the test.  Well, my name is hyphenated, and the password they sent included the hyphen, but when I tried to log in, I got an error message:  “password cannot contain any special characters,” so if anyone else plans to take the test, leave out any “special characters” when you fill out the application.

I am curious of these CLIENT Testimonials are too good to be true?

"The transcriptionists go beyond merely typing a document; they note discrepancies in the dictation so that we can investigate, thereby providing an accurate patient medical record. They are ‘human spell checkers’ who will follow up to ensure that medications, terminology, etc., are spelled correctly."
-Orthopedic Surgeon

"As the person responsible for selecting a transcription service for the 800 member faculty group at Strong Memorial Hospital, I am proud to say ExecuScribe has been a perfect fit. The customer service, response time, and quality control are superb. I am happy to report that with the suggestions you and your staff have made, the quality of our transcription is better than ever. Thank you for providing an outstanding service - you have made my job easy!"
-Associate Director, Health Information Management

"After dealing with a number of issues with our previous provider of transcription services, I thought outsourcing transcription was a nightmare. ExecuScribe has changed my mind! You have exceeded my expectations well beyond what I thought any transcription company could do. The quality and turnaround time is excellent. You and your staff are wonderful to work with, always willing to help problem solve any issues that we encounter, which I truly appreciate."

Where are you seeing IC? Many references sm - just me

to "employee" throughout the job section, I don't think they hire IC and the statement of ensuring they adhere to employment laws also indicates they only have employee status.

It is in the actual application - they ask about availability, days, hours; and you can - click - Employee or IC

[ In Reply To ..]

I would think it would be a big waste of time to ask if you want Employee or IC status if they do not offer IC status anymore, but then again, MTSOs never want to spend money updating their web pages, so it is very possible that they simply have not updated that section.

If anyone has applied with them recently and checked IC, I would be interested to know if you heard back from them about that.

As far as their "minimum wages" statement, that is one reason I asked.  Why would they keep that in the FAQ, while asking if you want to be an IC.

Nothing makes sense at that company, so I was hoping someone working there or who recently applied might be able to shed some light on this multiple-personality company.

If you want IC, none of the laws apply to you/SM - observer

in that case anyway, so it's a moot point.

The way I see it, they probably have mostly employees and that's why the site is geared toward them. It also may be a situation where they will not hire employee status from certain states and that's why the IC status.

I worked for this company a few years ago and have known the owner for over 20 years (not friends but know her from this business) and the pay was at that time below standard for employee. As far as I know they did away with ICs or you had to buy Workman's Comp ins...I left for a better job but then was thinking of going back part time a few years later but they had all these new rules when you were "new" like only working certain hours and doing 5 reports a day and they were putting me back on the acct I had been on so I said no. Hope this helps.

ExecuScribe minimum wage and overtime - EStran

I cannot speak for IC as I am an employee. However, as you are required to both work a minimum number of hours, as well as transcribe a minimum number of lines per day, if your hourly rate (based on the number of lines transcribed and hours worked in a pay period) calculates to be less than minimum wage, you will instead be paid minimum wage for the total hours worked rather than your line rate for those lines typed. As far as overtime, it is stressed never to work more than 40 hours per week. Neither of these has ever applied to me - I've always made well over my required line count (1200/day for FT) in far less than 40 hours per week. Hope that helps a little.

Question: If somebody turns in 98% accurate work,...sm - minimum lines

[ In Reply To ..]
but is not able to transcribe the minimum number of lines per day (employee) is this a reason to get fired?

Are some companies more lenient with this requirement, or do they all fire?

I've never been in that position, but I believe/SM - observer

[ In Reply To ..]
most of the large companies will talk to you if you seem to be not hitting the line count, but it can't go on indefinitely, so you would go thru disciplinary actions until you are fired.
I thought so, thanks!...nm - minimum lines

Federal Guidelines To Meet For ICs Under HIPAA
Sep 09, 2013

So I passed the BA Agreement, proof of liability insurance and Policies and Procedures with the company, so I may still be able to work as an IC and not an employee, but here is their response: "You must first provide proof that you meet the Federal Guidelines to remain an IC before providing proof of insurance or policies and procedures. You can research this by doing a Google search but these guidelines MUST be met in order to remain an IC." I already also passed the HIPAA training. What e ...

Wage Theft -- At Federal Level Says This Only
Mar 13, 2015

This is all you get at the Federal level: "No deduction may be made from an employee's wages which would reduce the employee's earnings below the required minimum wage or overtime compensation." You have to look to see what your state says about it to see if docking pay for mistakes comes under wage theft. As we know, they will give you MUP if you fall below minimum wage, so they have covered themselves on that, unless your state says differently. ...

Minimum Wage In MA And MUP
Nov 20, 2013

Massachusetts may well pass a minimum wage of $11 (over 3 years).  It's passed the state senate.  Parts of WA (Seatac) actually have a $15 minimum wage.  Wonder what Nuance will do about MUP now, since so many in those states will be getting it.  Could get interesting.  ...

DC Minimum Wage
Dec 18, 2013

Okay, so I read by 2015, DC wants minimum wage to be $11.50 an hour. I'm assuming by that time Nuance will make our minimum line count reflect this increase - approximately 280 lph, especially since WE NEVER GET A RAISE. ...

At Least Got Minimum Wage
Dec 17, 2014

Bottom line is, regardless of the new pay rules, it's hard to even make above minimum wage before or after the new rules. So at least federal law guarantees minimum wage. Beyond that, my goal is to get out of this field and leave this MTSO company ASAP, though it won't happen overnight. ...

Minimum Wage
Jan 25, 2015

A $15.00 minimum wage would equate to 375 lines per hour at .04 per line. That's 3000 lines a day for an 8 hour day! The best I have ever done was 2700 lines editing in an 8 hour day and that was only once and someplace where I had been doing the same doctors for 6 years. Guess I would get fired for always getting MUP. And by the way, that's 428 lines per hour (3424 lines per day) at .035 per line and 500 lines per hour at 0.03 (4000 lines per day). If more cities raise the ...

Working Below Minimum Wage
Apr 05, 2010

With the last spate of "changes" including institution of the latest version of DocQScribe -- the blossoming of the "swap board" and the "waving bye-bye" of accounts of 8-years' duration -- as they switch to using TEMPLATES (God Bless Electronic Medical Records) --my income has dropped more than 50% in the last 6 months.  But hey, I'm not concerned.  After all, I'm an idiot to begin with.  I have no intellect, no language skills, no research skills, no "shorth ...

Minimum Wage On Pay Stub
Jun 10, 2010

On today's check I had 0.25 hours at minimum wage, and I have no idea why. I have always produced my 150 lph minimum every day since I started. I am not making a ton of money, but my hourly average is more than minimum wage. Now I am getting really paranoid. Of course, I am in the over 10 cpl category. This just can't be right, but I fear it has put me on some big-wig's termination radar. ...

Minimum Wage Question. (sm)
Nov 14, 2011

I have heard in various places on these boards that if you are supposed to work full-time and your pay (by the line or character) doesn't equal minimum wage for those hours, you can get unemployment even though you still have a job. Does anyone know if that is true? Does it apply to part-time work? If anyone has a link to valid information, please let me know. I don't even know where to look, but I'm dying here with NJA when I'm supposed to be working, getting no response ...

SGS Pays SOME MTs Minimum Wage
Nov 27, 2011

On a post below about SGS, an MT states that she is being paid minimum wage.  She states she had to 'fight' for it, however, they are paying her minimum wage on the accounts where she is scheduled, and expected, to sit in front of her computer when there is very little work. I have asked several coworkers about this, and some of them are being paid minimum wage, as well.  Not all; only the ones who requested (demanded) it. THERE GOES ALL MTSO CLAIMS THAT SINCE WE' ...

Minimum Wage Issue Again
Dec 02, 2011

I was reading a post placed earlier today about minimum wage and calling employment lawyers, etc.  Why can't we all get together, hire someone to represent us (like a lobbyist) or start our own organization since AAMT bailed on us.  There is power in numbers.  We just need someone who is a leader to step forward and make this happen.  I would be willing to pay a small sum of money on my part to get something started for us to have some type of representation to get our i ...

STILL Making Just Over Minimum Wage!
Apr 04, 2012

I LOVE working from home. I love my CCM, she is extremely understanding and flexible, which is what I need! Due to this, a few weeks ago I decided I just had a "bad attitude" and needed an adjustment. So I put my nose to the grindstone and produced almost 5,000 more lines than normal or required (80 hours). I had quite a few straight transcription jobs, and was confident my paycheck for the last pay period would be awesome! Although it was approximately $70 more than normal, I still figured ...

MTSO And The Minimum Wage
Jun 25, 2012

I decided to drive to the Labor Department and ask them directly about this issue, with respect to the fact that MTs who work as employees are paid "per line." The guy said, "It doesn't matter what type of work you do, by federal law you must be paid mininum wage." --- Even if the agreement is for "per line," it must equal mininum wage. So folks ... start keeping very strict records of when you're working and ONLY when you're working. That means, if you get up to go to the ...

Minimum Wage With Overhead?
Feb 25, 2013

I graduated last year from MTEC.  I've been working since November at a national company and am earning minimum wage of $8.00.  Many recommend that you earn a certificate--starting with the RMT and later the CMT.  According to my research, each test costs about $200.  In addition, it is recommended that one keep up with the field by attending conferences and the like occasionally, which also tends to cost some money.  Now, I can understand the "overhead" if being a ...

Even With Accurate ASR, Still Minimum Wage.
Mar 18, 2013

I had a couple of ASR reports that were stellar, being of the quality we were promised (of course, not from my usual accounts), and yet, the lph was still around minimum wage (hovering around 200). What's up with that!? The new statistics graphic shows the proof. Geez, they keep handing us more and more proof that earning a living wage doing ASR for MM is hopeless. Anyone doing at least 300 lph without having dictator standard reports? ...

Minimum Wage Boost
Jun 22, 2014

Did you know that minimum wage will be raised from $8.00 to $9.00 next month, at least in California? So I wonder what that means for Nuance. Does that mean that the minimum line per hour will now be mmore than the current minimum of 186 lines/hour to meet minimum wage without having the company pay MUP or make-up pay? Or does that mean that they will give employees a raise and leave required lines at minimum of 186 lines? I wonder. ...

Why We Should Be Making More Than Minimum Wage
May 09, 2015

If our skills are valued the same as fast food workers, then why do they require at least one year's experience as an MT to be hired? Why do newbies have to have gone to school? Why the lengthy testing before being hired? Any 16-year-old with no work experience can be hired at Burger King, so why not as a medical transcriptionist? I don't understand the reasoning behind lowering our income to minimum wage and making it next to impossible to advance beyond minimum wage, even for peo ...
