DOES ANYONE KNOW IF MINIMUM WAGE APPLIES TO MT'S - No work equals less than minimum wage

I am just curious if we are entitled to minimum wage since those of us who are employees are required a minimum to keep benefits and yet not making minimum wage and just sitting here not making any money while accounts are over staffed? 

I believe minimum wage pertains to hourly rates. - not production.

If you are an employee, they have to make up the difference so your weekly pay equals 40 hours x min wage (whatever that is) assuming you worked 40 hours. However, it is my understanding they can say you must take the time off without pay if there is no work.

Many of the larger companies cheat the system by having you fill out a time sheet reflecting ONLY the time you had your hands on the keyboard producing a document. So if you work 60 hours but 30 of those hours you were waiting around for work to come in, you only worked 30 hours. Quite illegal, IMO and not something I'd ever agree to and companies that do this, I wouldn't work for.

what they are doing is a federal offense in asking you to falsify your time sheet. Go to the Labor Board and rat them out.

that is usually impossible. So then they claim to be doing us a big favor by allowing us to *flex* our time (no matter how long it takes) in order to make our minimum line count.

Legally I believe they are supposed to keep track and insure that you are making the minimum wage in your state. I worked for one company where you had to fill out a time card and everything! But then the others I've work for didn't do anything.

Minimum wage laws include ALL employees everywhere, including MTs. It doesn't matter whether your company pays you hourly or by the line. In either case the company is legally required to make sure that you are being paid at least minimum wage.

If your lines counts are lower than minimum wage because you're sitting there waiting for work, then your company is legally required to make up the difference in order to bring your pay up to at least miniumum wage. If your company is not doing this, contact your state's Department of Labor.

This applies only to MTs who are employees. Minimum wage laws do not apply to ICs. And this is one of the reasons why so many MTSOs try to skirt the law by misclassifying their MTs as ICs instead of employees.

Now, that being said, your company is probably not REQUIRING you to sit and wait for work (time you are not being paid) but you are assuming or taking their suggestions as direction to sit and wait for work.

But for the hours you worked on the clock, they must guarantee you at least minimum wage gross wages.

It is law that you make atleast the minimum wage rate in your state. Even in a production based job. If you don't make minimum wage with the lines you type, your company is required by law to make up the difference to get your pay to the minimum wage level. However, the time you are not working because of NJA, you are not legally considered on the clock so that time does not count against your 40 hour work week. This is my understanding, but I am certainly not an expert. This, of course, does not apply to IC MTs.

A $15.00 minimum wage would equate to 375 lines per hour at .04 per line. That's 3000 lines a day for an 8 hour day! The best I have ever done was 2700 lines editing in an 8 hour day and that was only once and someplace where I had been doing the same doctors for 6 years.
