I communicated several times with the wage and hour specialist. Here is the final email he sent. Its kind of confusing, but apparently right of first refusal unfortunately does not apply to us. It only applies to building services contracts for public buildings.

"I recall us speaking on the phone but also wanted to provide this link that may better explain what the executive order applies to specifically. This is a link to the pre amble for the final rule. It basically offers more details than the regulation itself and can help provide a better understanding of the concepts contained within the regulation. Specifically, 9.2-9.4, explicitly speaks on service contracts performed at a public building and offers a few examples. Please let me know if you have any additional questions."
